6. After hearing the learned Counsel for the parties
\nand perusing the award of the Tribunal, I am of the
\nView that the \ufb01nding of the Tribunal that claimant had<\/p>\n
contributed 20% for the accident is not just and proper<\/p>\n
and E hold. the accident was occurred <\/p>\n
negligence on the part of the ridcrpf it<\/p>\n
and quantum of compensation. awarded yvgustfarici<\/p>\n
reasonable and it does not for elnhan ce-:r1e~n’t’;’
\nAfter the accident, ,th’c…lPo’l’ice haVev..re.g’istered a
\ncase against the rider Vlohf’th.e.”\u00a5’c:ifendii1.g”‘motor cycle and<\/p>\n
after investigation,  against the<\/p>\n
ride1\u00a7r._pf   appears to have pleaded
\nguilty befo.re..thc_cri1i1i:nial Court. Even the spot sketch<\/p>\n
of:i2he__placVciden’tA-shows it is a double road and there is<\/p>\n
‘ .\u00bb.div:ide1fV.”~ Cla’in1ant after getting down from the bus was<\/p>\n
‘proceedingV..5’from West to East to attend duty in a<\/p>\n
garment ‘factory. She had almost reached the divider.<\/p>\n
  rider of the motor cycle who was proceeding from<\/p>\n
‘South to North, appears to have taken right turn<\/p>\n
suddenly and caused the accident. The insurer who<\/p>\n

contends, claimant had contributed for the accident at
\n20% did not choose to examine the rider of the<\/p>\n
offending vehicle. Whereas, the claimant hasrjdeposed<\/p>\n
before the Tribunal that she was crossihgg  <\/p>\n
carefully and cautiously, and the”ac-side-_ht  it<\/p>\n
due to rash and negligent riding’ <\/p>\n
by its rider. Therefore,   that\u00bb<\/p>\n
claimant had contributed    at 2(2)”\/o is not
\njust and proper and it   of oral and

Right temporal contusion with subarachnoid
\nhaemorrhage, which is grievous in nature.<\/p>\n
injuries sustained by her are also supported by
\nher era} evidence examined as P.W.1. She has not<\/p>\n
examined the doctor regarding disability.<\/p>\n
10. Considering the nature of injur_i.ee\u00bb,… <\/p>\n

13. Even though doctor is not examined regarding
\ndisability. the Tribunal considering the riature of<\/p>\n
injuries indicated in the wound certificate. has _a’w4ard’eAd<\/p>\n
$25,000\/– towards loss of amenities which  <\/p>\n
on the higher side and therefore\ufb02t. does  require<\/p>\n
enhancement.\n<\/p>\n
14. Claimant after continued
\nher employment in garilnerith  there is no loss
\nof employmeritr Z’? of awarding
\ncompensation’  income does not<\/p>\n
arise._.-  _  M<\/p>\n
15. the  awarded by the Tribunal is<\/p>\n
more than entitlement. there is no scope for<\/p>\n

far aslthe negligence is concerned and it is held that the<\/p>\n
 .accident was occurred due to sole negligence on the<\/p>\n

to pay the entire compensation awarded by the Tribunal<\/p>\n
with interest as has been awarded by the ‘I’ribuna1__._<\/p>\n
