It appears that the present petitioner has also taken<br \/>\ninspiration from the News Items appearing about the demolition of<br \/>\nillegal construction and removal of encroachment in the Print Media.<br \/>\nThe petitioner &#8211; Memunabibi D\/o. Ahmed Lala is<br \/>\nbefore this Court through her Power of Attorney holder  Rannaben<br \/>\nHarishkumar Patel.\n<\/p>\n<p> The prayer sought for in this petition is as under:\n<\/p>\n<p>&#8220;11(B).\tIssue<br \/>\nappropriate writ, order or direction directing the concerned<br \/>\nrespondent authorities  to look into the grievance of the<br \/>\npetitioner made in the representation \/ notice of the petitioner<br \/>\ndated 31\/7\/2010 (29\/7\/2010) and to take appropriate action for<br \/>\nremoval \/ demolition of illegal and unauthorized construction carried<br \/>\nout by respondent Nos. 4, 5 and 6 upon the land being Final Plot No.<br \/>\n28, T. P. Scheme No. 16, admeasuring 18469 sq. mtrs. situated at<br \/>\nMouje Village Kapodra, Dist. Surat in the aforesaid peculiar facts<br \/>\nand circumstances of the case.&#8221;\n<\/p>\n<p>(emphasis supplied)<\/p>\n<p>2.0\tLearned<br \/>\nadvocate Mr. NK Majmudar for the petitioner submitted that one<br \/>\nAjaybhai Ramdas Jadhav, resident of 12, Pashupatinath Society, Nana<br \/>\nVarachha, Surat filed complaints to the Vigilance Department of the<br \/>\nSurat Municipal Corporation on 18th March 2009 and 19th<br \/>\nMarch 2009, which are replied by communication dated 5th<br \/>\nMay 2009, copies of which are produced at Page Nos. 23 and 24.  From<br \/>\nthe aforesaid applications it is clear that the Corporation had<br \/>\ngranted Development Permission bearing<br \/>\nNo. East Zone\/TD\/46 dated<br \/>\n 29 th  November 1997.\n<\/p>\n<p>&#8216;On Owners&#8217; Plot admeasuring 18469 sq. mtrs., all constructions<br \/>\nare unauthorized&#8217;.  This permission was granted qua Final<br \/>\nPlot<br \/>\nNo. 28.\n<\/p>\n<p>2.1\tIt<br \/>\nwas inquired from the learned advocate for the petitioner as to who<br \/>\nAjaybhai Ramdas Jadhav is, the learned advocate for the petitioner<br \/>\nsubmitted that, &#8216;he is a member of the  same group&#8217;.  When it<br \/>\nis inquired, as to what &#8216;group&#8217;, he submitted that, those who are<br \/>\ncomplaining about the illegal \/ unauthorized construction in Final<br \/>\nPlot No. 28.  The learned advocate for the petitioner is not able to<br \/>\npoint out as to how this Ajaybhai Ramdas Jadhav is interested in<br \/>\nremoval of unauthorized construction on Final Plot No. 28.\n<\/p>\n<p>3.0\tWhat<br \/>\nis required to be noted is that the Development Permission was<br \/>\ngranted in the year 1997 and the extent of unauthorized construction<br \/>\nis mentioned to be 18469 sq. mtrs.  A judicial notice can be<br \/>\ntaken of the fact that, this construction must not have come up<br \/>\novernight and therefore, the present litigation is a litigation with<br \/>\nill-design and oblique motive.  Without making the bona-fides<br \/>\nclear of the petitioner, the Court refuses to grant any indulgence to<br \/>\nthe petitioner and therefore, this petition deserves to be dismissed<br \/>\nand it is accordingly dismissed.\n<\/p>\n<p>3.1\tHowever,<br \/>\nin the interest of justice it is clarified that, non-entertainment of<br \/>\nthis petition does not give, in any way, the &#8216;seal of approval&#8217; to<br \/>\nthe construction, which is referred to by the Corporation itself in<br \/>\nits communication dated 5th May 2009 as &#8216;unauthorized<br \/>\nconstruction&#8217;.  At any point of time, when the Corporation proposes<br \/>\nto remove or take action against this unauthorized construction,<br \/>\nnon-entertainment of this petition should not be pleaded as &#8216;seal of<br \/>\napproval&#8217; by this Court to the aforesaid unauthorized construction.\n<\/p>\n<p>[<br \/>\nRavi R.
