2. Case of the petitioner is that. Goreoration initiated enquiry
\nereceedinge by issuing article of charges dated 11.3.2004. in
\ncharges were alleged against the pe\ufb01lzioner and in this  ”
\nhas aise submitted his repiy. The Enquiry Officer by his  ”
\ndated 33.23.2005 held that, charge Nes.1 and:2″er”e 4;=qollarifa_tiei;.T6f”‘the
\nworkman. passed an order of ;2;;r1iehrrgentVVV:.ir;!ereiia heldiha  the
\npetitioner is guilty of misconduci 6? eat  order of High
\nCourt in time and has ceased   ii\ufb01ecordingly. the
\nQieciplinary Aut\u00e9worily.     eztrliehiteent. reduced one
\nincrement for the   effect and also
\ndirxted for reeoverir j salary of the petitioner.\n<\/p>\n

Petitioner has immediately ciear the fife and directed for impiementetiors<\/p>\n
of the order. it is in the Divisional Controllers of\ufb02ce, the file was lying<\/p>\n
and the deiey is on the part of the officials of the Divisional Con’eoiler’s
\noffice. He also submitted mat. the enquiry was ini\ufb01ated against <\/p>\n
the staff for deiaying \ufb02ue marker and they were punished. He  ”
\nthat. bo\ufb01i the Enquiry Officer have not considered  T’ 1 H
\noffered by the petitioner and so also are Appeiileiehsiiierityi   <\/p>\n
error in con\ufb01rming the order of punishment.\n<\/p>\n
4. Learned counsel appearing  reeoonderji ‘i.’}orooreiion
\nsubmitted that, it was the duty of  ‘see tiwiavtuiihe orders
\nof the Court are ireplemented. Thekiolei
\nof\ufb01ce and the Law   not make any
\nenquiry. it is alleged  resgierisiiqlefe\ufb02derelic\ufb01on of duties and
\nhas caused lees’ to \ufb01tii’i’-ereeard. he referred to the
\n\ufb01ndings of  out mat the Law Oi\ufb01cer has
\nadmitted mat he siege: rlareenm from 14.11.1997 rm 1.4.1998
\naridtill  he did Vno’:.Vrriel_re:any enquiry. The Enquiry Officer has
\nfound      the Law Officer to ensure that the erders of<\/p>\n

part of the Law Of\ufb01cer who did not effectively impiement the orders of
\nme Court. In my opinion, the Enquiry Oi\ufb01cer has rightly found that the
\ncharge N051 and 2 are proved. The \ufb01iscipiinary Authority as weH__as<\/p>\n
the Appeliate Au\ufb02zority have considered this matter and heft! that <\/p>\n
charges are proved. Ne doubt the petitioner has cieared me _\ufb01’\u00a7\u00e9;’   <\/p>\n
failed to impfement the order of the Coutt. His duty cannct..eA h\ufb01’.!VV asr\u00e9iy by { %  ~  <\/p>\n
approving, but he is afso required to see that  of\ufb01i\u00e9rs  I.\n<\/p>\n
properly implemented. in the circumstances;—J \ufb01nd ngi-“.’.re:a’s\u00e9n ‘ifs. V’<\/p>\n
