Ramachandra Menon, J.\n<\/p>\n<\/p>\n<p>     The petitioners are                     before this Court seeking for the<\/p>\n<p>following prayers:\n<\/p>\n<\/p>\n<blockquote><p>           &#8221; i) to        issue a writ of mandamus directing the<\/p>\n<p>           respondents 1 to 7 to ensure that the land having<\/p>\n<p>           an extent of 23.95 acres in R.S.No. 27\/1, 28\/1,<\/p>\n<p>           29\/2, 29\/4, 29\/5, 29\/6, 29\/7, 29\/8, 30\/1, 30\/2,<\/p>\n<p>           32\/1, 32\/6, 32\/7, 32\/9, 33\/6, 33\/10 and 74\/1 in<\/p>\n<p>           Edakochy in Ernakulam district is not converted into<\/p>\n<p>           a Cricket Stadium and not reclaimed in any manner<\/p>\n<p>           and that the said land is                         conserved as a paddy<\/p>\n<p>           lands and wetlands;<\/p><\/blockquote>\n<p>           ii) to declare that the land in R.S. No.27\/1, 28\/1,<\/p>\n<p>           29\/2, 29\/4, 29\/5, 29\/6, 29\/7, 29\/8, 30\/1, 30\/2,<\/p>\n<p>           32\/1, 32\/6, 32\/7, 32\/9, 33\/6, 33\/10 and 74\/1 in<\/p>\n<p>           Edakochy in Ernakulam district is not liable to be<\/p>\n<p>           converted into a Cricket Stadium and is to be<\/p>\n<p>W.P.(C) No. 34551 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>           preserved, without being reclaimed.<\/p>\n<p>                 iii) to issue a writ of mandamus directing the<\/p>\n<p>           respondents 1 to 7 to ensure preservation of the<\/p>\n<p>           above land with all the characteristics thereof and<\/p>\n<p>           without in any way converting the wet land and<\/p>\n<p>           paddy lands in the said area;\n<\/p>\n<p>                 iv)   to issue a writ of mandamus directing<\/p>\n<p>           Respondents 1 to 7 to take appropriate actions<\/p>\n<p>           against respondent No.8 and the persons in charge<\/p>\n<p>           of respondent No.8 society including Respondents 9<\/p>\n<p>           and 10 for attempting to convert the paddy land<\/p>\n<p>           and referred in Ext.P3 wetlands into a Cricket<\/p>\n<p>           Stadium by violating the law;\n<\/p>\n<p>                 v) to issue such other orders, directions or<\/p>\n<p>           writs as may be prayed for and that this Hon&#8217;ble<\/p>\n<p>           Court may deem fit on the facts and circumstances<\/p>\n<p>           of the case.&#8221;\n<\/p>\n<\/p>\n<p>     2. Going by the materials on record, the prayer essentially<\/p>\n<p>is that the property concerned is not liable to be converted into<\/p>\n<p>a Cricket Stadium and is not liable to be reclaimed           in any<\/p>\n<p>manner, it being a wet land by virtue of the relevant provisions<\/p>\n<p>of law (the Kerala Conservation of Paddy Land and Wet Land Act,<\/p>\n<p>2008). There is also a case for the petitioners that it comes<\/p>\n<p>W.P.(C) No. 34551 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>under the prohibited zone, by virtue of the parameters prescribed<\/p>\n<p>by the Coastal Zone Management Authority.<\/p>\n<p>      3.  Mr.   Kaleeswaram Raj, the learned Counsel for the<\/p>\n<p>petitioners submits that the 4th respondent has already filed a<\/p>\n<p>counter affidavit along with the relevant records, pointing out<\/p>\n<p>that the property comes under the CRZ-1 zone and as such, no<\/p>\n<p>construction activity is permissible under any circumstances.<\/p>\n<p>      4. Mr. G. Sreekumar, the learned Counsel appearing for the<\/p>\n<p>respondents 8, 9 and 10 reiterated the submission already made<\/p>\n<p>before this Court that the said     respondents do not intend to<\/p>\n<p>effect any construction at all, contrary to the relevant provisions<\/p>\n<p>of law, unless and until statutory clearance is obtained. The<\/p>\n<p>learned Counsel further submits that the 4th respondent has<\/p>\n<p>already issued a notice to the said respondents with regard to the<\/p>\n<p>the proposal to construct Cricket Stadium and that the above<\/p>\n<p>respondents are pursuing further steps by giving reply.<\/p>\n<p>      5. In the above circumstances, this Court does not find it<\/p>\n<p>necessary to go into the merits of the case. The Writ Petition is<\/p>\n<p>disposed of, permitting the respondents 8, 9 and 10 to pursue<\/p>\n<p>W.P.(C) No. 34551 OF 2010<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>the matter by filing appropriate reply before the 4th respondent,<\/p>\n<p>however, making it clear that further steps with regard to<\/p>\n<p>construction of stadium shall be pursued only subject to the<\/p>\n<p>statutory clearance, to be given by the 4th respondent\/competent<\/p>\n<p>authority.\n<\/p>\n<p>\nI.A.
