Heard learned counsel for the petitioners, learned<\/p>\n<p>                    counsel for the State of Bihar and its authorities (Respondent nos. 1<\/p>\n<p>                    &amp; 2), learned counsel for respondent no. 3 and learned counsel for<\/p>\n<p>                    respondent nos. 4 to 8 (plaintiffs).\n<\/p>\n<p>                             2.       The petitioners were defendants -appellants in the<\/p>\n<p>                    court below whereas respondent nos. 3 to 8 were plaintiffs-<\/p>\n<p>                    respondents and hence, they are necessary parties for disposal of<\/p>\n<p>                    this writ petition.\n<\/p>\n<p>                             3.       This writ petition has been filed by the defendants-<\/p>\n<p>                    appellants-petitioners challenging order dated 12.08.2010 by which<\/p>\n<p>                    the Additional District Judge, Siwan rejected the application filed<\/p>\n<p>                    by them under the provision of Order 41 Rule 5 of the Code of<\/p>\n<p>                    Civil Procedure for stay of further proceeding of Execution Case<\/p>\n<p>                    No. 1 of 2004 pending in the court of Sub-ordinate Judge-V, Siwan<\/p>\n<p>                    till the disposal of Title Appeal No. 50 of 2003, which was pending<\/p>\n<p>                    before the aforesaid Additional District Judge, Siwan.<\/p>\n<p>                             4.       Learned counsel for the petitioners submits that<\/p>\n<p>                    the petitioners are residing in the suit premises along with their<\/p>\n<p>                    families and after the decree dated 23.09.2003 passed in Title Suit<\/p>\n<p>                    No. 148 of 1984 he filed Title Appeal No. 50 of 2003 which is<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>pending for hearing since long but is not being decided by the<\/p>\n<p>lower appellate court. He further argues that in the mean time<\/p>\n<p>Execution Case No. 1 of 2004 had been filed by the plaintiffs-<\/p>\n<p>decree holders before the Sub-ordinate Judge-V, Siwan. He further<\/p>\n<p>states that in the said circumstances, it was necessary for the lower<\/p>\n<p>appellate court to stay the proceeding of execution case.<\/p>\n<p>         5.      On the other hand, learned counsel for respondent<\/p>\n<p>no. 3 and learned counsel for respondent nos. 4 to 8-2nd           Set<\/p>\n<p>vehemently oppose the contentions of learned counsel for the<\/p>\n<p>petitioners and submit that petitioners&#8217; claim was absolutely<\/p>\n<p>frivolous and misconceived due to which the suit had been decided<\/p>\n<p>against them and the title appeal also has got no merit at all, hence,<\/p>\n<p>the court below rightly rejected the stay petition of the appellants-<\/p>\n<p>petitioners.\n<\/p>\n<p>         6.      Considering the entire facts and circumstances of<\/p>\n<p>this case, this court finds that admittedly, the appellants-petitioners<\/p>\n<p>are residing in the suit premises and for its delivery of possession<\/p>\n<p>against the petitioners, execution case has been lodged. This court<\/p>\n<p>also finds that title appeal is pending since 2003 although as<\/p>\n<p>claimed by the parties, it is ready for final hearing.<\/p>\n<p>         7.      In the said circumstances, the impugned order is<\/p>\n<p>set aside and this writ petition is disposed of with a direction to the<\/p>\n<p>1st Additional District Judge, Siwan to expedite the hearing of T.A.<\/p>\n<p>No. 50 of 2003 so that it may be decided without any further delay<\/p>\n<p>preferably within a period of two months from the date of<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>        receipt\/production of a copy of this order. Till the final disposal of<\/p>\n<p>        the aforesaid title appeal,   further proceeding of Execution Case<\/p>\n<p>        No. 1 of 2004 pending before the Subordinate Judge-V, Siwan<\/p>\n<p>        shall remain stayed.\n<\/p>\n<p>                 8.
