Heard     Shri    Raj     Nandan     Prasad,       learned<\/p>\n<p>                    counsel   for     the    petitioner     and   Shri    Ashok    Kumar<\/p>\n<p>                    Gupta, learned A.C. to S.C.5.\n<\/p>\n<p>                              The    petitioner,      who   retired      as    Assistant<\/p>\n<p>                    from the office of Deputy Development Commissioner,<\/p>\n<p>                    D.R.D.A.,       Sheohar,    has     prayed     for      payment    of<\/p>\n<p>                    following retiral dues :\n<\/p>\n<blockquote><p>                                i.     Amount    of     Gratuity      and      leave<\/p>\n<p>                                      encashment      of    the   petitioner      be<\/p>\n<p>                                      paid to the petitioner with up to<\/p>\n<p>                                      date     statutory     interest,        giving<\/p>\n<p>                                      benefit of six pay Commission.<\/p><\/blockquote>\n<pre>\n\n                              ii.       Arrear     of      full   payment      from\n\n                                      8.5.2006        to      21.3.2007         and\n\n<\/pre>\n<blockquote><p>                                      23.5.2008 to 30.6.2009 with up to<\/p>\n<p>                                      date statutory interest.<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<\/blockquote>\n<p>               iii.     Deference of payment since 1.4.2007<\/p>\n<p>                          to   30.6.2009    due     to     six    pay<\/p>\n<p>                          Commission    with       up     to     date<\/p>\n<p>                          statutory interest.\n<\/p>\n<p>                 With the consent of the parties, the writ<\/p>\n<p>        petition is being disposed of with liberty to the<\/p>\n<p>        petitioner to file a detailed representation before<\/p>\n<p>        the respondent no.3 within a period of six weeks<\/p>\n<p>        from today. If such representation is filed, the<\/p>\n<p>        respondent no.3 is directed to examine the same and<\/p>\n<p>        pass necessary order within a period of two months<\/p>\n<p>        from the date of filing of such representation so<\/p>\n<p>        that   entire    grievances    of   the   petitioner      may   be<\/p>\n<p>        redressed within aforesaid time.
