According to the instructions dated 4th<br \/>\nJune 2004 issued by the Government under Section 54 of the Bombay<br \/>\nPrimary Education Act, a primary teacher against whom charges have<br \/>\nbeen proved after an enquiry has to be posted at a far off place by<br \/>\nan administrative order.  In fact, several other responsibilities are<br \/>\ncast upon the District Primary Education Officer to make appropriate<br \/>\nenquiries and initiate necessary disciplinary action when any teacher<br \/>\nin the district is found to be indulging in serious acts of<br \/>\nmisconduct.\n<\/p>\n<p>2.\tIt<br \/>\nwas submitted by learned counsel, Mr.Vyas, that serious charges were<br \/>\nnot only proved against respondent no.3 and not only that he was<br \/>\nremoved from service by way of punishment, another charge sheet dated<br \/>\n17.5.2008 alleging twelve different acts of serious misconduct is<br \/>\npending against said respondent and the DPEO is not proceeding with<br \/>\nthe enquiry.  On the other hand that respondent is threatening and<br \/>\ninfluencing other proceedings, according to the allegations made in<br \/>\nthe petition and affidavits placed on record.   It was further<br \/>\nsubmitted that the powers vested in the respondent authorities were<br \/>\nnot exercised in a bona fide manner and in consonance with the<br \/>\nstatutory Rules and guidelines.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel, Ms.Mandavia, appearing for respondent no.2 could not<br \/>\nproperly reply to the queries about the allegations made against that<br \/>\nauthority, and hence, the District Primary Education Officer was<br \/>\nordered to remain personally present for giving correct answers to<br \/>\nrelevant queries of the Court.  Upon remaining personally present, it<br \/>\nwas stated by him that he was only acting as an in-charge DPEO and<br \/>\ndid not think it proper to transfer respondent no.3 in view of order<br \/>\nof the tribunal to reinstate him on his original post.   It was<br \/>\nsubmitted on his behalf by learned counsel, Ms.Mandavia, that, even<br \/>\nas present in-charge DPEO is in charge of four offices, he would try<br \/>\nto complete the pending departmental enquiry against respondent no.3<br \/>\nwithin a period of two months.  She also argued that the petitioners<br \/>\nhave no locus standi to challenge any order of the authorities<br \/>\nand they were not entitled to any relief in their own right.\n<\/p>\n<p>4.\tLearned<br \/>\nAGP appearing for the State submitted, on the basis of letter dated<br \/>\n24.2.2010 of the Director of Primary Education, that respondent no.3<br \/>\nwas appointed in the same school inspite of pendency of the enquiry,<br \/>\nand hence, DPEO was directed to expeditiously conclude the<br \/>\ndepartmental enquiry and abide by the instructions issued by<br \/>\nGovernment resolution dated 4.6.2004.  It was further submitted by<br \/>\nlearned AGP that by virtue of the aforesaid very recent letter and<br \/>\neven otherwise it is the DPEO, who has to take appropriate action and<br \/>\nthe Government has done the needful by writing aforesaid letter.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel, Mr.K.B.Pujara, appearing for respondent no.3 submitted that<br \/>\nthe allegations against respondent no.3, on the earlier occasion as<br \/>\nwell as in the pending enquiry, were hollow and not admitted.  He<br \/>\nsubmitted that some people with vested interest were conspiring<br \/>\nagainst respondent no.3 on account of the leadership provided by him<br \/>\nto majority of the teachers of the district.  He further submitted<br \/>\nthat all the allegations made against respondent no.3 in the charge<br \/>\nsheet or by the petitioner were specifically denied and the<br \/>\nallegations of tampering with or influencing any judicial or<br \/>\nquasi-judicial proceeding were concocted and baseless.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned counsel for the parties at length, it was clear that it<br \/>\nwas one of the rare and exceptional case in which prima facie<br \/>\nthe authorities constituted under and for the implementation of the<br \/>\nBombay Primary Education Act have consistently failed in discharging<br \/>\ntheir duties for the purpose of maintaining minimum standard of<br \/>\ndiscipline and necessary atmosphere of good behaviour and safety in<br \/>\nthe sector of primary education in Bharuch district.  The Court has<br \/>\ncome to such prima facie conclusion<br \/>\non the basis of the facts that the charges against respondent no.3<br \/>\nwere to the effect that respondent no.3 was indulging in political<br \/>\nactivity and making public speeches, which were not befitting a<br \/>\nGovernment servant, while abdicating his duty of teaching the<br \/>\nstudents.  Without disturbing the finding of the enquiry against that<br \/>\nrespondent, the District Primary Education Tribunal reduced penalty<br \/>\nto stoppage of three increments.  On the other hand, enquiry<br \/>\ninitiated by charge sheet dated<br \/>\n17.5.2008 has admittedly not even commenced.  A bare reading of<br \/>\ncharge sheet dated 17.5.2008 would have impelled any authority to<br \/>\ntake immediate energetic action so as to disable the delinquent<br \/>\nofficer from continuing any of his activities related to his service.<br \/>\n Under the instructions issued by Government resolution dated 4th<br \/>\nJune 2004, the DPEO would have been obliged to transfer the<br \/>\ndelinquent officer.  Instead of that, as alleged by the petitioners,<br \/>\nrespondent no.3 is allowed to influence the proceedings pending<br \/>\nagainst him and the DPEO, who issued the charge sheet, has been<br \/>\ntransferred.  It was under such circumstances that serious<br \/>\napprehensions were expressed on behalf of the petitioners about the<br \/>\noutcome of any disciplinary proceeding or judicial proceeding held or<br \/>\nto be held against respondent no.3.\n<\/p>\n<p>7.\tSince<br \/>\nthe petitioners as well as the respondents are operating in the area<br \/>\nof education of children at the primary level and discharging their<br \/>\npublic duties, the issue of locus standi<br \/>\nof the petitioners and of their entitlement to any relief is<br \/>\nrelegated to irrelevance and the Court has, prima facie<br \/>\nfound this case to be one of abdication of statutory duties by the<br \/>\nDirector of Primary Education and District Primary Education Officer<br \/>\nof District Bharuch.  It was submitted, in that context, by learned<br \/>\nAGP that the Director of Primary Education has already issued special<br \/>\ninstructions vide letter dated 24.2.2010, and hence, necessary<br \/>\nactions were now required to be taken by the DPEO, and no further<br \/>\ndirection is required as far as the Director of Primary Education is<br \/>\nconcerned.  However, in view of the attitude adopted by respondent<br \/>\nno.2 and the record of the case so far, it is difficult to repose any<br \/>\ntrust in respondent no.2 for taking the required action in discharge<br \/>\nof his statutory duties.  Therefore, in order to ensure the rule of<br \/>\nlaw and prompt and proper execution of order dated 24.2.2010, as well<br \/>\nas for ensuring due compliance of the instructions contained in<br \/>\nGovernment resolution dated 4th<br \/>\nJune 2004, it is directed by way of interim order that a competent<br \/>\nand experienced officer of the rank higher than District Primary<br \/>\nEducation Officer, who is competent and experienced for conducting a<br \/>\nproper departmental enquiry, shall be specially appointed for the<br \/>\npurpose of holding departmental enquiry into the charges levelled by<br \/>\ncharge sheet dated 17.5.2008 and respondent no.3 shall be transferred<br \/>\nwith immediate effect to any other village in the same district in<br \/>\naccordance with the instructions contained in paragraph 5 of<br \/>\naforesaid Government resolution dated 4th<br \/>\nJune 2004.\n<\/p>\n<p>8.\tIn<br \/>\nthe aforesaid rare and exceptional circumstances, briefly referred to<br \/>\nherein above, the petition is Admitted<br \/>\nand Notice of Rule<br \/>\nis waived by learned counsel for the respondents.  It is ordered to<br \/>\nbe listed for further hearing and further orders, if required, on<br \/>\n30th<br \/>\nMarch 2010.
