AGP for Respondent: 1, \nNone\nfor Respondents : 2 -\n5. \n================================================= \n\n\n\t \n\t\t  \n\t\t \n\t\t  \n\t\t\t \n\t\t\t\t \n\nCORAM\n\t\t\t\t: \n\t\t\t\t\n\t\t\t\n\t\t\t \n\t\t\t\t \n\nHONOURABLE\n\t\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\t\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/04\/2011 \n\n \n\n \n \nCOMMON\nORAL ORDER<\/pre>\n<p>:\n<\/p>\n<p>In<br \/>\n\tthis group of petitions, this Court on 21\/4\/2011 passed an order,<br \/>\n\tindicating the grounds on which the petitions were filed challenging<br \/>\n\tthe notice dated 11\/4\/2011, and challenge to the action for process<br \/>\n\tof registration of new proposed societies.\n<\/p>\n<p>Today,<br \/>\n\tlearned AGP Ms. Jhaveri has placed on record the communication from<br \/>\n\tTaluka Development Officer, Kalawad to Addl. District Registrar,<br \/>\n\tJamnagar, indicating that the notices dated 11\/4\/2011 is revoked for<br \/>\n\tthe reasons stated thereunder. Copy of the said communication<br \/>\n\tis taken on record. Learned AGP has placed on record fax copy of the<br \/>\n\tnew notices dated 18\/4\/2011 \/ 20\/4\/2011 to the 7 petitioners calling<br \/>\n\tupon them to furnish their objections, if any, and fixing the<br \/>\n\thearing on 26\/4\/2011 \/ 27\/4\/2011. This fax copy of the notices are<br \/>\n\talso taken on record.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioners stated that, some of the petitioners<br \/>\n\thave received notices only on 23\/4\/2011. Be that as it may; this<br \/>\n\tCourt is of the view that even when the order was made on 21\/4\/2011<br \/>\n\tby this Court, the notices impugned in this group of petitions did<br \/>\n\tnot exist.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioners therefore withdraw this group of<br \/>\n\tpetitions with a view to take out fresh petitions challenging the<br \/>\n\tnotices dated 18\/4\/2011 and 20\/4\/2011 and submits that, the fresh<br \/>\n\tnotices which are intended to be challenged also suffer from patent<br \/>\n\tillegality, some of them could be summarised as under, namely;\n<\/p>\n<p>i)<br \/>\n\tThe authority while inviting objection has called upon the<br \/>\n\tpetitioners society to produce balancesheet from the date of<br \/>\n\tregistration till the date of hearing.\n<\/p>\n<p>ii)<br \/>\n\tDocumentary evidences and testimonials to indicate that the society,<br \/>\n\ti.e. the objector is functioning as per its objects.\n<\/p>\n<p>The<br \/>\n\tpermission for withdrawal is granted, with a liberty to file fresh<br \/>\n\tpetition challenging the notices, registration process and proposed<br \/>\n\tregistration that have been issued. At this stage Ms. Jhaveri,<br \/>\n\tlearned AGP under instructions from Shri D.K. Gamit, Addl. District<br \/>\n\tRegistrar, Panchayat, stated that even the notices dated 18\/4\/2011 &amp;<br \/>\n\t20\/4\/2011 are withdrawn with a view to issue fresh notices in<br \/>\n\taccordance with law. In view of this statement, the petitions are<br \/>\n\tdisposed of as withdrawn. It is observed &amp; clarified that the<br \/>\n\tauthority is entitled to invite objections in accordance with law<br \/>\n\tand if the petitioners are aggrieved in any manner, they are also at<br \/>\n\tliberty to challenge the same, in accordance with law. No costs.<br \/>\n\tOffice to maintain copy of this order in each of the petitions.\n<\/p>\n<p>\t                                 [<br \/>\n\tS.R.
