For that, specific averment made in Para.3 and 4 of<br \/>\naffidavit-in-reply (page-60), is quoted as under :\n<\/p>\n<p>&#8220;3.\tI<br \/>\nsay that following the decision of this Hon&#8217;ble Court in the case of<br \/>\nPrabhudas R. Nimavat v. State of Gujarat &#8211; SCA No.1696\/1996 and<br \/>\nthe subsequent decision in case of <a href=\"\/doc\/1307950\/\">Jani Popatlal Vasanji v. State of<br \/>\nGujarat &amp; Ors.<\/a> &#8211; SCA No.6992\/2002, the Government has decided to<br \/>\ncount the entire length of service of the husband of the petitioner<br \/>\nfrom the date of his initial appointment in Sarvodaya Scheme till his<br \/>\ndeath for the purpose of calculating pension. Thus, it has been<br \/>\ndecided to grant pension tot he petitioner counting the service of<br \/>\nher husband from 1.2.1080.\n<\/p>\n<p>4.\tI<br \/>\nsay that it has also been decided to grant pay and allowances to the<br \/>\npetitioner for the period between 1.9.1981 i.e. the date on which the<br \/>\nhusband of the petitioner was absorbed in the ex-cadre post under the<br \/>\nPanchayat as peon. The prayer of the petitioner for grant of pay and<br \/>\nallowances from the date her husband was appointed in Sarvodaya<br \/>\nScheme has been rejected as such prayer is not in consonance with the<br \/>\ndeclared policy of the Government.&#8221;\n<\/p>\n<p>3.\tIn<br \/>\nview of aforesaid averments made in affidavit-in-reply, learned<br \/>\nadvocate Mr.Vora appearing on behalf of petitioner is not disputing<br \/>\nsuch payments made by respondents to petitioner. But he wants details<br \/>\nof break up from respondents.\n<\/p>\n<p>4.\tTherefore,<br \/>\nit is directed to respondent No.2 to give break up details to<br \/>\npetitioner in respect to whatever payments made by respondents to<br \/>\npetitioner. Therefore, let DDO may supply such details to petitioner<br \/>\nwithin a period of one month from date of receiving copy of present<br \/>\norder.
