Ramachandran, J:\n<\/p>\n
       This is an appeal filed at the instance of a victim of a road<\/p>\n
traffic accident.     At the time of accident she was travelling in a<\/p>\n
vehicle,   bearing   registration   No.KED   5353,   which   had   been<\/p>\n
insured with the United India Insurance Company  Limited.   The<\/p>\n
Tribunal had found that the accident was caused because of the<\/p>\n
negligent   driving   of   the   vehicle   and     she   is   to   be   adequately<\/p>\n
compensated.  However, in the matter of assessing the disability,<\/p>\n
as   highlighted   in   the   appeal,   perhaps   the   Tribunal   was   highly<\/p>\n
conservative.     The   injuries   sustained   by   the   appellant,   as   could<\/p>\n
be gatherable from the order, are extracted herein below:\n<\/p>\n
                   “The injuries allegedly sustained by the<\/p>\n
            petitioner   are   lacerated   injury   5   x   3   cm<\/p>\n
            lateral   aspect   of   right   eye,   fracture   right<\/p>\n
            maxilla,   fracture   right   zygomatic   arch,<\/p>\n
            haemorragic   contusion   right   front   parietal<\/p>\n
            region,        cerebral   oedema,   facial   palsy,<\/p>\n
            haematyn   parietal   ptosis   right   eye,   fracture<\/p>\n
            posterea   lateral   longwall   of   right   antrium,<\/p>\n
            fracture   zygomatic   arch   right,   fracture<\/p>\n
            lateral orbital bonywall right, fracture frontal<\/p>\n
            bone   right   involving   the   anterior   frontal<\/p>\n
            supra   orbital   and   lateral   frontal   area,<\/p>\n
            fracture,   greater   wind   of   sphenoid   right,<\/p>\n

             small   focal   intra   cerebral   haematoma   in   the<\/p>\n
             basal   part   of   the   right   fonto   temporal   lobe,<\/p>\n
             mild   sub   arachnoid   blood   at   the   level   of   the<\/p>\n
             right   sylvial   fisure   and   sulci   in   the   right<\/p>\n
             hemisphere, mild cerebral oedema.  In order to<\/p>\n
             prove   the   injuries   the   petitioner   has   given<\/p>\n
             evidence   as   P.W1   and   Ext.A1   to   A10   and   X1<\/p>\n
             marked.   PW.1 has given evidence to fact that<\/p>\n
             she   sustained   fracture   on   the   right   hand   and<\/p>\n
             shoulder.  She has also sustained head injury.”<\/p><\/blockquote>\n
       2.      The   medical   attendant   had   assessed   the   disability   at<\/p>\n
20%,   which   according   to   the   Tribunal,   was   on   the   excessive   side<\/p>\n
and was not acceptable, and according to the Tribunal, 10% would<\/p>\n
have been more safe and reasonable.\n<\/p>\n
       3.      We   can   hardly   agree   with   the   above.     Of   course,   the<\/p>\n
learned counsel for the 3rd  and 6th  respondents submits that being<\/p>\n
a   house   wife   and   practically   she   does   not   earn   income,   the<\/p>\n
compensation   awarded   was   equitable   by   all   standards   and   the<\/p>\n
assessment   by   the   Tribunal   in   respect   of   the   disablement   should<\/p>\n
not   have   been   upset   in   these   proceedings.     But,   as   referred   to<\/p>\n
earlier,   the   accident   has   wrecked   her   person.     Compensation   for<\/p>\n
disfiguration,   hospitalisation   was   inadequate.         Disablement   as<\/p>\n
certified   by   the   doctor   should   have   led   to   a   better   and   fair<\/p>\n
compensation.\n<\/p>\n
       4.      Taking   notice   of   the   totality   of   the   circumstances,   we<\/p>\n
direct that in the matter of item No.4 of paragraph 9 of the award,<\/p>\n
[MFA No.206 of 2001]<\/p>\n

treatment and medical expenses to be awarded  should be refixed<\/p>\n
at Rs.7,500\/-.  Compensation figure for disfiguration (item No.5) is<\/p>\n
to be substituted as Rs.20,000\/-.  Compensation for disability  (item<\/p>\n
No.6) is fixed astRs.40,800\/-.\n<\/p>\n
        5.     Thus,   the   additional   compensation   payable,   over   and<\/p>\n
above   what   has   been   awarded,   should   be   arrived   at   Rs.41,400\/-.\n<\/p>\n
The interest on this additional amount of compensation will be 6%<\/p>\n
from the date of award till realisation.\n<\/p>\n
        6.     The   award   in   O.P.(MV).No.1849   of   1995   will   stand<\/p>\n
modified to this extent.  The appeal is disposed of as above.\n<\/p>\n
