JUSTICE BIRENDRA PRASAD VERMA\n            ORAL ORDER<\/pre>\n<p>            (Per: HONOURABLE THE CHIEF JUSTICE)<br \/>\n<span class=\"hidden_text\"> 6         Patna High Court LPA No.944 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p>                                               6 \/ 11<\/p>\n<p>3.   08-07-2011                   These three Appeals preferred under Clause 10 of the<br \/>\n                   Letters Patent arise from the common order dated 27 th June 2011<br \/>\n                   made by the learned single Judge pending the above C.W.J.C. No.<br \/>\n                   8262 of 2011 and other writ petitions.\n<\/p>\n<p>                                 The subject matter of dispute is the admission to post<br \/>\n                   graduate medical courses granted by the Katihar Medical College<br \/>\n                   and    Mata      Gujri      Memorial       Medical   College,   Kishanganj<br \/>\n                   (hereinafter cumulitatively referred to as \u201ethe Colleges\u201f). Both the<br \/>\n                   aforesaid Colleges are admittedly non-government, non-grant-in-<br \/>\n                   aid, minority colleges. According to the Colleges, they being<br \/>\n                   minority, non-grant-in-aid colleges, they have exclusive right of<br \/>\n                   governance and admission to medical courses. In exercise of the<br \/>\n                   same they have granted admission to post graduate medical<br \/>\n                   courses on the basis of the result of the Post Graduate Medical<br \/>\n                   Entrance Test-2011 conducted by the Private Medical Colleges<br \/>\n                   Association, Bihar (hereinafter referred to as \u201ethe Association\u201f).<br \/>\n                   Such admissions were granted in the last week of April 2011.\n<\/p>\n<p>                                 The said admissions have been challenged by the<br \/>\n                   private respondents, the qualified Doctors, seeking admission to<br \/>\n                   post graduate medical courses pursuant to the result of the Post<br \/>\n                   Graduate Medical Admission Test-2011 conducted by the Bihar<br \/>\n                   Combined Entrance Competitive Examination Board, Government<br \/>\n                   of Bihar (hereinafter referred to as \u201ethe Examination Board\u201f).<br \/>\n                   According to the writ petitioners, they have successfully passed the<br \/>\n                   aforesaid admission test conducted by the Examination Board.<br \/>\n                   They have a right to admission to post graduate medical courses on<br \/>\n                   50% of the seats sanctioned by the Medical Council of India in the<br \/>\n                   non-government, non-grant-in-aid medical colleges.\n<\/p>\n<p>                                 The learned single Judge has, after hearing the parties,<br \/>\n<span class=\"hidden_text\"> 7   Patna High Court LPA No.944 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p>                                         7 \/ 11<\/p>\n<p>             pending the writ petitions held, &#8220;&#8230;.. till Regulation-9 of Medical<br \/>\n             Council of India is declared to be unconstitutional the private<br \/>\n             medical college of India do not have a right to resist admission<br \/>\n             under 50% State quota which has been provided for in the<br \/>\n             year 2009.&#8221; Consequently, the learned single Judge has directed<br \/>\n             the Colleges to refund the full fees to those students who have<br \/>\n             been admitted on 50% State quota. The Court further directed the<br \/>\n             Colleges, &#8220;to offer admission forthwith to all the petitioners<br \/>\n             who are before this Court up to 30th June 2011&#8221;.\n<\/p>\n<p>                            Feeling aggrieved by the aforesaid directions, the<br \/>\n             Katihar Medical College has preferred the above Letters Patent<br \/>\n             Appeal No.944 of 2011 and the Mata Gujri Memorial Medical<br \/>\n             College has preferred above Letters Patent Appeal No.945 of 2011.<br \/>\n             Letters Patent Appeal No.969 of 2011 is preferred by one of the<br \/>\n             post graduate students with the leave of this Court. He apprehends<br \/>\n             that in case above referred directions are permitted to be<br \/>\n             implemented his admission to DCP (Pathology) (a post graduate<br \/>\n             medical course) in Katihar Medical College may be cancelled.\n<\/p>\n<p>                           Learned counsel Mr. Y.V. Giri has appeared for the<br \/>\n             appellant Katihar Medical College. He has assailed the order of the<br \/>\n             learned single Judge on the basis of the observations made by the<br \/>\n             Hon\u201fble Supreme Court in the matter of <a href=\"\/doc\/279061\/\">T.M.A. Pai Foundation v.<br \/>\n             State of Karnataka,<\/a> [(2002) 8 SCC 481]. He has submitted that<br \/>\n             Article 15(5) of the Constitution read with Article 130 of the<br \/>\n             Constitution read with the observations made by the Hon\u201fble<br \/>\n             Supreme Court in the above referred matter of T.M.A. Pai<br \/>\n             Foundation followed by the Hon\u201fble Supreme Court in the matter<br \/>\n             of <a href=\"\/doc\/1390531\/\">P.A. Inamdar v. State of Maharashtra,<\/a> [(2005) 6 SCC 537];<br \/>\n             the Colleges are, being minority, non-government, non-grant-in-\n<\/p>\n<p><span class=\"hidden_text\"> 8   Patna High Court LPA No.944 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p>                                         8 \/ 11<\/p>\n<p>             aid institutions, fully empowered to control their administration<br \/>\n             and also admission to various courses offered by the Colleges. The<br \/>\n             State Government has no right to interfere in the said matters. Mr.<br \/>\n             Giri has particularly relied upon observations made in paragraphs<br \/>\n             45, 50, 55 and 68 of the judgment in the matter of T.M.A. Pai<br \/>\n             (supra) and paragraphs 109, 110, 121, 124, 129, 130, 132 and 134<br \/>\n             of the judgment in the matter of P.A. Inamdar (supra). He has also<br \/>\n             submitted that against the prospectus issued by the State<br \/>\n             Government incorporating 50% of the seats sanctioned for the<br \/>\n             Colleges      for    common admission test     conducted    by the<br \/>\n             Examination Board, the Colleges had lodged objection as early as<br \/>\n             on 3rd March 2011. The Colleges, therefore, cannot be compelled<br \/>\n             to give admission to the successful students of the common<br \/>\n             admission test conducted by the Examination Board.\n<\/p>\n<p>                           Learned advocate Mr. Basant Kumar Choudhary has<br \/>\n             appeared for the appellant Mata Gujri Memorial Medical College,<br \/>\n             Kishanganj, the appellant in Letters Patent Appeal No.945 of 2011.<br \/>\n             He has adopted the aforesaid arguments advanced by Mr. Giri.\n<\/p>\n<p>                           Learned advocate Mr. Abhinav Shrivastava has<br \/>\n             appeared for the appellant in Letters Patent Appeal No.969 of<br \/>\n             2011. He has submitted that if the impugned order made by the<br \/>\n             learned single Judge is sustained, some 20 students admitted to the<br \/>\n             post graduate medical courses in Katihar Medical College will lose<br \/>\n             their admission. It was, therefore, essential that such students were<br \/>\n             heard before the impugned order was made. The appellant, not<br \/>\n             being a party to the petition, his admission cannot be adversely<br \/>\n             affected by the impugned order.\n<\/p>\n<p>                           The appeals are contested by the learned Government<br \/>\n             advocate Mr. R.K.Choubey and the learned Additional Advocate<br \/>\n<span class=\"hidden_text\"> 9   Patna High Court LPA No.944 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p>                                         9 \/ 11<\/p>\n<p>             General Mr. Lalit Kishore appearing for the State of Bihar and by<br \/>\n             Mr. Rajendra Prasad Singh appearing for the writ petitioners.<br \/>\n             Reliance is placed on Regulation-9 of the Medical Council of India<br \/>\n             Postgraduate Medical Education Regulations, 2000. It is submitted<br \/>\n             that proviso to Regulation-9 of the said Regulations specifically<br \/>\n             provides,      &#8220;Provided        further        that   in   non-Governmental<br \/>\n             institutions fifty per cent of the total seats shall be filled by the<br \/>\n             Competent Authority notified by the State Government and<br \/>\n             the remaining fifty per cent by the management(s) of the<br \/>\n             institution on the basis of Inter-se Academic Merit.&#8221;\n<\/p>\n<p>                           The aforesaid regulations have been framed by the<br \/>\n             Medical Council of India in exercise of power conferred by<br \/>\n             Section 33 read with Section 20 of the Indian Medical Council<br \/>\n             Act, 1956 with the previous sanction of the Central Government.<br \/>\n             The said Regulations, unless held to be ultra vires by a Court of<br \/>\n             law, are binding. All non-Government medical colleges are bound<br \/>\n             by the said Regulations. It is not in dispute that the constitutional<br \/>\n             validity of the aforesaid proviso to Regulation-9 of the Regulations<br \/>\n             is the subject matter of challenge before the Hon\u201fble Supreme<br \/>\n             Court in the Writ Petition (Civil) No. 584 of 2009 filed by the<br \/>\n             appellant Katihar Medical College under Article 32 of the<br \/>\n             Constitution. Pending the said writ petition the Hon\u201fble Court has,<br \/>\n             on 14th May 2011 made order as under:\n<\/p>\n<blockquote><p>                     &#8220;As the State is in the process of sending<br \/>\n                     candidates for the 50% seats and in fact, has<br \/>\n                     already sent 8 students, interim relief is rejected.<br \/>\n                     However, admission of the students sent by the<br \/>\n                     State Government will be without prejudice to the<br \/>\n                     contentions of the petitioner and therefore will not<br \/>\n<span class=\"hidden_text\"> 10   Patna High Court LPA No.944 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p>                                          10 \/ 11<\/p>\n<p>                      be a precedent for the future.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                            It is thus evident that though the Hon\u201fble Court has<br \/>\n              said that the above order shall not be a precedent, the Court has not<br \/>\n              granted stay against the operation of the aforesaid proviso to<br \/>\n              Regulation-9 of the Regulations. It cannot be gainsaid that the<br \/>\n              State Government issued the prospectus for post graduate medical<br \/>\n              admission test 2011 as early as on 11th December 2010. In the said<br \/>\n              prospectus half of the seats sanctioned for the Colleges have also<br \/>\n              been included in total number of the seats available for admission.\n<\/p><\/blockquote>\n<p>              Nevertheless, the Colleges did not take any action until the month<br \/>\n              of March 2011. Even then the Colleges thought it fit not to go<br \/>\n              further than lodging objection. In our view, it is apparent that<br \/>\n              lodging of the objection in the month of March 2011 was a mere<br \/>\n              formality followed with a view to saving the admissions that the<br \/>\n              Colleges intended to make in the month of April 2011.\n<\/p>\n<p>                            In the above circumstances, we dismiss these appeals<br \/>\n              for the reasons:- (i) The order impugned is an interim order made<br \/>\n              pending the writ petitions; (ii) The Regulations framed by the<br \/>\n              Medical Council of India are statutory in nature and are binding to<br \/>\n              the appellant Colleges as well; and (iii) While granting admissions<br \/>\n              to the students on the basis of the competitive examination<br \/>\n              conducted by the Association the appellant Colleges were fully<br \/>\n              conscious of their obligation to spare half of the seats for<br \/>\n              admission from amongst the students passing the common<br \/>\n              admission test conducted by the Examination Board.\n<\/p>\n<p>                            As to the Letters Patent Appeal No.969 of 2011, the<br \/>\n              appellant merely apprehends that the axe may fall on his admission<br \/>\n              if the impugned order is permitted to be implemented. At the<br \/>\n              moment the admissions have not yet been worked out.
