\nJ I} D G M E N T ‘
\nLegality and correctness of the judgment and
\ndecree passed by the I Addl. Civil Judge {$rrDn.),
\nDavanagere in 0.S.No.61\/1997 dated <\/p>\n
in question in this appeal.    _\n<\/p>\n
2. We have heard the counsel V-3′:”or—.the appellant. <\/p>\n
3. Appellant was the plainti’1’ff:’–._in ‘~<\/p>\n
filed the suit for partition”*~..andV.separatezvv”possession<\/p>\n
of her 1\/5″‘ share inthe &.suit:’–sizhednle”-property and<\/p>\n
also for”nnVesnie_  lnplliiccording to the plaint
\navermentsga plaint’i’v’f_ff._\u00bbl”and,’.-defendants 1 to 4 are the<\/p>\n
children of one Tuhiatjvappa and they are the members of<\/p>\n
 V-disjointA.Farni\u00abl}f”Vand that after the death of<\/p>\n
  having 1\/ 5″‘ share . Therefore, she<\/p>\n
 partition as the defendants were not<\/p>\n
‘<.l\u00abl..j'jpwi_lling t.or~ divide the properties in accordance with<\/p>\n
 Law in respect of the panchayat convened in<\/p>\n
 of December, 1996.\n<\/p>\n

Befendants 2 to 4 contested the case. They
\nadmit the relationship between the partiesxlI_ They<\/p>\n
contended that they have another sister fhy\u00a5;\ufb01ame<\/p>\n
Anuradha Chillal who has not been made as 3 party #6;<\/p>\n
the suit and that plaintiff; ahdj?Ahtradhaf;ghii1aia5<\/p>\n
being two sisters were given ‘in .marriagg:Vj While
\ncelebrating their marriage\ufb02 they were given in cash
\nand. kind and jewels”%towards; their, share and that
\nplaintiff who married ih–thegyear;l\u00a75\ufb01 cannot claim a
\nshare in the,pr\u00e9pertyfe_Accordingly, they requested
\nthe court to diseiss the suit:}
\nBased on fthefypleadings, following issues were
\nframed by the”trialbccditf\n<\/p>\n
1.j Whether: the’ plaintiff proves that suit
\n” ‘schedule ‘A’ and ‘B’ properties are self
\n_ acquired properties of deceased Tulajappa
\nV=which\u00abare available for partition?
\n2,f whhthef the plaintiff further proves that
\n‘.suit 5C’ schedule ‘properties are available
\n‘for partition?\n<\/p>\n
. \u00a7Whether the defendants prove that father of
\nplaintiff and defendants performed the
\nmarriages of plaintiff and Anuradha Chillal<\/p>\n
and given sufficient movable pxoperty at the
\ntime of marriage?\n<\/p>\n

\nIn order to prove theirui\ufb01\u00e9s\ufb01sctives contentions,
\nplaintiff got examinedn herself das l\ufb01wsl wand relied<\/p>\n
upon Exs.P-1<\/p>\n
e10. No oral and documentary evidence<\/p>\n
was let in on behalf of the defendants. Trial court<\/p>\n
after cgh\u00e9ideting “the; e\u00a7:a\u00a2nce let in by the
\nPlaintiff }he1d~ that r\u00a7uit. ‘A’, ‘B’ and ‘C’ are
\nancestiglu Pro?\u00a7ftiesd and suit item. No.’D’ has not
\nIoeen.  by  “” ‘plaintiff, issues 3 & 4 in the<\/p>\n
negative, “issue ;No.S in the affirmative and issue<\/p>\n
\u00b0~Ho.6 fin Vthe\ufb01 negative. Accordingly, suit was<\/p>\n
–cfdismissed,on the ground that plaintiffmappellant did<\/p>\n
tunottimplead her sister Anuradha Chillal and therefore<\/p>\n
fcaee to the conclusion that the suit is bad for non-<\/p>\n
iaijeinder of proper parties. Court held that plaintiff<\/p>\n

is entitled to claim 1\/30″ share. Accordingly, suit
\nwas dismissed. Challenging the legality’ and
\ncorrectness of the same, present appeal Vislgfiled.<\/p>\n
Even though respondents are served, they; are nun-<\/p>\n
represented. In the circumstances, we have heard the_<\/p>\n
counsel for the appellant.\n<\/p>\n
4. The main contention us the appel1;\ufb01$”before us
\nis that trial court having  that”-Apljaintiff is
\nentitled for 1\/30″‘ shareh in Lschedule–‘A’ to ‘C’,<\/p>\n
committed a serious error in dismissing the suit on<\/p>\n
the ground that nlaintiff did not implead her sister
\nAnuradha thillallim\ufb01ccording to him, even if Anuradha
\nChillal had not i\ufb01pleaded as a party to the suit as
\n:her share is deter\ufb01ined by the court holding that she<\/p>\n
is also entitled to claim 1\/3W” share, trial court<\/p>\n
v”<should,have.granted share in favour of the plaintiff-<\/p>\n
rlfappellantv in respect of' her share in the ;property<\/p>\n
sddenarcating share of Anuradha Chillal as the share of<\/p>\n
'5Anuradha Chillal cannot be taken away either by the<\/p>\n
Vigiplaintiff or by defendants 1 to 4.<\/p>\n

did not implead her sister Anuradhalchillaliwhohh<\/p>\n
is a necessary and proper party to”tha.5uit\u00a7*p<\/p>\n
6. So far as the share allotted by the court below
\nto the plaintiff,  challenged the
\nsame. Therefore, _s\ufb01\u00a2,ii\u00a7_”ag\u00a7g;\u00e9ved only for
\ndismissing her suit on the ground of non–joinder of
\nnecessary’ partiesg.K yhdhittedly; suit is filed for
\npartition and separate possession. Even if a sharer
\nhas not been impleaded} it was the duty of the court
\nto direct ghe parties to implead the sharer or in the
\nalternatiyey\ufb02hold Wthat sister who has not been<\/p>\n
impleaded= is. also entitled to claim share by<\/p>\n
Ahallotting_”her share; so that in Final Decree<\/p>\n
