DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 99 of 2005 with Sayla Police Station,  for the offences<br \/>\n\tpunishable under Sections 365, 368, 385, 506(2), 323, 120(B) etc. of<br \/>\n\tthe Indian Penal Code.\n<\/p>\n<p>Mr<br \/>\n\tSV Raju, learned Senior Advocate appearing for the applicant submits<br \/>\n\tthat allegations against the applicants are to the extent he is<br \/>\n\tinvolved in the crime punishable under sections 365, 368, 385,<br \/>\n\t506(2), 120-B of IPC.  So far as other accused are concerned, charge<br \/>\n\tsheet was filed on 21.03.2006 wherein the applicant is shown as<br \/>\n\tabsconder.  It is further submitted that as per the allegations, the<br \/>\n\tapplicant was found near the guest house and considering the nature<br \/>\n\tof punishment, the applicant cannot be denied bail only on the<br \/>\n\tground that his name is shown in Column No.2 of the charge sheet.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tKartik Pandya, learned APP would submit that if the applicant is<br \/>\n\tenlarged on bail, the applicant is likely to commit similar offences<br \/>\n\tand that he has not surrendered before the Investigating Agency<br \/>\n\titself is sufficient to deny bail.  He further submits that<br \/>\n\tconsidering the record, prima facie material and allegations<br \/>\n\tlevelled against the applicant, bail may not be granted to the<br \/>\n\tapplicant only on the sole ground that he had not surrendered in<br \/>\n\ttime.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and considering the nature of allegations, role attributed to<br \/>\n\tthe accused and punishment prescribed for the alleged offences, I am<br \/>\n\tinclined to enlarge the applicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 99 of 2005<br \/>\n\twith Sayla Police Station on executing a bond of Rs.5,000\/- (Rupees<br \/>\n\tFive thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. till the trial is<br \/>\n\tcommenced;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
