HAMEEDULLAH (CJ)\nGUPTA, A.C.\n\nCITATION:\n 1977 AIR 1194\t\t  1977 SCR  (3) 556\n 1977 SCC  (3) 242\n\n\nACT:\n\t    Orissa  Land Reforms Act, 1960 as amended by Act  13  of\n\t1965  and Act 29 of 1976--Revisional powers u\/s\t 59--Whether\n\tan order passed by the appellate authority u\/s 44 of the Act\n\twhich  has become final u\/s 44(2) is capable of revision  by\n\tthe  Collector\tu\/s  59\t before\t the  amendment\t Act  29  of\n\t1976--Construction of S. 59.\n\n\n\nHEADNOTE:\n\t    Under  Section  43 of the Orissa Land Reforms  Act,\t the\n\tRevenue\t Officer determines the ceiling surplus and  on\t the\n\ttermination  of\t the  proceedings  thereunder,\tthe  Revenue\n\tOfficer u\/s 44(1) confirms the draft statement; u\/s 44(2) an\n\tappeal\tlies to the prescribed authority against  the  order\n\tunder sub-section (1) and subject to results of such appeal,\n\tif  any, order of the Revenue Officer shall be final.\tSec-\n\ttion  58 provides a right of appeal to any person  aggrieved\n\tby  an order passed under any of the Sections enumerated  in\n\tsubsection (1).\t Sub-section (1) of S. 59 provides that\t the\n\tCollector  may\trevise\tany order passed in  appeal  by\t any\n\tofficer\t below\tthe  rank of a\tCollector  under  this\tAct.\n\tSection 59(1) also empowers the Board of Revenue  to  revise\n\tany order passed by the Collector.  Sub-section (2)  enables\n\tthe  Collector\tor the Board of Revenue sue motu or  on\t the\n\tapplication of the party concerned call for and examine\t the\n\trecord\tin  respect  of any proceedings under  the  Act\t and\n\tmodify, annual reverse or remit for reconsideration.\n\t    In\tthe  proceedings u\/s 38 of the Act the plea  of\t the\n\trespondent  landlord that there was a partition between\t him\n\tand his sons was rejected by the Revenue Officer who  deter-\n\tmined the surplus extent as 12.08 standard acres. The appeal\n\tpreferred  before the Sub-Divisional Officer having  failed,\n\tthe  respondent\t filed\ta  revision  before  the  Additional\n\tDistrict   Magistrate.\tThe Additional Magistrate held\tthat\n\tthe  appellate orders u\/s 44 are final and that no  revision\n\tlay  to\t him.  The writ petition filed\tagainst\t this  order\n\tfiled by the respondent was allowed by the Orissa High Court\n\tby  its\t order dated 15-7-1976 holding that  the  Additional\n\tMagistrate  had powers to revise an order of  the  appellate\n\tauthority passed u\/s 44 by virtue of the powers conferred on\n\thim under s. 59of the Act.\n\tDismissing the appeal by certificate, the Court,\n\t    HELD:  (i) The language of S. 59(1) of the\tOrissa\tLand\n\tReforms Act is wide enough to enable the Collector to revise\n\tany  order including an appellate order under S. 44  of\t the\n\tAct.  [561 B]\n\t    (ii)  In  applying the rule of  harmonious\tconstruction\n\twith a view to give effect to the intention of the  legisla-\n\tture the court will not be justified in putting a  construc-\n\ttion  which would restrict the revisionary  jurisdiction  of\n\tthe Collector and the Board of Revenue.\t [560E]\n\t    In\tthe instant case, the Act is of expropratory  nature\n\tand  the  determination of the excess lands is done  by\t the\n\tRevenue Officer.  The legislature intended that any error or\n\tirregularity should be rectified by higher authorities\tlike\n\tthe Collector and the Board of Revenue.\t [560E]\n\t    J. K. Cotton Spinning &amp; Weaving Mills Co. Ltd. v.  State\n\tof U.P. &amp; Ors. [1961] 3 S.C.R. 185 held not applicable.\n\t    <a href=\"\/doc\/1629830\/\">The Bengal Immunity Company Ltd. v. The State of Bihar &amp;\n\tOrs.<\/a> [1955] 2 S.C-R.. 603 referred to.\n\t    (iii)  It  cannot  be said that there  is  any  conflict\n\tbetween\t S.  44(1) and 8. 58 inasmuch as S.  44(1)  provides\n\tthat  the order of the Revenue Officer shall be final,\tsub-\n\tject to the result of appeal u\/s 44(2), while no such final-\n\tity\n\t557\n\tis mentioned in the case of an appeal u\/s 58.  The provision\n\tas  to\tfinality u\/s 44(2) is provided for so  that  in\t the\n\tabsence\t of  the aggrieved party proceeding further  in\t the\n\tmatter, the consequences of the vesting of surplus lands u\/s\n\t45, the preparation of the Compensation Assessment Roll, the\n\tsettlement of surplus lands etc. can be proceeded with. [559\n\tD-F]\n\t    (iv)  The amendment to 8. 44(3) by the Amendment Act  of\n\t1975  making it clear that a right to revision\tis  provided\n\tfor  orders passed u\/s 44(2) does not make  any\t difference.\n\tThe amendment could not mean that S. 44(2) as it  originally\n\tstood  did not provide for power of revision to the  Collec-\n\ttor' u\/s 59. Rao for Respondents.<br \/>\n\t   The Judgment of the Court was delivered by<br \/>\n\t    KAILASAM,  J.&#8211;This\t appeal is by the  State  of  Orissa<br \/>\n\trepresented  by the Secretary, Revenue\tDepartment,  against<br \/>\n\tthe  judgment of a Bench of the Orissa High Court on a\tcer-<br \/>\n\ttificate of fitness granted by it.\n<\/p>\n<p>\t    The\t respondent  herein is a land-holder  whose  ceiling<br \/>\n\tsurplus was determined by the Revenue Officer under  section<br \/>\n\t43  of the Orissa Land Reforms Act, 1960, as amended by\t Act<br \/>\n\t13 of 1965 and subsequently by Act 29 of 1976.<br \/>\n\t    The Revenue Officer rejected the plea of the  respondent<br \/>\n\tthat  there  was a partition between him and  his  sons\t and<br \/>\n\tdetermined the\tsurplus extent as 12.08 standard acres.\t The<br \/>\n\trespondent  preferred  an appeal before\t the  Sub-Divisional<br \/>\n\tOfficer\t and the Sub-Divisional Officer confirmed the  order<br \/>\n\tof the Revenue Officer and dismissed the  appeal Against the<br \/>\n\torder  of  the appellate authority the\trespondent  filed  a<br \/>\n\trevision  before the Additional District  Magistrate,\tGan-<br \/>\n\tjam.   The  Additional\tDistrict Magistrate  held  that\t the<br \/>\n\tappellate  orders trader section 44 were final and  that  no<br \/>\n\trevision  lay  to  him.\t The respondent\t thereupon  filed  a<br \/>\n\tpetition  under\t Articles 226 and 227  of  the\tConstitution<br \/>\n\tchallenging the order of the Additional District  Magistrate<br \/>\n\trejecting  the.\t revision petition.  A Bench of\t the  Orissa<br \/>\n\tHigh  Court by\tan order dated 15th July, 1976, allowed\t the<br \/>\n\twrit  petition holding that the Additional  District  Magis-<br \/>\n\ttrate  had powers to revise the order of the  appellate\t au-<br \/>\n\tthority\t passed\t under section 44 by virtue  of\t the  powers<br \/>\n\tconferred  on  him under section 59 of the  Act.   The\tHigh<br \/>\n\tCourt came to this conclusion that a revision was entertain-<br \/>\n\table tinder section 59 by the Additional District Magistrate<br \/>\n\teven  before  the amendment introduced by Orissa Act  29  of<br \/>\n\t1976,  the details of which will be referred to later.<br \/>\n\t    The only question that arises in this appeal is  whether<br \/>\n\tan order passed by the appellate authority under section  44<br \/>\n\twhich has become<br \/>\n\t9&#8211;502 SCI\/77<br \/>\n<span class=\"hidden_text\">\t558<\/span><br \/>\n\tfinal  under  section 44(2) is capable of  revision  by\t the<br \/>\n\tCollector  under section 59 before the amendment of the\t Act<br \/>\n\tin 1976.  Section 44 runs as follows :&#8211;\n<\/p>\n<blockquote><p>\t\t\t      &#8220;44.  (1)\t On the termination  of\t the<br \/>\n\t\t      proceedings  under  Section  43,\tthe  Revenue<br \/>\n\t\t      Officer shall by order confirm the       draft<br \/>\n\t\t      statement with such alterations or  amendments<br \/>\n\t\t      as may   have been made therein under the said<br \/>\n\t\t      Section.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t      (2) An appeal against the order of the<br \/>\n\t\t      Revenue  Officer under &#8216;sub-section (1 )\tcon-<br \/>\n\t\t      firming  the  statement  if  presented  within<br \/>\n\t\t      thirty  days from the date of the order  shall<br \/>\n\t\t      lie to the prescribed authority and subject to<br \/>\n\t\t      the results of such appeal, if any, the orders<br \/>\n\t\t      of the Revenue Officer shall be final.&#8221;\n<\/p><\/blockquote>\n<p>\tUnder  section 44(1) the Revenue Officer confirms the  draft<br \/>\n\tstatement  and\tunder section 44(2) an appeal  lies  to\t the<br \/>\n\tprescribed authority against the order under sub-section (1)<br \/>\n\tand subject to results of such appeal, if any, order of\t the<br \/>\n\tRevenue Officer shall be final.\t Section 58 provides a right<br \/>\n\tof  appeal to any person aggrieved by an order passed  under<br \/>\n\tany of the sections enumerated in sub-section. (1).  As\t the<br \/>\n\tdecision  in  this case will depend  upon  the\tconstruction<br \/>\n\tthat-is put upon section 59 we extract section 59(1) and (2)<br \/>\n\tin full.\n<\/p>\n<blockquote><p>\t\t      &#8220;59. Revision:\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t      (1  )  The Collector  may\t revise\t any<br \/>\n\t\t      order  passed in appeal by any  officer  below<br \/>\n\t\t      the rank of a Collector under this Act and the<br \/>\n\t\t      Board  of Revenue may revise any order  passed<br \/>\n\t\t      by the Collector under this Act and the period<br \/>\n\t\t      of  limitation for such revision shall  be  as<br \/>\n\t\t      may be prescribed.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t      (2)  For the purposes  of\t sub-section<br \/>\n\t\t      (1)  the Collector or the Board of Revenue  as<br \/>\n\t\t      the case may be may suo motu or on application<br \/>\n\t\t      of either party or any interested person\tcall<br \/>\n\t\t      for  and examine the record of any  matter  in<br \/>\n\t\t      respect  of any proceedings under this Act  as<br \/>\n\t\t      to the regularity of such\t proceedings or\t the<br \/>\n\t\t      correctness,  legality  or  propriety  of\t any<br \/>\n\t\t      decision or order passed thereon and if in any<br \/>\n\t\t      case  if\tappears that any  such\tdecision  or<br \/>\n\t\t      order shall be  modified,\t annulled,  reversed<br \/>\n\t\t      or remitted for reconsideration, the Collector<br \/>\n\t\t      or  Board of  Revenue as the case may be,\t may<br \/>\n\t\t      consider accordingly.&#8221;\n<\/p><\/blockquote>\n<p>\tSub-section ( 1 ) provides that the Collector may revise any<br \/>\n\torder  passed in appeal by any officer below the rank  of  a<br \/>\n\tCollector  under  this Act. It also empowers  the  Board  of<br \/>\n\tRevenue to revise an order passed by the Collector under the<br \/>\n\tAct.  Sub-section (2) enables the collector or the Board  of<br \/>\n\tRevenue\t suo  motu or on the application of the\t party\tcon-<br \/>\n\tcerned\tcall  for and examine the record in respect  of\t any<br \/>\n\tproceedings  under  the Act and modify, annual,\t reverse  or<br \/>\n\tremit  for  reconsideration  such a decision  to  the  lower<br \/>\n\tauthority.   The section as if stands does not put  any\t re-<br \/>\n\tstriction  on the power of revision by the Collector or\t the<br \/>\n\tBoard of Revenue for it states that the\t Collector  or\t the<br \/>\n\tBoard of Revenue may revise any order passed under this\t Act<br \/>\n\twhich would<br \/>\n<span class=\"hidden_text\">\t559<\/span><br \/>\n\tinclude\t an  order passed under section 44(2).\t Again\tsub-<br \/>\n\tsection (2) of section 59 provides that the Collector or the<br \/>\n\tBoard  of  Revenue may examine the record of any  matter  in<br \/>\n\trespect of any proceedings under the Act which would include<br \/>\n\tthe proceedings under section 44(2).\n<\/p>\n<p>\t    The submission of the learned counsel for the  appellant<br \/>\n\tis that the power of revision under section 59 is restricted<br \/>\n\tto an appeal that is disposed of under section 58 and is not<br \/>\n\tavailable against an order passed under section 44(2).\t The<br \/>\n\tlearned\t counsel  very\tstrongly relied on  the\t wording  of<br \/>\n\tsection\t 44(2) which provides that the order of the  Revenue<br \/>\n\tOfficer\t shall be final subject to the result of  an  appeal<br \/>\n\tprovided  under section 44(2) and therefore submits that  no<br \/>\n\tother  relief  is  available to\t the  aggrieved\t party.\t The<br \/>\n\tlearned counsel in contrast referred us to section 58  where<br \/>\n\tthe  order of the lower authority is not stated to be  final<br \/>\n\tsubject\t to  the result of the appeal,\tAs  no\tfinality  is<br \/>\n\tprovided  for orders passed on appeal under section 58,\t the<br \/>\n\tsubmission was that a revision under section 59 is available<br \/>\n\tfor  those orders but orders passed under section 44(2)\t are<br \/>\n\tfinal and they are not subject to revision under section 59.<br \/>\n\t    There  is no doubt that section 44(1) provides that\t the<br \/>\n\torder  of the Revenue Officer shall be final subject to\t the<br \/>\n\tresult of an appeal under section 44(2) while no such final-<br \/>\n\tity is mentioned in the case of an appeal under section\t 58.<br \/>\n\tBut this cannot conclude the matter for the powers of  revi-<br \/>\n\tsion  conferred under section 59 are very wide and  empowers<br \/>\n\tthe  Collector or the Board of Revenue to revise  any  order<br \/>\n\tpassed\tunder  this  Act and sub-section  (2)  empowers\t the<br \/>\n\tCollector and the Board of Revenue to set aside any  irregu-<br \/>\n\tlarity in respect of any proceedings under this Act.  As the<br \/>\n\tpower of revision is not restricted we are unable to  accept<br \/>\n\tthe  contention of the learned counsel that because  of\t the<br \/>\n\twording\t of section 44(2) providing. that the order  of\t the<br \/>\n\tRevenue\t Officer  subject  to  the  result  of\tthe   appeal<br \/>\n\twould  .be final, bars the revisionary jurisdiction  of\t the<br \/>\n\tCollector and the Board of Revenue as provided under section\n<\/p>\n<p>\t59.   We do not find any conflict between the  two  sections<br \/>\n\tand  the  provision as to finality under  section  44(2)  is<br \/>\n\tprovided  for so that in the absence of the aggrieved  party<br \/>\n\tproceeding  further  in the matter the consequences  of\t the<br \/>\n\tvesting\t of surplus lands under section 45, the\t preparation<br \/>\n\tof  the\t Compensation Assessment Roll,\t the  settlement  of<br \/>\n\tsurplus lands etc. can be proceeded with.\n<\/p>\n<p>\t    The learned counsel drew our attention to the  amendment<br \/>\n\tto  the\t Orissa\t Act by Act 29 of  1976.   The\tOrissa\tLand<br \/>\n\tReforms\t (2nd Amendment) Act&#8217;, 1975, and submitted that\t the<br \/>\n\tamendments introduced to section 44, 45 and 59 would make it<br \/>\n\tdear  that the legislature understood that the\tsections  as<br \/>\n\tthey stood before the amendment did not enable the Collector<br \/>\n\tto  exercise revisional jurisdiction over orders  passed  by<br \/>\n\tthe appellate authority under section 44(2) of the Act.\t  By<br \/>\n\tthe  amending Act. section 44, sub-sections (2) and (3)\t are<br \/>\n\tamended.  Sub-section  (2) of section 44  as  it  originally<br \/>\n\tstood provided that subject to the result of such appeal, if<br \/>\n\tany,  the orders of the Revenue Officer shall be  final\t and<br \/>\n\tsub-section  (3) provided that the draft statement  as\tcon-<br \/>\n\tfirmed or as modified in appeal shall be final and con-\n<\/p>\n<p><span class=\"hidden_text\">\t560<\/span><\/p>\n<p>\tclusive.    By the amendment sub-section (2) is\t recast\t and<br \/>\n\tsub-section  (3) provides that the draft statement  as\tcon-<br \/>\n\tfirmed\tor as modified in appeal on revision shall be  final<br \/>\n\tand  conclusive.  The amendment specifically provides for  a<br \/>\n\trevision.   The amended sub-section (1) of section  59\tpro-<br \/>\n\tvides that on an application by party aggrieved by any order<br \/>\n\tpassed\tin an appeal under any provision of this  Act  filed<br \/>\n\twithin\tthe prescribed period, the prescribed authority\t may<br \/>\n\trevise\tsuch  order. Though the amendment to  section  44(3)<br \/>\n\tmakes  it  clear that a right to revision  is  provided\t for<br \/>\n\torders passed under section 44(2), we do not think that this<br \/>\n\tcould mean that section 44(2) as it originally stood did not<br \/>\n\tprovide for power of revision to the Collector under section\n<\/p>\n<p>\t59.  In our opinion, amendment does not make any difference.<br \/>\n\t    The\t learned  counsel for the appellant  submitted\tthat<br \/>\n\tsection\t 44(3) is in the nature of a special  provision\t and<br \/>\n\tshould\tbe  construed as an exception to section 59  on\t the<br \/>\n\tprinciple  of  harmonious construction. In support  of\tthis<br \/>\n\tplea  the  learned counsel referred to the decision  in\t The<br \/>\n\tJ.K.  Cotton Spinning &amp; Weaving Mills Co. Ltd. v. State\t  of<br \/>\n\tU.P.  &amp;\t Ors. (1).  In construing the provisions  of  clause<br \/>\n\t5(a)  and clause 23 of the G.O. concerned, this\t Court\theld<br \/>\n\tthat  the rule of harmonious construction should be  applied<br \/>\n\tand  in\t applying the rule the court will have\tto  remember<br \/>\n\tthat to harmonise is not to destroy and that in interpreting<br \/>\n\tthe statutes the court always presumes that the\t legislature<br \/>\n\tinserted  every part thereof for a purpose and the  legisla-<br \/>\n\ttive intention is that every part of the statute should have<br \/>\n\teffect,\t and a construction which defeats the  intention  of<br \/>\n\tthe  rule-making authority must be avoided.   This  decision<br \/>\n\tdoes not help the appellant for in our view in applying\t the<br \/>\n\trule  of harmonious construction with a view to give  effect<br \/>\n\tto  the\t intention o(the legislature the court will  not  be<br \/>\n\tjustified in putting a construction which would restrict the<br \/>\n\trevisionary  jurisdiction of the Collector and the Board  of<br \/>\n\tRevenue.   It may be noted that the Act is of  exproprietory<br \/>\n\tnature and the determination of the excess lands is done  by<br \/>\n\tthe Revenue Officer and on appeal by the Revenue  Divisional<br \/>\n\tOfficer.   In  such  circumstances, it is  only\t 13roper  to<br \/>\n\tpresume\t that  the legislature i,tended that  any  error  or<br \/>\n\tirregularity should. be rectified by higher authorities like<br \/>\n\tthe Collector and the Board of Revenue.\t In our view it will<br \/>\n\tbe  in conformity with the intention of the  legislature  to<br \/>\n\thold that section 59 confers a power of revision of an order<br \/>\n\tpassed under section 44(2) of the Act.\tThe learned  counsel<br \/>\n\tnext  referred\tto a decision of this Court  in\t <a href=\"\/doc\/1629830\/\">The  Bengal<br \/>\n\tImmunity   Company  Limited  v.\t The  State  of\t Bihar\t and<br \/>\n\tOthers.<\/a>(2)  The rule of construction is stated at p. 791  in<br \/>\n\tthe  following terms by Venkatarama Ayyar ,J.  speaking\t for<br \/>\n\tthe Court :&#8211;\n<\/p>\n<blockquote><p>\t\t\t  &#8220;It  is  a cardinal rule  of\tconstruction<br \/>\n\t\t      that  when there are in a Statute\t two  provi-<br \/>\n\t\t      sions  which are in conflict with\t each  other<br \/>\n\t\t      such  that  both of them cannot  &#8216;stand,\tthey<br \/>\n\t\t      should,  if possible. be so  interpreted\tthat<br \/>\n\t\t      effect  can be given to both, and that a\tcon-<br \/>\n\t\t      struction which renders either of them inoper-<br \/>\n\t\t      ative and useless should not be adopted except<br \/>\n\t\t      in the last resort.   This is what is known as<br \/>\n\t\t      the  rule\t of  harmonious\t construction.\t One<br \/>\n\t\t      application of this rule is that when there<br \/>\n<span class=\"hidden_text\">\t\t      561<\/span><br \/>\n\t\t      is a law generally dealing with a subject\t and<br \/>\n\t\t      another  dealing particularly with one of\t the<br \/>\n\t\t      topics  comprised therein, the general law  is<br \/>\n\t\t      to be construed as yielding to the special  in<br \/>\n\t\t      respect of the matters comprised therein.&#8221;\n<\/p><\/blockquote>\n<p>\tConstruing  section  59 as conferring a\t power\tof  revision<br \/>\n\tagainst\t an order passed under section 44(2) is not  in\t any<br \/>\n\tway  contrary to the principle laid down in the above  deci-<br \/>\n\tsion.\n<\/p>\n<p>\t    We\tagree with the view taken by the Orissa\t High  Court<br \/>\n\tthat the language of section 59(1) is wide enough to  enable<br \/>\n\tthe  Collector\tto revise any order including  an  appellate<br \/>\n\torder under section 44 of the Act.
