By  this  petition, the petitioner seeks quashing  of<br \/>\n     the order dated                   29-12-2009 (Annexure<br \/>\n     P\/1)  passed  by the Secretary, Department  of  Rural<br \/>\n     Industries, by which the petitioner has been terminated<br \/>\n     from the service.\n<\/p>\n<p>2.   The indisputable facts, in nutshell, as projected by<br \/>\nthe petitioner for adjudication of the case, are that<br \/>\ninitially the petitioner was appointed on the post of<br \/>\nInspector, Handloom against the general category on<br \/>\n22-02-1983 (Annexure P\/2).  In the year 1981-82, the<br \/>\ncompetent authority issued the caste certificate in favour<br \/>\nof the petitioner treating the petitioner member of Halba<br \/>\ncommunity i.e. Scheduled Tribe category.  Cast certificate<br \/>\nis Annexure P\/5.  For the first time after the appointment<br \/>\non 26-09-1986 (Annexure P\/6) the petitioner requested the<br \/>\nDirector, Handlooms, to enter the caste certificate in his<br \/>\nservice record.  Thereafter, in the year 1990 and 1997,<br \/>\nthe petitioner was promoted to the posts of Senior<br \/>\nInspector, Handlooms and Assistant Director, Handlooms,<br \/>\nrespectively on the basis of his caste certificate.\n<\/p>\n<p>3.   According to the petitioner, after formation of the<br \/>\nnew State of Chhattisgarh, on the basis of option<br \/>\nsubmitted by the petitioner, his services were allocated<br \/>\nto the State of Chhattisgarh.  The caste certificate of<br \/>\nthe petitioner was referred to the High Power Caste<br \/>\nScrutiny Committee (for short &#8220;the Committee&#8221;) for<br \/>\nverification.  The Committee by its order dated 16-03-2007<br \/>\n(Annexure P\/11), observed that the petitioner belongs to<br \/>\nKosti community and the same does not comes within the<br \/>\npurview of Scheduled Tribe.  Thus, the caste certificate<br \/>\nsubmitted by the petitioner was not found genuine.\n<\/p>\n<p>4.   Being aggrieved by the said order, the petitioner<br \/>\npreferred a writ petition before the High Court of Madhya<br \/>\nPradesh at Jabalpur being W.P.No.14285\/2007 (Vishnu Prasad<br \/>\nDhakate, S\/o Shri Sunder Lal Dhakate v. State of M.P. &amp;<br \/>\nOthers).  The said writ petition was dismissed by order<br \/>\ndated 29-04-2008 (Annexure P\/12).  Thereagainst, the<br \/>\npetitioner preferred a writ appeal before the High Court<br \/>\nof Madhya Pradesh at Jabalpur being W.A.No. 643\/2008<br \/>\n(Vishnu Prasad Dhakate v. State of Madhya Pradesh &amp;<br \/>\nOthers).  The said appeal was also dismissed by order<br \/>\ndated 23-07-2008 (Annexure P\/13).\n<\/p>\n<p>5.   The respondent authorities issued the show cause<br \/>\nnotice to the petitioner on 16-06-2008 (Annexure P\/16)<br \/>\ncalling upon the petitioner to offer his explanation<br \/>\nwithin a period of 15 days.  Thereafter, on<br \/>\n03-12-2007 (Annexure P\/17) again issued the show cause<br \/>\nnotice to the petitioner.  On 16-06-2008, the petitioner<br \/>\nsubmitted his reply and stated that he had not secured the<br \/>\nappointment against the reserved category of Scheduled<br \/>\nTribe on the basis of a caste certificate.  On receipt of<br \/>\nreply, it appears that the petitioner was removed from the<br \/>\nservice vide order dated 29-12-2009 (Annexure &#8211; P\/1).<br \/>\nThus, this petition.\n<\/p>\n<p>6.   Shri Paranjape, learned counsel appearing for the<br \/>\npetitioner, submits that the impugned order is illegal,<br \/>\narbitrary and against the principles of natural justice,<br \/>\nas before passing the impugned order, the opportunity of<br \/>\nhearing was not afforded to the petitioner.  In fact, the<br \/>\npetitioner has not obtained the service against the<br \/>\nreserved category i.e. Scheduled Tribe.  Even by letter<br \/>\ndated 28-02-2009 (Annexure P\/23), the Joint Director,<br \/>\nHandlooms, Madhya Pradesh, Bhopal, intimated the Director,<br \/>\nHandlooms, Chhattisgarh, Raipur, that at the time of<br \/>\nfilling the application form for appointment, the<br \/>\npetitioner has not mentioned his caste and the petitioner<br \/>\nhas not attached any caste certificate along with the said<br \/>\napplication form.  Thus, the impugned order is illegal and<br \/>\nnot at all sustainable in the eye of law and the same may<br \/>\nbe quashed.\n<\/p>\n<p>7.   On the other hand, Shri Das, learned Deputy<br \/>\nGovernment Advocate appearing for the State, submits that<br \/>\nafter following the due process of law and after affording<br \/>\nproper opportunity of hearing to the petitioner, the<br \/>\nimpugned order was passed.  Thus, the petitioner is not<br \/>\nentitled to any relief and the petition may be dismissed.\n<\/p>\n<p>8.   Shri Paranjape, learned counsel appearing for the<br \/>\npetitioner, in rejoinder, submits that the respondent<br \/>\nState itself in para 11 of the return has admitted that<br \/>\nthe petitioner has not secured the appointment against the<br \/>\nreserved category i.e. Scheduled Tribe community.  In para<br \/>\n22 of the return also the State admitted the fact that the<br \/>\npetitioner was appointed in open category.  The<br \/>\nrespondents failed to appreciate the law laid down by the<br \/>\nSupreme Court as well as this Court in catena of<br \/>\ndecisions.\n<\/p>\n<p>9.   I have heard learned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.\n<\/p>\n<p>10.  It is indisputable that the petitioner was appointed<br \/>\non the post of Inspector, Handloom, against the general<br \/>\ncategory, not against the reserved Scheduled Tribe<br \/>\ncategory.  The promotion, thereafter, to the higher posts,<br \/>\nwas granted on the basis of Scheduled Tribe social status<br \/>\ncertificate granted to the petitioner, later on. The said<br \/>\ncertificate was rejected by the Committee.  Thereagainst<br \/>\nthe writ petition filed in the High Court of Madhya<br \/>\nPradesh was rejected on 29-4-2008 and further writ appeal<br \/>\nwas also dismissed on 23-7-2008.\n<\/p>\n<p>11.  As a sequel, it appears that the promotion to the<br \/>\nhigher posts was granted on the basis of Scheduled Tribe<br \/>\nsocial status certificate, which was cancelled<br \/>\nsubsequently.  The petitioner is not entitled to hold the<br \/>\npromoted post against the reserved Scheduled Tribe<br \/>\ncategory on the ground that he was promoted against the<br \/>\nreserved Scheduled Tribe category.  Thus, termination of<br \/>\nhis initial appointment against the general category is<br \/>\nillegal.  Since the petitioner was selected and appointed<br \/>\nin open category and he has also not represented to the<br \/>\nauthorities that he belongs to Scheduled Tribe community<br \/>\nat the time of initial appointment, the initial<br \/>\nappointment cannot be cancelled on any account.  Thus, the<br \/>\norder dated 29-12-2009 (Annexure &#8211; P\/1) terminating the<br \/>\nservices of the petitioner is quashed.\n<\/p>\n<p>12.  So far as promotion to the higher posts is concerned,<br \/>\nthe petitioner is not entitled to continue on the<br \/>\npromotional posts, as the same was granted against the<br \/>\nreserved ST category.  The authorities are at liberty to<br \/>\ntake appropriate steps for cancellation of promotion of<br \/>\nthe petitioner after affording proper opportunity of<br \/>\nhearing to the petitioner, if so advised.\n<\/p>\n<p>13.  <a href=\"\/doc\/678652\/\">In State of Maharashtra v. Milind and Others1, Milind<\/a><br \/>\njoined the medical course against the reserved category,<br \/>\nwhich was later on found false.  The Supreme Court held<br \/>\nthat Milind cannot take advantage of the Scheduled Tribes<br \/>\nOrder any further or for any other constitutional purpose.<br \/>\nIn view of the fact that he had obtained medical education<br \/>\nand huge amount was spent on completion of medical course,<br \/>\nhe was permitted to continue and the degree obtained by<br \/>\nMilind on submission of wrong certificate was not quashed.\n<\/p>\n<p>14.  <a href=\"\/doc\/1475926\/\">In R.Vishwanatha Pillai v. State of Kerala and<br \/>\nOthers2,<\/a> in an identical case, where the appointment was obtained<br \/>\non the basis that the petitioner belongs to Scheduled<br \/>\nTribe community was held as void from its inception.\n<\/p>\n<p>15.  In the case on hand, the initial appointment was not<br \/>\nobtained on misrepresenting or on the basis that he<br \/>\nclaimed to be Scheduled Tribe candidate.  Thus, the<br \/>\ninitial appointment of the petitioner cannot be<br \/>\nterminated.  However, the subsequent promotions on the<br \/>\npost of wrong certificate may be quashed, as aforestated.\n<\/p>\n<p>16.  In the result, the writ petition is allowed to the<br \/>\nabove extent.
