             In this case, the petitioner was posted as<\/p>\n
Bal    Vikas       Pariyojana          Adhikari,        Raipur       District<\/p>\n
Bhilwara.          At    that     time,         he    has   forwarded     an<\/p>\n
application moved by Smt. Anita Vijay with the report<\/p>\n
that   she     has      worked    as       Aanganwadi       worker    w.e.f.<\/p>\n
7.10.991 to 30.6.1992 but her form was rejected by<\/p>\n
Regional Dy. Director (Bal Vikas) on the ground that<\/p>\n
she has worked for preparing record only and as such<\/p>\n
she was not given any employment.\n<\/p>\n<\/p>\n
             The     petitioner         was      not    posted       in   the<\/p>\n
Education      Department        but       he   was    on   deputation    in<\/p>\n
Mahila & Bal Vikas Department and while working on the
\n                                              2<\/span><\/p>\n
post     of    Project           Officer,             he     has         forwarded           the<\/p>\n
application             of    Smt.        Anita       Vijay         –    wife          of    the<\/p>\n
petitioner himself.                  A charge-sheet was issued to the<\/p>\n
petitioner on 9.8.1993 and allegation was made which<\/p>\n

              The aforesaid charge-sheet was issued to the<\/p>\n
petitioner         under        Rule        16     of       the         CCA     Rules        and<\/p>\n
thereafter, enquiry was conducted and enquiry officer<\/p>\n
gave its finding against the petitioner and it was<\/p>\n
found    that           the     petitioner            is     guilty            of      alleged<\/p>\n
misconduct, which is punishable under the CCA Rules,<\/p>\n
for which major penalty is required to be inflicted.<\/p>\n
The     disciplinary             authority            after         considering              the
\n                                                  3<\/span><\/p>\n
       entire    enquiry         report      and      the      reply    filed        by    the<\/p>\n
       petitioner penalized the petitioner with penalty of<\/p>\n
       withholding         of    one     grade       increment        with    cumulative<\/p>\n
       effect vide order dated 25.3.2000.                             Against the said<\/p>\n
       order,    an    appeal          was   preferred           by    the    petitioner<\/p>\n
       before    the       Commissioner              and       Secretary,       Secondary<\/p>\n
       Education.          The     said      appeal        was       accepted       and    the<\/p>\n
       penalty   was       reduced        from       withholding         of   one      grade<\/p>\n
       increment without cumulative effect.                           Against the said<\/p>\n
       order,    the        petitioner           also          preferred        a     review<\/p>\n
       petition, which was also dismissed by the reviewing<\/p>\n
       authority vide order dated 21.9.2002<\/p>\n
                   I have perused the impugned orders passed by<\/p>\n
       disciplinary authority as well as appellate authority<\/p>\n
       and the order of reviewing authority.<\/p>\n
                   Looking to the seriousness of the misconduct<\/p>\n
       committed      by    the        petitioner,         I    am    not    inclined      to<\/p>\n
       interfere      in        this    matter.            Accordingly,         the       writ<\/p>\n
       petition is dismissed.\n<\/p>\n<\/p>\n
