PATTANAIK, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by the State is directed against the order<br \/>\nof the\tPatna High  Court dated 5.3.1992, by which order the<br \/>\nHigh Court  has quashed\t the cognizance\t taken\tagainst\t the<br \/>\nrespondent under Section 414 of the Indian Penal Code.\n<\/p>\n<p>     Shri Uddai\t Singh,\t Sub-Inspector\tof  Police,  Dhanbad<br \/>\nPolice\tStation\t was  on  duty\tat  the\t Police\t Station  on<br \/>\n8.1.1992. At  5.15  P.M.  two  Constables  brought  a  truck<br \/>\nbearing Registration  No. HRX-3125  along with\tits  driver,<br \/>\nKhalasi and  two other\tpersons and reported that they found<br \/>\nthe truck  coming speedly  and crossing the Railway gate and<br \/>\ndid not\t stop even  though the\tvehicle was  asked to  stop.<br \/>\nThey, therefore,  chased the  vehicle and  stopped the\tsame<br \/>\nafter some  time and  found that  the truck  has been loaded<br \/>\nwith pieces  of iron  tracks  which  were  the\tproperty  of<br \/>\nB.C.C.L. On  their enquiry  about the  documents, a  copy of<br \/>\nchallan\t was  shown  but  suspecting  something\t wrong\tthey<br \/>\nbrought the  truck with\t the persons  to the Police Station.<br \/>\nThe Sub-Inspector  then found  on checking  that most of the<br \/>\niron loaded on the truck were the pieces of the track trolly<br \/>\nused in\t B.C.C.L. On  suspicion the  Sub-Inspector asked the<br \/>\ndriver who  told that  the truck  has been  loaded from\t the<br \/>\nfactory of Rajendra Agarwalla, the respondent in this appeal<br \/>\nand one\t Surendra Agarwal,  proprietor of Associate Iron and<br \/>\nSteel Company at Saraidhela has purchased the same. But they<br \/>\ncould not  produce any\tdocument. He  therefore submitted  a<br \/>\nreport to  the Inspector-cum-Officer-in-Charge of the Police<br \/>\nStation alleging  that the  accused persons  are  guilty  of<br \/>\noffence under  Section 414 of I.P.C. and the said report was<br \/>\ntreated as  First Information  Report. After  investigation,<br \/>\ncharge sheet was filed against the respondent and five other<br \/>\npersons on  21.1.1992. In  G.R. Case  No. 107  of 1992,\t the<br \/>\nlearned Magistrate on perusal of the papers submitted by the<br \/>\npolice and  all other  relevant materials  took conizance of<br \/>\nthe  offence   in  question   on  1.2.1992.  The  respondent<br \/>\nthereafter filed  application in  the Patna  High  Court  at<br \/>\nRanchi Bench  invoking the  jurisdiction of  the Court under<br \/>\nSection 482  of the  Code of  Criminal Procedure praying for<br \/>\nquashing  the\torder  of  cognizance  taken  and  the\tsaid<br \/>\napplication was registered as Criminal Case No. 475 of 1992.<br \/>\nThe learned  Judge by  the impugned order having quashed the<br \/>\ncognizance taken  by the  Magistrate so far as respondent is<br \/>\nconcerned, the State has approached this Court.\n<\/p>\n<p>     Mr. B.B. Singh, learned counsel appearing for the State<br \/>\ncontended that\tthe State  contended  that  the\t High  Court<br \/>\nexceeded its  jurisdiction under  Section 482 of the Code of<br \/>\nCriminal Procedure  by trying  to appreciate the evidence on<br \/>\nrecord and  thereafter recording  the finding  that no prima<br \/>\nfacie case  has been  made out.\t Mr. Singh further contended<br \/>\nthat   notwithstanding\t the   well   recognised   principle<br \/>\nenunciated by this Court that the power under Section 482 of<br \/>\nthe Code  of Criminal  Procedure should\t be  exercised\tvery<br \/>\nsparingly and  cautiously and  only when  the court comes to<br \/>\nthe conclusion\tthat there  has been an abuse of the process<br \/>\nof the\tcourt, but  in the  case in  hand the  learned Judge<br \/>\nexamined the  legality of the order of cognizance as a court<br \/>\nof appeal  and as  such the  order  of\tthe  High  Court  is<br \/>\nunsustainable in law. Mr. U.R. Lalit, learned senior counsel<br \/>\nappearing for  the respondent  on the  other hand  contended<br \/>\nthat the  High Court having examined the material and having<br \/>\ncome to\t the conclusion\t that the materials on record do not<br \/>\nmake out  an offence  under Section  414 of the Indian Penal<br \/>\nCode, the court was fully justified in quashing the order of<br \/>\ncognizance and\tthe same  order should\tnot be interfered by<br \/>\nthis Court.\n<\/p>\n<p>     It has  been held\tby this\t Court in several cases that<br \/>\nthe inherent  power of\tthe court  under Section  482 of the<br \/>\nCode of\t Criminal Procedure  should be\tvery  sparingly\t and<br \/>\ncautiously used\t only when the court comes to the conclusion<br \/>\nthat there  would be  manifest injustice  or there  would be<br \/>\nabuse of  the process  of the  court, if  such power  is not<br \/>\nexercised. So far as the order of cognizance by a Magistrate<br \/>\nis concerned,  the inherent  power can be exercised when the<br \/>\nallegations in the First Information Report or the complaint<br \/>\ntogether  with\t the  other   materials\t  collected   during<br \/>\ninvestigation taken  at their  face value, do not constitute<br \/>\nthe offence  alleged. At  that stage  it is not open for the<br \/>\ncourt  either  to  shift  the  evidence\t or  appreciate\t the<br \/>\nevidence and come to the conclusion that no prima facie case<br \/>\nis made out. In a recent Judgment of this Court to which one<br \/>\nof us (Hon. K. Ramaswamy, J.) was a member it has been held,<br \/>\nfollowing the  earlier decision\t in <a href=\"\/doc\/579822\/\">Mrs.  Rupan Deol Bajaj &amp;<br \/>\nAnr. v. Kanwar Pal Singh Gill &amp;<\/a> anr. (JT 1995 (7) SC 299) :\n<\/p>\n<blockquote><p>     &#8216;It  is   thus  settled   law  that  the<br \/>\n     exercise of  inherent power  of the High<br \/>\n     Court is  an exceptional one. Great care<br \/>\n     should be taken by the High court before<br \/>\n     embarking\t   to\t   scrutinize\t  the<br \/>\n     FIR\/chargesheet\/complaint.\t In  deciding<br \/>\n     whether the case is rarest of rare cases<br \/>\n     to\t scuttle   the\tprosecution   in  its<br \/>\n     inception, it  first has to get into the<br \/>\n     grip   of\t the   matter\twhether\t  the<br \/>\n     allegations constitute  the offence.  It<br \/>\n     must be  remembered that  FIR is only an<br \/>\n     imitation to  move the  machinery and to<br \/>\n     investigate  into\t cognizable  offence.<br \/>\n     After the investigation is concluded and<br \/>\n     the charge-sheet is laid the prosecution<br \/>\n     produces the statements of the witnesses<br \/>\n     recorded under  Section 161  of the Code<br \/>\n     in support\t of the charge-sheet. At that<br \/>\n     stage it  is not  the  function  of  the<br \/>\n     Court to  weigh the pros and cons of the<br \/>\n     prosecution   case\t   or\tto   consider<br \/>\n     necessity of  strict compliance  of  the<br \/>\n     provisions\t   which    are\t   considered<br \/>\n     mandatory\tand   its  effect   of\t non-<br \/>\n     compliance. It  would be  done after the<br \/>\n     trial is  concluded. The  Court  has  to<br \/>\n     prima facie  consider from the averments<br \/>\n     in the  charge-sheet and  the statements<br \/>\n     of witnesses  on the  record in  support<br \/>\n     thereof   whether\t court\t could\t take<br \/>\n     cognizance\t of   the  offence,  on\t that<br \/>\n     evidence and  proceed further  with  the<br \/>\n     trial. If\tit reaches  a conclusion that<br \/>\n     no cognizable  offence is\tmade  out  no<br \/>\n     further act  could\t be  done  except  to<br \/>\n     quash the\tcharge\tsheet.\tBut  only  in<br \/>\n     exceptional cases,\t i.e.  in  rarest  of<br \/>\n     rare cases\t of mala  fide initiation  of<br \/>\n     the   proceedings\t to   wreak   private<br \/>\n     vengeance process of criminal is availed<br \/>\n     of in  laying a  complaint or FIR itself<br \/>\n     does not  disclose at all any cognizable<br \/>\n     offence &#8211;\tthe court may embark upon the<br \/>\n     consideration thereof  and exercise  the<br \/>\n     power.<\/p><\/blockquote>\n<p>\t  When the  remedy under  Section 482<br \/>\n     is available,  the High  Court would  be<br \/>\n     loath and\tcircumspect to\texercise  its<br \/>\n     extraordinary power  under\t Article  226<br \/>\n     since efficacious\tremedy under  Section<br \/>\n     482 of  the Code  is available. When the<br \/>\n     Court exercises its inherent power under<br \/>\n     Section  482   the\t prime\tconsideration<br \/>\n     should only  be whether  the exercise of<br \/>\n     the power\twould advance  the  cause  of<br \/>\n     justice or\t it would  be an abuse of the<br \/>\n     process of the court. When investigation<br \/>\n     officer  spends   considerable  time  to<br \/>\n     collect  the  evidence  and  places  the<br \/>\n     charge-sheet before  the Court,  further<br \/>\n     action should  not be short-circuited by<br \/>\n     resorting to  exercise inherent power to<br \/>\n     quash  the\t  charge-sheet.\t The   social<br \/>\n     stability\tand   order  requires  to  be<br \/>\n     regulated\tby   proceeding\t against  the<br \/>\n     offender as it is an offence against the<br \/>\n     society  as   a  whole.   This  cardinal<br \/>\n     principle should  always be kept in mind<br \/>\n     before   embarking\t   upon\t   exercising<br \/>\n     inherent power.&#8217;<br \/>\n     Bearing in\t mind the aforesaid parameters if the charge<br \/>\nsheet and  the F.I.R. filed in the case in hand are examined<br \/>\nand the\t impugned order\t of the\t High court  is tested,\t the<br \/>\nconclusion becomes irresistible that the High Court exceeded<br \/>\nits jurisdiction  by trying  to appreciate  the evidence and<br \/>\ncoming to  a conclusion\t that no  offence is  made  out.  On<br \/>\nexamining the  material on  record and the impugned judgment<br \/>\nof the\tHigh Court we are of the considered opinion that the<br \/>\nHigh Court  was wholly\tunjustified in invoking its inherent<br \/>\npower under Section 482 of the Code of Criminal Procedure to<br \/>\nquash the  cognizance taken  in as much as the allegation in<br \/>\nthe F.I.R.  and material  referred to in the charge sheet do<br \/>\nmake out  an offence  under Section  414 of the Indian Penal<br \/>\nCode,  so  far\tas  the\t respondent  is\t concerned.  In\t the<br \/>\naforesaid premise the impugned order of the High Court dated<br \/>\n5.3.1992 passed in Criminal Miscellaneous No. 475 of 1992 is<br \/>\nquashed and  this  appeal  is  allowed.\t The  Magistrate  is<br \/>\ndirected to  proceed with  the trial against the respondent.<br \/>\nThe  respondent\t  may  now   appear  before  the  Magistrate<br \/>\nforthwith.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Bihar vs Sri Rajendra Agrawalla on 18 January, 1996 Equivalent citations: JT 1996 (1), 601 1996 SCALE (1)394 Author: G Pattanaik Bench: G.B.
