SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/01\/2011 \n\n \n\n \nCOMMON\nORAL JUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\napplication under Section 5 of the Limitation Act has been preferred<br \/>\nby the applicants &#8211; original opponents to condone the delay of<br \/>\n661 days in preferring the Appeal against the judgment and award<br \/>\ndated 30.10.2007 passed by the learned Additional District Judge,<br \/>\nFast Track Court No.1, Bharuch in Land Reference Case No.1514\/1998 to<br \/>\n1526\/1998.  Though served, nobody appears on behalf of respondent<br \/>\nNos.1\/1 to 1\/4.\n<\/p>\n<p>2.\tRespondent<br \/>\nNos.1\/5 and 1\/6 are reported to have died.  Despite the earlier<br \/>\norders passed by this Court, no steps are taken by the appellants to<br \/>\nbring the heirs of respondent Nos.1\/5 and 1\/6 on record.  Hence,<br \/>\npresent application is dismissed as having been abated so far as<br \/>\nrespondent Nos.1\/5 and 1\/6 are concerned.  As such the estate is<br \/>\nalready represented through other heirs.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Soni, learned Assistant Government Pleader appearing on<br \/>\nbehalf of the applicants and considering the averments in the<br \/>\napplication in support of the prayer to condone the delay, it appears<br \/>\nthat a sufficient cause has been shown to condone the delay in<br \/>\npreferring the First Appeal.  Even otherwise, so as to give one<br \/>\nadditional opportunity to the applicants to submit the case on merits<br \/>\nrather than non-suiting them on technical ground of delay, delay<br \/>\ncaused in preferring the First Appeal is hereby condoned.  Rule is<br \/>\nmade absolute accordingly.
