Justice PIUS C.KURIAKOSE\n\n Dated :06\/10\/2008\n\n O R D E R\n                      PIUS.C.KURIAKOSE,J.\n                      ------------------------\n                      L.A.A.No.434 OF 2006\n                      ------------------------\n                Dated this the 6th of October, 2008\n\n                            JUDGMENT\n<\/pre>\n<p>      The bone of contention between the parties in this appeal is<\/p>\n<p>Ext.X1 consent, by which         the predecessor -in-interest of<\/p>\n<p>respondents 8 and 9 and the legal heirs of Sri. Yohannan original<\/p>\n<p>owner of the properties, had consented that the            entire<\/p>\n<p>compensation for the acquired properties can be disbursed to the<\/p>\n<p>present appellants.    The present appellants were in possession<\/p>\n<p>and enjoyment of the acquired properties.       It was from their<\/p>\n<p>possession that the property was taken over by the Government.<\/p>\n<p>Pursuant to Ext.X1, the initial compensation of Rs.8,000\/- was<\/p>\n<p>paid to the present appellants. This was done relying on Ext.X1.<\/p>\n<p>Dispute arose thereafter before the land acquisition officer. It<\/p>\n<p>was claimed by the contesting respondents that, they being the<\/p>\n<p>title holders, should be paid the entire compensation. Relying on<\/p>\n<p>Ext.X1, the appellants contended that Ext.X1 having been<\/p>\n<p>voluntarily given and the same having been acted upon, it is not<\/p>\n<p>open to respondents 8 and 9 to turn round and claim<\/p>\n<p><span class=\"hidden_text\">L.A.A..No.434\/2006              2<\/span><\/p>\n<p>compensation.\n<\/p>\n<p>     2.       Sri.Mathews K.Philip,   learned counsel for the<\/p>\n<p>appellants, addressed me very strenuously on all the grounds<\/p>\n<p>raised in the appeal memo.   He argued that there was no scope<\/p>\n<p>for any enquiry before the land acquisition officer since Ext.X1<\/p>\n<p>had been given and the officer should have disbursed the entire<\/p>\n<p>compensation relying on Ext.X1 which had once been relied on<\/p>\n<p>by him.\n<\/p>\n<p>       3. Sri.R. Bindu Sasthamangalam, counsel for respondents<\/p>\n<p>8 and 9, would place strong reliance on the judgment of the Full<\/p>\n<p>Bench in    <a href=\"\/doc\/561872\/\">Ranee Sidhan      v. Special Tahsildar<\/a> for Land<\/p>\n<p>Acquisition (1974 K.L.T. 724) . He drew my attention to the<\/p>\n<p>award file. He submitted that the award will show that the entire<\/p>\n<p>compensation is towards land value and the statutory benefits is<\/p>\n<p>calculated upon such land value.           No portion of the<\/p>\n<p>compensation is towards value of     improvements.    He further<\/p>\n<p>submitted that no claim statement was filed by the present<\/p>\n<p>appellants making any claim towards the value of improvements.<\/p>\n<p>     4. I have considered the rival submissions addressed at the<\/p>\n<p>bar and I have gone through the entire records which are<\/p>\n<p><span class=\"hidden_text\">L.A.A..No.434\/2006               3<\/span><\/p>\n<p>available.     I  will  immediately     notice  that   the balance<\/p>\n<p>compensation amount now        presently under deposit i.e.27,596\/-<\/p>\n<p>represents the value of the acquired land        and the statutory<\/p>\n<p>benefits due upon such value. Total compensation of Rs.35,596\/-<\/p>\n<p>was determined and the advance amount of Rs.8,000\/- already<\/p>\n<p>paid to the appellants was deducted. The file also reveals that<\/p>\n<p>the claim statement was filed in the award enquiry only by the<\/p>\n<p>predecessor in interest of the     contesting respondents.       He<\/p>\n<p>claimed land value at the rate of Rs.35,000\/- per cent.<\/p>\n<p>Sri.Mathews K.Philip would highlight before me Ext.X1 consent.<\/p>\n<p>      5.    On a reading of Ext.X1, it is seen that an unconditional<\/p>\n<p>consent was given by the predecessor in interest of the<\/p>\n<p>contesting    respondents    for  disbursement      of  the  entire<\/p>\n<p>compensation to the appellants.       But, it has been clearly laid<\/p>\n<p>down by the Full Bench in       Ranee Sidhan&#8217;s case (supra) that<\/p>\n<p>failure on the part of the party who is interested in the amount<\/p>\n<p>under the acquisition to claim compensation or part thereof, or<\/p>\n<p>his failure to dispute the claims advanced by others, or even an<\/p>\n<p>admission that another is entitled to the compensation amount,<\/p>\n<p>in proceedings before the Collector cannot preclude him from<\/p>\n<p><span class=\"hidden_text\">L.A.A..No.434\/2006               4<\/span><\/p>\n<p>advancing his claim and establishing the same, at any<\/p>\n<p>subsequent stage, before the Collector or before the Court, so<\/p>\n<p>long as the rule of conclusive evidence stated in Section 31 of<\/p>\n<p>the Act is not in his way.     His conduct, failure to claim or to<\/p>\n<p>dispute another&#8217;s claim, or the admission, as the case may be,<\/p>\n<p>can, if established be a relevant fact under the ordinary rules of<\/p>\n<p>evidence in assessing the merits of his claim, but he is under<\/p>\n<p>those rules of evidence also entitled to explain away these facts,<\/p>\n<p>and to establish his title to compensation or part thereof.  It is<\/p>\n<p>seen that the appellants did not have any claim for title over the<\/p>\n<p>acquired property.    Their claim could only be that they are in<\/p>\n<p>possession and they are entitled to the value of the<\/p>\n<p>improvements.     It is not disputed that the appellants were in<\/p>\n<p>possession. But, as already indicated, compensation amounts<\/p>\n<p>represents value of the land only.\n<\/p>\n<p>     Following the judgment of the Full Bench I confirm the<\/p>\n<p>judgment of the reference court.         The appeal will stand<\/p>\n<p>dismissed.
