L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\t  applicant &#8211; convict prisoner, who,  vide   judgment    and<br \/>\n\torder dated 28.11.2006   rendered  in Sessions   Case No. 48 of 2006<br \/>\n\tby  the  learned  Additional Sessions Judge, Fast Track Court<br \/>\n\tNo.2, Patan, has been convicted for the offence punishable under<br \/>\n\tSection 302 of the Indian Penal Code and sentenced to imprisonment<br \/>\n\tfor life, has filed this application through jail authority, praying<br \/>\n\tto enlarge him on temporary bail for a period of 30 days to enable<br \/>\n\thim to render financial assistance to his family members.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by  Mr.L.B.Dabhi, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the application so also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the application.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 4 years, 8 months and 2 days of<br \/>\n\timprisonment and during the said period he was enlarged on temporary<br \/>\n\tbail on two occasions and has also enjoyed Furlough Leave on two<br \/>\n\toccasions.   There is no jail punishment as his conduct in jail is<br \/>\n\talso good.\n<\/p>\n<p>In<br \/>\n\tview of this, if the Applicant convict is released on temporary bail<br \/>\n\tfor a period of 7 days from the date of his actual release, the same<br \/>\n\twould meet the ends of justice.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeed in part and is<br \/>\n\taccordingly partly allowed.  The Applicant &#8211; Convict &#8211;<br \/>\n\tBHARAT KESHAVLAL  is ordered to be released on<br \/>\n\ttemporary bail for a period of 7 days from the date of his actual<br \/>\n\trelease, on executing a personal bond of Rs.5,000\/- before the jail<br \/>\n\tauthority on usual terms and conditions. The applicant shall<br \/>\n\tsurrender to the jail authority on completion of 7 days from the<br \/>\n\tdate of his release without fail.  During the period of temporary<br \/>\n\tbail, the applicant shall not abuse the liberty granted to him and<br \/>\n\tshall maintain law and order.
