No.956 of 2009\n    ------------------------------------------------\n      Dated this the 28th day of August, 2009\n\n                     JUDGMENT\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>      We do not find any warrant for interference with<\/p>\n<p>the judgment under appeal. The case pertains to<\/p>\n<p>acquisition of land in Elathur village in Calicut district<\/p>\n<p>for the purpose of construction of Railway over bridge.<\/p>\n<p>The property was enjoying frontage of existing<\/p>\n<p>National   Highway.    The    relevant   Section    4(1)<\/p>\n<p>notification was published on 02\/12\/2000. The Land<\/p>\n<p>Acquisition Officer awarded land value at the rate of<\/p>\n<p>Rs.20,090\/- per cent which was enhanced by the<\/p>\n<p>Reference Court at Rs.60,000\/- per cent. The main<\/p>\n<p>item of evidence was Ext.A1 and report of the<\/p>\n<p>Commissioner. In Ext.A1, the distance between Ext.A1<\/p>\n<p>property and acquired property was 50 metres. Ext.A1<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.956 of 2009           -2-<\/span><\/p>\n<p>      reveal a centage value of Rs.1 lakh. The learned<\/p>\n<p>      Subordinate Judge did not become inclined to award<\/p>\n<p>      the entire centage value revealed in Ext.A1 for the<\/p>\n<p>      reason that the Advocate Commissioner did not<\/p>\n<p>      inspect and compare Ext.A1 property with the<\/p>\n<p>      acquired property. But the Advocate Commissioner<\/p>\n<p>      recommended for much more than what is now<\/p>\n<p>      awarded. We feel that the appreciation of evidence by<\/p>\n<p>      the learned Subordinate Judge was proper and it is<\/p>\n<p>      more or less the correct market value of the property<\/p>\n<p>      at the relevant time which has been arrived at under<\/p>\n<p>      the impugned judgment.\n<\/p>\n<p>             The appeal will stand dismissed.
