NO.28344 OF 2008\nRAMA KANT CHAUDHARY, SON OF FAKIR CHAND CHAUDHARY, RESIDENT\nOF VILLAGE AND POLICE STATION NAGARNAUSA, DISTRICT NALANDA\n                              VERSUS\n                        THE STATE OF BIHAR\n                               *******\n<\/pre>\n<p>2    20\/06\/2011             Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                  appearing on behalf of the State.\n<\/p>\n<p>                            The petitioner is aggrieved by the order dated<\/p>\n<p>                  12.03.2008 passed in Nagarnausa Police Station Case<\/p>\n<p>                  No. 26 of 2007 (Trial No. 2149 of 2008) by which the Sub<\/p>\n<p>                  Divisional      Judicial    Magistrate,     Hilsa   has    taken<\/p>\n<p>                  cognizance for the offence under Section 7 of the<\/p>\n<p>                  Essential Commodities Act.\n<\/p>\n<p>                            The submission on behalf of the petitioner is<\/p>\n<p>                  that when the inspection was made, it was found that the<\/p>\n<p>                  shop was closed and therefore, no physical verification<\/p>\n<p>                  took place of the shop in question. It is also submitted<\/p>\n<p>                  that there is no specific allegation regarding black-<\/p>\n<p>                  marketing of the items that were stored in the shop of the<\/p>\n<p>                  petitioner.     Lastly, it is submitted that the case of the<\/p>\n<p>                  petitioner is covered by the decision of this Court in the<\/p>\n<p>                  case of Md. Waizuddin vs. the State of Bihar [2007 (1)<\/p>\n<p>                  PLJR 714].\n<\/p>\n<p>                            All    these     aspects   of   the   matter   may   be<\/p>\n<p>                  examined at the stage of framing of the charge when the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        Court below will have the liberty to peruse the case diary<\/p>\n<p>        of this case.
