It is submitted that considering<br \/>\nthe role attributed to the applicants, statements of witnesses and<br \/>\nthe fact that since the investigation is over and charge-sheet is<br \/>\nalready filed, they deserve to be enlarged on bail. Learned advocate<br \/>\nfurther placed reliance on the order dated 17.11.2009 passed by this<br \/>\nCourt [Coram: Akil Kureshi, J.] in Criminal Misc. Application No.<br \/>\n12400 of 2009 and submitted that sister-in-law of the deceased has<br \/>\nalready been enlarged on bail. Considering the aforesaid fact and<br \/>\nsince the applicants are also identically situated like sister-in-law<br \/>\nof the deceased, they deserve to be enlarged on bail even on the<br \/>\nground of parity.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>M.L. Shah, learned APP representing the opponent State, placing<br \/>\nreliance on the order dated 17.11.2009 passed by this Court [Coram:<br \/>\nAkil Kureshi, J.] in Criminal Misc. Application No. 12400 of 2009,<br \/>\nsubmitted that sister-in-law of the deceased was  staying separately<br \/>\nand her case stands on different footing than the case of the present<br \/>\napplicants. As the present applicants were staying with the deceased<br \/>\nand they subjected the deceased to cruelty and harassment  and<br \/>\nabetted the husband in the aforesaid act, their case cannot be<br \/>\nequated with sister-in-law who was staying separately and enlarged on<br \/>\nbail by this Court. Thus, considering the aforesaid aspect and<br \/>\nprovisions of Section 304B of Indian Penal Code, which is with regard<br \/>\nto dowry death, no discretionary relief be granted to the applicants<br \/>\nand the application deserves to be dismissed.\n<\/p>\n<p>\tI<br \/>\nhave heard the learned advocate Mr. Bhoharia for the applicants and<br \/>\nMs. M.L. Shah, learned APP for the opponent State, at length and in<br \/>\ngreat detail. I have considered the averments made in the<br \/>\napplication, role attributed to the applicants and the manner in<br \/>\nwhich the offence is committed by the applicants. Statements of<br \/>\nwitnesses which are referred to by the learned advocates of both the<br \/>\nsides are  perused by me. Deceased was subjected to mental and<br \/>\nphysical cruelty by the applicants and that fact is borne out from<br \/>\nthe statements of witnesses.\n<\/p>\n<p>\tSection-304B<br \/>\nof IPC is also perused by me. It is with regard to dowry death. It is<br \/>\nstated therein, that where the death of a woman is caused by any<br \/>\nburns or bodily injury or occurs otherwise than under normal<br \/>\ncircumstances within seven years of her marriage and it is shown that<br \/>\nsoon before her death she was subjected to cruelty or harassment by<br \/>\nher husband or any relative of her husband for, or in connection<br \/>\nwith, any demand for dowry, such death shall be called  dowry<br \/>\ndeath  and such husband or relative shall be deemed to have caused<br \/>\nher death. Sub-section [2] of Sec.304B prescribes punishment for<br \/>\ndowry death for not less than seven years and it may extend to<br \/>\nimprisonment for life.\n<\/p>\n<p>\tThus,<br \/>\nconsidering the role attributed to the applicants as discussed herein<br \/>\nabove and from perusal of police papers, no discretionary relief, in<br \/>\nmy view, be granted to the applicants. Case of the applicants cannot<br \/>\nbe equated with the case of the sister-in-law who is already enlarged<br \/>\non bail and was staying separately from the deceased and other family<br \/>\nmembers. Thus, considering the aforesaid aspect, the applicants, in<br \/>\nmy view, are not entitled to claim discretionary relief and as there<br \/>\nis no merit in the application, the same is dismissed.
