The impugned order dated 12.6.2000 reads as<\/p>\n<p>under:-\n<\/p>\n<blockquote><p>       &#8220;Heard learned counsel for the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>       The petitioner has challenged the order dated<br \/>\n       28.3.2000, wherein it has been shown that he has not<br \/>\n       been able to fulfill the conditions of appointment,<br \/>\n       namely that he should have acquired requisite<br \/>\n       typing\/shorthand speed as early as possible. Since the<br \/>\n       petitioner was on temporary service, which was to be<br \/>\n       regularized only upon his fulfilling the conditions<br \/>\n       contained in the appointment letter and he having not<br \/>\n<span class=\"hidden_text\">LPA 350\/2000                                     Page 1 of 4<\/span><br \/>\n       fulfilled the same, he has been issued a notice dated<br \/>\n      28.3.2000, which he challenges.\n<\/p><\/blockquote>\n<blockquote><p>      I find no infirmity in the impugned notice.\n<\/p><\/blockquote>\n<blockquote><p>      Dismissed.&#8221;\n<\/p><\/blockquote>\n<p>2.             On 30.12.1997, a letter of appointment offering the<\/p>\n<p>post of SI (Steno) was issued by the DIG CRPF clearly<\/p>\n<p>indicating that the post offered to the appellant was on purely<\/p>\n<p>temporary capacity.       Vide clause-vii of the said letter it was<\/p>\n<p>informed to the appellant:\n<\/p>\n<blockquote><p>      &#8220;You must acquire requisite typing\/shorthand speed as<br \/>\n      early as possible. You will not be allowed to draw<br \/>\n      increment or considered for confirmation\/promotion to<br \/>\n      next unless you obtain the requisite typing\/shorthand<br \/>\n      speed.&#8221;\n<\/p><\/blockquote>\n<p>3.             It is apparent that the confirmation of the appellant<\/p>\n<p>was contingent upon obtaining the requisite typing\/shorthand<\/p>\n<p>speed. Thus, it can be said that till confirmed, the status of<\/p>\n<p>the appellant was akin to a probationer.<\/p>\n<p>4.             On 28.3.2000, the services of the appellant were<\/p>\n<p>discontinued      informing   him   that   after   one       month   his<\/p>\n<p>employment would cease.\n<\/p>\n<p>5.             The reason thereof is that the appellant failed to<\/p>\n<p>attain the requisite typing\/shorthand speed.<\/p>\n<p>6.             It has been urged by learned counsel for the<\/p>\n<p>appellant that the impugned order dated 28.3.2000 has been<\/p>\n<p><span class=\"hidden_text\">LPA 350\/2000                                   Page 2 of 4<\/span><br \/>\n passed after two years of employment and thus the appellant<\/p>\n<p>has to be treated as a confirmed employee.<\/p>\n<p>7.             What is the basis of the said submission has<\/p>\n<p>remained a mystery.\n<\/p>\n<p>8.             It is settled law that unless the rule prescribes to<\/p>\n<p>the contrary a person appointed on probation or on a<\/p>\n<p>temporary       basis   cannot   claim   permanency      upon   being<\/p>\n<p>continued in service beyond the initial prescribed period of<\/p>\n<p>probation or temporary engagement.\n<\/p>\n<p>9.             It is next urged that the employer sent the<\/p>\n<p>appellant for duty to Manipur where business was not being<\/p>\n<p>transacted in Hindi and thus the appellant could not acquire<\/p>\n<p>skill in shorthand\/typing in Hindi. It is urged that a test was<\/p>\n<p>held on 7.1.2000 to test the proficiency of the persons<\/p>\n<p>appointed as Steno-Typist in which the appellant failed.<\/p>\n<p>Attributing the reason of failure to the respondents it is urged<\/p>\n<p>that in terms of the circular dated October 1998 it was the<\/p>\n<p>duty of the respondents to impart at least six months training<\/p>\n<p>to the appellant.\n<\/p>\n<p>10.            It may be noted that the appellant has done his<\/p>\n<p>schooling in Hindi medium and would be expected to be<\/p>\n<p>proficient in Hindi. As regards the circular dated October 1998<\/p>\n<p>which is annexed as Annexure P-10 it simply states that job<\/p>\n<p><span class=\"hidden_text\">LPA 350\/2000                                   Page 3 of 4<\/span><br \/>\n training for six months under the direct supervision of the<\/p>\n<p>head of office be imparted. The circular does not require the<\/p>\n<p>candidates to be sent to any training institutes. The circular<\/p>\n<p>only requires that the candidate should be under the direct<\/p>\n<p>supervision of the head of office. Further, the said circular is<\/p>\n<p>not general in nature but is addressed to the Commandant<\/p>\n<p>92nd Bn. CRPF at Varanasi.\n<\/p>\n<p>11.            Thus, we find no scope to grant any benefit to the<\/p>\n<p>appellant and concur with the view taken by the learned Single<\/p>\n<p>Judge.\n<\/p>\n<p>12.
