M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr. Mihir Thakore, learned Senior counsel assisted by<br \/>\nlearned counsel Mr. Dhaval C. Dave, Mr. Ankur Oza and Mr. Dipak<br \/>\nSabharwal for the petitioner.\n<\/p>\n<p>2.\t\tBy<br \/>\nmeans of this writ petition, the petitioner has challenged grant of<br \/>\ntender in favour of respondent No.2 on the ground that respondent<br \/>\nNo.2&#8217;s technical bid has illegally been accepted though as per<br \/>\nspecifications provided in the tender notice in Tender No.17<br \/>\n(Annexure 2 to the writ petition) in Clause 5 &#8211; Technical<br \/>\nQualification Requirements (Eligibility Criteria) of sewing machines<br \/>\nof Quality specified, which has been mentioned at page 61 of the<br \/>\npetition wherein the machine has to adjust length of stitches as well<br \/>\nas to get patterns of stitches.  Minimum 18 in built stitches<br \/>\npatterns is required to be the capacity of the machine.\n<\/p>\n<p>3.\t\tAccording<br \/>\nto learned senior counsel for the petitioner, sewing machines of the<br \/>\nrespondent No.2 could adjust length of stitches but it could not get<br \/>\n18 in built stitches patterns.  Therefore, according to learned<br \/>\nsenior counsel for the petitioner, the technical bid of respondent<br \/>\nNo.2 has illegally been accepted as he was not qualified for<br \/>\ntechnical bid and, therefore, there was no question of opening of<br \/>\nfinancial bid of respondent No.2.  He states that he has heard that<br \/>\ncontract has been awarded to respondent No.2, but order has not yet<br \/>\nbeen placed to respondent No.2 by the respondent No.1.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the urgency of the matter, issue RULE.  List this matter on<br \/>\n09.08.2011 to enable both the respondents to appear and file their<br \/>\naffidavit-in-reply.\n<\/p>\n<p>5.\t\tIf<br \/>\norder in pursuance of the contract awarded to respondent No.2 has not<br \/>\nyet been placed by respondent No.1, the same shall not be placed till<br \/>\n09.08.2011.
