SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent application has been preferred by the applicant-original<br \/>\nappellant for an appropriate order of initiating appropriate<br \/>\nproceedings against opponents  nos. 2, 3 and 4 under Order XXXIX Rule<br \/>\n2A  read with  Section 151 of the Code of Civil Procedure and,<br \/>\nthereupon, to detain opponents nos. 2, 3 and 4 in civil prison for<br \/>\nthe period contemplated under the provisions contained in  Order<br \/>\nXXXIX and Rule 2A and to direct opponents nos. 2 to 4 to maintain<br \/>\nstatus-quo ante  with respect to the suit land as it was prevailing<br \/>\nas on date of passing the order by this Court dated 07\/08\/2008 passed<br \/>\nin Appeal  from Order No. 152\/2007 with Civil Application No.<br \/>\n5604\/2007.\n<\/p>\n<p>2.\tShri<br \/>\nD.C. Dave, learned advocate appearing on behalf of the<br \/>\napplicant-original appellant has placed on record<br \/>\naffidavit-in-rejoinder of the applicant-original appellant dated<br \/>\n09\/07\/2010 seeking permission of the Court to enter into settlement<br \/>\nwith opponents nos. 3 and 4 as opponents nos. 3 and 4 have agreed to<br \/>\ncompensate the applicant-original appellant by paying an amount of<br \/>\nRs. 30 lakhs in lieu of the disputed land in question i.e. part of<br \/>\nSurvey No. 399 of village Makarba admeasuring 2508 sq meters of land,<br \/>\nthe reference of which is made in paragraph 4(C) of the said<br \/>\nrejoinder.  He has also further submitted that on grant of necessary<br \/>\npermission by this Court, opponents nos. 3 and 4 shall pay an amount<br \/>\nof Rs. 30 lakhs by way of an account payee cheque and on realizing<br \/>\nthe amount, the applicant-original appellant shall submit an<br \/>\nappropriate application before the learned trial Court to delete the<br \/>\naforesaid land from the proceedings of the original suit, and,<br \/>\ntherefore, it is requested to grant necessary permission to the<br \/>\napplicant-original appellant in the peculiar facts and circumstances<br \/>\nof the case as the applicant-original appellant is now to be<br \/>\ncompensated as stated hereinabove.\n<\/p>\n<p>3.\tShri<br \/>\nTatvam Patel, learned advocate appearing on behalf of opponents nos.<br \/>\n3 and 4 has stated at the bar that without further entering into the<br \/>\nmerits of the application and\/or the allegation, opponents  nos. 3<br \/>\nand 4 has tendered unconditional apology and it is requested to<br \/>\naccept the unconditional apology and grant permission as prayed for<br \/>\non payment of cost, which may be quantified by this Court.  It is<br \/>\nfurther submitted that on grant of permission as prayed for,<br \/>\nopponents nos. 3 and 4 will be giving three cheques of Rs. 10 lakhs<br \/>\neach, total amounting to Rs. 30 lakhs, which  shall be realized and<br \/>\nencashed as soon as the same are deposited with the Bank.  He has<br \/>\nalso requested to issue appropriate direction to the<br \/>\napplicant-original appellant to submit an appropriate application<br \/>\nbefore the learned trial Court, on realization of the aforesaid three<br \/>\ncheques total amounting to  Rs. 30 lakhs.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the affidavit-in-rejoinder of the applicant<br \/>\ndated 09\/07\/2010 and in the peculiar facts and circumstances of the<br \/>\ncase and as opponents nos. 3 and 4 have tendered their unconditional<br \/>\napology at the outset and they are ready and willing to compensate by<br \/>\npaying the cost, which may be quantified by this Court, the<br \/>\nunconditional apology tendered by opponents nos. 3 and 4 is hereby<br \/>\naccepted and the applicant-original appellant is permitted to enter<br \/>\ninto the settlement with opponents nos. 3 and 4 and accept Rs. 30<br \/>\nlakhs in lieu of the disputed land, reference of which is made<br \/>\nhereinabove.  The learned advocate appearing on behalf of opponents<br \/>\nnos. 3 and 4 has paid three cheques dated 08\/07\/2010 bearing nos.<br \/>\n178489, 178714, 178882 of Rs. 10 lakhs each (total amounting to Rs.<br \/>\n30 lakhs), drawn on Bank of India, S.G. Highway Branch, Ahmedabad.\n<\/p>\n<p>5.\tShri<br \/>\nTatvam Patel, learned advocate appearing on behalf of opponents nos.<br \/>\n3 and 4 has stated at the bar that the amount shall be realized and<br \/>\nencashed as soon as it is deposited with the Bank.  On realization of<br \/>\nthe aforesaid amount, the applicant-original appellant shall act as<br \/>\nper the affidavit-in-rejoinder dated 09\/07\/2010 and submit an<br \/>\nappropriate application before the learned trial Court for deleting<br \/>\nthe aforesaid land from the proceedings pending before the learned<br \/>\ntrial Court and the learned trial Court to pass an appropriate order<br \/>\non the said application.\n<\/p>\n<p>6.\tOpponents<br \/>\nnos. 3 and 4 are hereby directed to pay the cost, which is quantified<br \/>\nat Rs. 25,000\/-  to be deposited by opponents nos. 3 and 4 within a<br \/>\nperiod of two weeks from today with the Registry of this Court.
