Basheer, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       W.A.No. 2073 OF 2009\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 18th day of September, 2009\n\n                               JUDGMENT\n<\/pre>\n<p>Basheer, J.\n<\/p>\n<p>     This appeal at the instance of the employer who is<\/p>\n<p>aggrieved by the order passed by the learned Single Judge in<\/p>\n<p>WP(C) No.31129 of 2004.              By the impugned judgment, the<\/p>\n<p>learned Single Judge has set aside Ext.P1 award and directed the<\/p>\n<p>Tribunal to consider the matter afresh.<\/p>\n<p>     2.     We have heard learned Senior Counsel for the<\/p>\n<p>appellant\/employer and the learned counsel for respondent No.1<\/p>\n<p>workman.\n<\/p>\n<p>     3. Having heard learned counsel for the parties and having<\/p>\n<p>perused the impugned award and the judgment, we are of the<\/p>\n<p>view that, this Writ Appeal need not be kept pending on the files<\/p>\n<p>of this Court. In our view, the direction issued by the learned<\/p>\n<p>Single Judge does not call for any interference in the facts and<\/p>\n<p>circumstances of the case. However, certain observations made<\/p>\n<p>by the learned Single Judge with regard to the merit or otherwise<\/p>\n<p>of the case were not warranted. At the same time, the view<\/p>\n<p>WA No.2073 of 2009<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>expressed by the learned Single Judge that Tribunal ought to<\/p>\n<p>have adverted to the basic contentions of the parties and arrive<\/p>\n<p>at a finding only after independent consideration of those<\/p>\n<p>contentions appears to be eminently justified.<\/p>\n<p>     4. Therefore, while upholding the view taken by the learned<\/p>\n<p>Single Judge in remitting the matter to the Tribunal, we make it<\/p>\n<p>clear that the Tribunal shall not be swayed, influenced or<\/p>\n<p>trammelled by any of the observations made by the learned<\/p>\n<p>Single Judge while setting aside the award and directing the<\/p>\n<p>Tribunal to take a fresh decision in the matter. The Tribunal will<\/p>\n<p>be at liberty to take an independent decision untrammelled by<\/p>\n<p>any of the observations made by the learned Single Judge.<\/p>\n<p>     The Writ Appeal is disposed of in the above terms.<\/p>\n<p>                                          S.R.
