Respondents \/ Respondents.\n                                          -----------\n<\/pre>\n<p>7.            03.12.2010                  Having heard learned counsel for the parties,<\/p>\n<p>                               this Court is of the considered opinion that even if the<\/p>\n<p>                               appointment of the appellant-writ petitioner was made on<\/p>\n<p>                               a contractual basis for a period of 11 months and the<\/p>\n<p>                               respondents had reserved the right of granting further<\/p>\n<p>                               extension only after being satisfied with regard to her<\/p>\n<p>                               performance duty, if her such renewal of contract was<\/p>\n<p>                               denied on the ground of any allegation, she ought to have<\/p>\n<p>                               been subjected to a show-cause notice followed by an<\/p>\n<p>                               enquiry and an order. Apparently, such procedure was<\/p>\n<p>                               never followed and even if the averments made in<\/p>\n<p>                               counter affidavit in this appeal is taken into account, all<\/p>\n<p>                               that would emerges is that some sort of general hearing<\/p>\n<p>                               was going on in which the appellant-writ petitioner along<\/p>\n<p>                               with others was also asked to participate. Such procedure<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>of hearing cannot be held to be the compliance of the<\/p>\n<p>principles of natural justice and to that extent we also<\/p>\n<p>agree with the learned counsel for the appellant-writ<\/p>\n<p>petitioner that in view of the certificate issued by the<\/p>\n<p>District Superintendent of Education recording that the<\/p>\n<p>appellant-writ petitioner had satisfactory tenure of<\/p>\n<p>service, there would be hardly any occasion to believe<\/p>\n<p>that the past performance of the writ petitioner was<\/p>\n<p>unsatisfactory.\n<\/p>\n<p>            The question, however, would be that even after<\/p>\n<p>the writ petitioner was made aware of her term being not<\/p>\n<p>extended and her replacement by one Amarendra Das, she did<\/p>\n<p>not choose to implead Amarendra Das as a party in the<\/p>\n<p>connected writ petition and today after almost one and a half<\/p>\n<p>years of his continuation in service, we would not like to<\/p>\n<p>disturb such appointment of Amarendra Das only on the<\/p>\n<p>ground of violation of principles of natural justice.<\/p>\n<p>            Learned    counsel    for    the   respondent-State,<\/p>\n<p>however, taking into account that the appellant-writ petitioner<\/p>\n<p>was not given any opportunity to defend herself, has fairly<\/p>\n<p>agreed that the non-renewal of the contractual service of the<\/p>\n<p>appellant-writ petitioner will not be treated as a proof of her<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>                 unsatisfactory service and in fact her such non-renewal<\/p>\n<p>                will not be taken to be stigma for her future employment<\/p>\n<p>                in any other service. We believe that learned counsel for<\/p>\n<p>                the State has very fairly agreed to this aspect because the<\/p>\n<p>                District Superintendent of Education has also given<\/p>\n<p>                certificate with regard to satisfactory working of the<\/p>\n<p>                petitioner in the entire period of 11 months between<\/p>\n<p>                1.8.2007 to 30.5.2008.\n<\/p>\n<p>                           We would therefore dispose of this appeal<\/p>\n<p>                with a finding that non-renewal of the contract of the<\/p>\n<p>                appellant-writ petitioner will not stand in her way in<\/p>\n<p>                obtaining any future employment.\n<\/p>\n<p>                           With the aforementioned observation, this<\/p>\n<p>                appeal is disposed of.\n<\/p>\n<\/p>\n<p>                                                  (T.
