NO. 1953 OF 2008\n              = = = = = = = = = = = = = = =\n        Dated this the 27th day of January, 2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Pala in O.P.(MV)286\/05. The<\/p>\n<p>claimant, a 24 year old man sustained injuries in a road<\/p>\n<p>accident and he has been awarded a compensation of<\/p>\n<p>Rs.85,380\/-. A perusal of the award would reveal that he<\/p>\n<p>had some head injury for which he was treated as an<\/p>\n<p>inpatient in a hospital for a period of six days. A disability<\/p>\n<p>certificate is seen issued by a retired civil surgeon that too<\/p>\n<p>without any further investigation.       He has assessed the<\/p>\n<p>disability at 11% and the Tribunal without any hesitation has<\/p>\n<p>accepted the said disability certificate. I do not want to say<\/p>\n<p>anything at this stage for the reason I am inclined to send<\/p>\n<p>back the matter to the Tribunal with a direction to refer him<\/p>\n<p>to a Medical Board.     The Medical Board shall consist of a<\/p>\n<p>neuro-surgeon and after the receipt of the certificate from<\/p>\n<p>the Medical Board the matter be reconsidered and<\/p>\n<p>M.A.C.A. 1953 OF 2008<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>appropriate award to be passed. Therefore the award under<\/p>\n<p>challenge is set aside and the matter is remitted back to the<\/p>\n<p>Tribunal with a direction to refer the claimant to the Medical<\/p>\n<p>Board and thereafter to decide the matter in accordance with<\/p>\n<p>law after affording equal opportunities to all sides to adduce<\/p>\n<p>evidence. Parties are directed to appear before the Tribunal<\/p>\n<p>on 2.3.09.\n<\/p>\n<p>     The MACA is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                           M.N.
