Justice V.GIRI\n\n Dated :28\/07\/2009\n\n O R D E R\n                              V.GIRI, J.\n                        -------------------------\n\n                   W.P (C) No.2533 of 2009\n                  ------------------------------------\n\n                 Dated this the 28th July, 2009\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner was working as an operator in &#8216;pure<\/p>\n<p>water section&#8217; in the Kerala Water Authority.           He was<\/p>\n<p>seriously affected by leakage of chlorine gas poisoning<\/p>\n<p>while on duty. He was not compensated in this regard. He<\/p>\n<p>approached    the  Human        Rights      Commission.    The<\/p>\n<p>Commission recommended that an amount of Rs.1,00,000\/-<\/p>\n<p>(One lakh only) be paid to the petitioner as interim<\/p>\n<p>compensation.    The operative portion of order in Ext.P1<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>            &#8221; We therefore recommend the Government<br \/>\n      being the Principal Employer to pay a sum of Rs.1<br \/>\n      lakh to the petitioner as an interim measures and<br \/>\n      make further payments if any after final decision by<br \/>\n      the Government as indicated.          There will be a<br \/>\n      recommendation under Regulation 46 of the Kerala<br \/>\n      State Human Rights (Procedure) Regulation in the<br \/>\n      above terms&#8221;.\n<\/p><\/blockquote>\n<p>W.P (C) No.2533 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>     2.  The amount of Rs.1 lakh has been paid but the<\/p>\n<p>claim made by the petitioner has not been finally decided.<\/p>\n<p>Hence this writ petition.\n<\/p>\n<p>     3.  Ext.P2 is pending before the 1st respondent.<\/p>\n<p>Learned Government Pleader submits that Ext.P2 will be<\/p>\n<p>looked into and appropriate action will be taken by the<\/p>\n<p>Government keeping in mind Ext.P4 within three months<\/p>\n<p>from the date of receipt of a copy of this judgment.<\/p>\n<p>     Submission is recorded.
