The operative part of the<br \/>\njudgment and order of the Tribunal reads as under:-\n<\/p>\n<p> (1)\tThe petitioner to<br \/>\nrecover Rs.46,205\/- (Rupees forty six thousand two hundred and five<br \/>\nonly) from opponents Nos.1, 2 and 3 jointly and severally with an<br \/>\ninterest thereon at 6 per cent per annum from the date of the<br \/>\npetition till the date of realization with proportionate costs but<br \/>\nthe liability of opponent No.3 United India Insurance Company shall<br \/>\nbe to the extent of Rs.15000\/- and proportionate costs and interest<br \/>\nthereon.\n<\/p>\n<p>(2)\tThe rest of the claim of<br \/>\nthe petitioner stands dismissed with no order as to costs.\n<\/p>\n<p>(3)\tThe petition stands<br \/>\ndismissed against opponents Nos.4, 5 and 6 with no order as to costs.\n<\/p>\n<p>(4)\tThe opponents to bear<br \/>\ntheir own costs.\n<\/p>\n<p><span class=\"hidden_text\">(5)\tThe opponents Nos.1, 2<\/span><\/p>\n<p>and 3 are given three months time to deposit the amount with this<br \/>\nTribunal.\n<\/p>\n<p>(6)\tThe petitioner shall<br \/>\ninvest the amount in excess of Rs.8,000\/- in any Nationalized Bank<br \/>\nnear to the place of his residence but the duration of investment<br \/>\nshall be decided at the time of disbursement.  However, the amount to<br \/>\nbe invested shall not include costs and interest.  The petitioner<br \/>\nshall not be entitled to withdraw the invested amount before<br \/>\ninvestment period is over but shall be entitled to the interest over<br \/>\nit as and when it falls due.  The concerned Bank be informed to make<br \/>\na note of the same on the Fixed Deposit Receipt or Receipts and the<br \/>\nBank Books.\n<\/p>\n<p>(7)\tThe deficit court-fees,<br \/>\nif any, be recovered from the amount deposited with this Tribunal.\n<\/p>\n<p>2.\tThe facts given rise to<br \/>\nthe present appeal as set out in the judgment and award are as<br \/>\nunder:-\n<\/p>\n<p>2.1\tThis petition has been<br \/>\nfiled by the injured who received injuries in a vehicular accident<br \/>\nwhich took place on 11-3-1983 on the old National High Way No.8 near<br \/>\nvillage Andada.  The vehicles involved in the accident are two<br \/>\nautorickshwas.  The petitioner was going in autorickshaw No.GRV 343,<br \/>\ndriven by the opponent No.1, owned by the opponent No.2 and insured<br \/>\nby the opponent No.3 and it dashed against another rickshaw.  No.GRV<br \/>\n728, driven by the opponent No.4, owned by the opponent No.5 and<br \/>\ninsured by the opponent No.6.  The said rickshaw No.GRV 343 dashed<br \/>\nwith rickshaw No.GRV 728 from behind and that caused the accident.\n<\/p>\n<p>3.\tLearned Advocate Mr.Hakim<br \/>\nfor the appellant vehemently submitted that the Tribunal has erred in<br \/>\nholding only first rickshaw, in which the appellant-applicant was<br \/>\ntraveling and not holding second rickshaw which which it collided,<br \/>\nnegligent or responsible for payment of compensation.  In this<br \/>\nregard, he invited attention of the Court to the discussion in the<br \/>\njudgment and award.\n<\/p>\n<p>4.\tThe Tribunal, after<br \/>\ntaking into consideration the evidence led before it, had framed the<br \/>\nfollowing issues:-\n<\/p>\n<p> 1.\tWhether the applicant<br \/>\nproves that the opponents Nos.1 &amp; 4 drove their  autorickshaws<br \/>\nbearing Nos.GRV 343 and GRV 728 respectively rashly and\/or<br \/>\nnegligently and thereby caused injuries to the applicant?\n<\/p>\n<p>2.\tWhat amount of<br \/>\ncompensation is available to the applicant and from whom?\n<\/p>\n<p>3.\tWhat order and award?\n<\/p>\n<p>4.1\tThe Tribunal recorded<br \/>\nfollowing findings to the aforesaid issues:-\n<\/p>\n<p> 1.\tYes regarding<br \/>\nautorickshaw No.GRV 343.  No regarding autorickshaw No.GRV 728.\n<\/p>\n<p>2.\tRs.46,205\/- from<br \/>\nopponents Nos.1, 2 and 3 jointly and severally but the liability of<br \/>\nthe opponent No.3 shall be to the extent of Rs.15,000\/-\n<\/p>\n<p>3.\tAs per final<br \/>\norder&#8230;&#8230;&#8230;..\n<\/p>\n<p>5.\tLearned Advocate for the<br \/>\nappellant invited attention of the Court to paras-8, 9 and the<br \/>\nconclusions drawn by the Tribunal in para-10.  Learned Advocate read<br \/>\nthe aforesaid paras extenso.  He submitted that the Tribunal has<br \/>\nerred in holding that,  from all these previous statements, it can<br \/>\nbe seen  that the theory of the second  autorickshaw stopping for<br \/>\nallowing some person to get down in the middle of the road  is<br \/>\na subsequently got up one .\n<\/p>\n<p>5.1\tLearned Advocate for the<br \/>\nappellant submitted that the Tribunal ought to have held that there<br \/>\nwas no material to record a finding to the effect that the story was<br \/>\ngot up one and it should have been appreciated that when there are<br \/>\ntwo vehicles involved in an accident, may be that the vehicle which<br \/>\ndashing from behind may be attributed larger share of negligence, but<br \/>\nat the same time vehicle going ahead cannot be absolved from the<br \/>\nliability arising from the negligence on account of sudden stoppage<br \/>\nof the vehicle.\n<\/p>\n<p>6.\tTaking into consideration<br \/>\nthe material which has come on record and the appreciation thereof by<br \/>\nthe Tribunal, wherein the Tribunal has observed that,  Moreover,<br \/>\nfrom the claim petition itself, it is clear that a jeep car was<br \/>\ncoming from the otherside and that is why the second autorickshaw<br \/>\nallowed down and at that time, the first autorickshaw was overtaking<br \/>\nthe second autorickshaw.  It is difficult to understand the anxiety<br \/>\nof the driver of the first autorickshaw to overtake the second<br \/>\nautorickshaw on a road which is a Highway when a jeep car was coming<br \/>\nfrom the otherside.   A driver of a vehicle going ahead may have to<br \/>\nslow it for many reasons and the vehicle going behind has to drive it<br \/>\ncautiously, keeping some distance between the two vehicles and there<br \/>\nshould not be any overtaking without any signal from the vehicle<br \/>\ngoing ahead or without taking proper precautions for the same ,<br \/>\nthis Court finds that the findings recorded by the Tribunal does not<br \/>\nwarrant to be disturbed.  In view of that, the impugned judgment and<br \/>\naward if confirmed.
