No. 1134 of 2007\n                 - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 14th day of June, 2010\n\n                                 O R D E R\n<\/pre>\n<p>     This review petition is filed by                         the Kalpetta<\/p>\n<p>Municipality against the judgment dated 17.08.2007 in the<\/p>\n<p>writ petition which reads thus:\n<\/p>\n<blockquote><p>     This writ petition is filed with the following prayer:\n<\/p><\/blockquote>\n<blockquote><p>           1.    Call for the records relating to Ext.P2 and<br \/>\n           issue a writ of mandamus or appropriate writ,<br \/>\n           direction or order directing the 4th respondent to<br \/>\n           comply Ext.P2        direction issued by the 3rd<br \/>\n           respondent.\n<\/p><\/blockquote>\n<blockquote><p>     2.    In view of the directions already issued by the competent<br \/>\n     authorities, there will be a direction to the 4th respondent to<br \/>\n     hand over the key and records to the petitioner within a period<br \/>\n     of one month from the date of production of a copy of this<br \/>\n     judgment.\n<\/p><\/blockquote>\n<blockquote><p>     This writ petition is disposed of as above.<\/p>\n<p>     2.    The contention now raised is that, at no point of<\/p>\n<p>time the Municipality had any intention to part with<\/p>\n<p>possession of the building and the intention was only to<\/p>\n<p>handover the building to the petitioner for conducting<\/p>\n<p>repairs of the building to be returned to the Municipality for<\/p>\n<p>R.P. No. 1134 of 2007<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>continuing to use the building as school. The Municipality<\/p>\n<p>relies on Annexure 2 &amp; 3 orders in this regard. According<\/p>\n<p>to the Municipality, this is a tribal school and there is no<\/p>\n<p>other building to house the school.\n<\/p>\n<p>      3.     I have heard the counsel for the petitioner also.<\/p>\n<p>The Municipality did not file any counter affidavit in the<\/p>\n<p>Writ petition.       I doubt very much whether they even<\/p>\n<p>appeared for the hearing of the Writ petition on 17.8.2007.<\/p>\n<p>Admittedly by Ext.P2, the Deputy Director of Education has<\/p>\n<p>directed the Principal of the school to vacate the building<\/p>\n<p>and handover the key to the petitioner in the writ petition.<\/p>\n<p>Admittedly, the Municipality has not challenged that order.<\/p>\n<p>The learned judge only directed handing over the key as per<\/p>\n<p>the directions issued by the Officers of the Government.<\/p>\n<p>According to the counsel for the Municipality, the Deputy<\/p>\n<p>Director of Education had no jurisdiction to issue such an<\/p>\n<p>order in so far as the school belongs to the Municipality. I<\/p>\n<p>do not find much substance in that contention. Admittedly,<\/p>\n<p>the school was in existence years before the Municipality<\/p>\n<p>R.P. No. 1134 of 2007<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>was vested with the responsibility of running the school.<\/p>\n<p>The school continued to belong to the Government under<\/p>\n<p>the control of the educational authorities. Therefore, I do<\/p>\n<p>not think that, the Deputy Director of Education is wholly<\/p>\n<p>without jurisdiction to pass Ext.P2 order. Apart from that,<\/p>\n<p>the judgment is dated 17.08.2007. The school has all along<\/p>\n<p>been functioning elsewhere ever since and even now.<\/p>\n<p>Therefore it is not as if because of want of availability of the<\/p>\n<p>building, the school is not functioning.        Further from<\/p>\n<p>dilapidated nature of the building as is evident from the<\/p>\n<p>photographs of the school produced by the petitioner, I am<\/p>\n<p>certain that, that building is not fit to house the school and<\/p>\n<p>would pose a threat to the safety of the children. In the<\/p>\n<p>above circumstances, I do not find any merit in the review<\/p>\n<p>petition and accordingly the same is dismissed.<\/p>\n<p>                                                S.
