NAGESH FOR ORIGINAL\nCOMPLAINANT \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\nDate : 25\/10\/2010\n \n \nORAL ORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicant for grant of<br \/>\n\tregular bail under section 439 of Code of Criminal Procedure, 1973.\n<\/p>\n<p>The<br \/>\n\tapplicant is charged with having committed offence sections 363,<br \/>\n\t376, 506(1) and 114 of Indian Penal Code for which F.I.R. being<br \/>\n\tI-C.R.No.45 of 2010 has been registered with Fatepura Police<br \/>\n\tStation.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Kharadi for the applicant accused submitted that it is a<br \/>\n\tcase of consent and the allegation with regard to manner in which<br \/>\n\toffences is alleged to have been committed, may not be believed as<br \/>\n\tthe victim is a woman aged about 21 years and she is said to have<br \/>\n\tbeen kidnapped from bus-stand where there will be presence of number<br \/>\n\tof persons. Further, he referred to the details with regard to<br \/>\n\tmoving from one place to another place and submitted that present<br \/>\n\tapplication may be considered in the facts and circumstances.\n<\/p>\n<p>Ms.Manisha<br \/>\n\tL.Shah, learned Additional Public Prosecutor resisted the<br \/>\n\tapplication and submitted that applicant is also married.\n<\/p>\n<p>Mr.Nagesh,<br \/>\n\tlearned advocate for original complainant submitted the affidavit of<br \/>\n\tcomplainant.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate Mr.Kharadi for the applicant, learned APP<br \/>\n\tMs.Shah and learned advocate Mr.Nagesh for the complainant and<br \/>\n\thaving perused the papers also and considering the nature of<br \/>\n\toffence, manner in which it is alleged to have been committed<br \/>\n\tparticularly considering the averments regarding the age of the<br \/>\n\tvictim and as stated in her own affidavit, when she has been taken<br \/>\n\ton motorcycle, without any further elaboration, present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.45 of 2010 has<br \/>\n\tbeen registered with Fatepura Police Station on his executing bond<br \/>\n\tof Rs.5,000\/- (Rupees Five Thousand) with one solvent surety of the<br \/>\n\tlike amount to the satisfaction of the lower Court and subject to<br \/>\n\tthe conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof English calender month between 11:00 AM to 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
