No. M-2841 of 2009 (O&amp;M)\n                         Date of Decision: January 30 , 2009\n\n\nHarjinder Kaur                                       ...........Petitioner\n\n                         Versus\n\n\n\nState of Punjab and others                           ..........Respondents\n\n\nCoram:         Hon'ble Mrs.Justice Sabina\n\nPresent:      Mr. Sukhjit Singh, Advocate for the petitioner.\n             Mr.Amandeep Singh Rai, AAG Punjab\n                  **\n\nSabina, J.\n<\/pre>\n<p>               Petitioner has filed this petition under Section 482 of the<\/p>\n<p>Code of Criminal Procedure for a direction to respondent No.3 to take<\/p>\n<p>action on the representation made by the petitioner or with a prayer for<\/p>\n<p>direction to respondent No.3 to register an FIR against respondents No. 4 to<\/p>\n<p>12 under appropriate Sections.\n<\/p>\n<p>               It has been held by the Apex Court in <a href=\"\/doc\/1836621\/\">Sakiri Vasu vs. State<\/p>\n<p>of U.P. and others<\/a>, 2008 (1) RCR (Criminal) 392 as under:-<\/p>\n<blockquote><p>           &#8220;24. In view of the above mentioned legal position, we are of the<\/p>\n<p>           view that although Section 156(3) is very briefly worded, there is<\/p>\n<p>           an implied power in the Magistrate under Section 156(3) Cr.P.C.<\/p><\/blockquote>\n<p>           to order registration of a criminal offence and\/or to direct the<\/p>\n<p>           officer in charge of the concerned police station to hold a proper<\/p>\n<p>           investigation and take all such necessary steps that may be<\/p>\n<p>           necessary   for   ensuring   a   proper    investigation          including<\/p>\n<p>           monitoring the same. Even though these powers have not been<\/p>\n<p>           expressly mentioned in Section 156(3) Cr.P.C., we are of              the<br \/>\n<span class=\"hidden_text\"> Crl. Misc. No. M-2841 of 2009                -2-<\/span><\/p>\n<p>opinion that they are implied in the above provision.<\/p>\n<p>25.We have elaborated on the above matter because we often find<\/p>\n<p>that when some one has a grievance that his FIR has not been<\/p>\n<p>registered at the police station and\/or a proper investigation is not<\/p>\n<p>being done by the police, he rushes to the High Court to file a writ<\/p>\n<p>petition or a petition under Section 482 Cr.P.C. We are of the<\/p>\n<p>opinion that the High Court should not encourage this practice<\/p>\n<p>and should ordinarily refuse to interfere in such matters, and<\/p>\n<p>relegate the petitioner to his alternating remedy, firstly under<\/p>\n<p>Section 154 (3) and Section 36 Cr.P.C. before the concerned<\/p>\n<p>police officers and if that is of no avail, by approaching the<\/p>\n<p>concerned Magistrate under Section 156 (3).<\/p>\n<p>26.   If a person has a grievance that his FIR has not been<\/p>\n<p>registered by the police station his first remedy is to approach the<\/p>\n<p>Superintendent of Police under Section 154 (3) Cr.P.C. or other<\/p>\n<p>police officer referred to in Section 36 Cr.P.C.          If despite<\/p>\n<p>approaching the Superintendent of Police or the officer referred to<\/p>\n<p>in Section 36 his grievance still persists, then he can approach a<\/p>\n<p>Magistrate under Section 156(3) Cr.P.C. Instead of rushing to the<\/p>\n<p>High Court by way of a writ petition or a petition under Section<\/p>\n<p>482 Cr.P.C.     Moreover, he has a further remedy of filing a<\/p>\n<p>criminal complaint under Section 200 Cr.P.C. Why then should<\/p>\n<p>writ petitions or Section 482 petitions be entertained when there<\/p>\n<p>are so many alternative remedies?&#8221;\n<\/p>\n<p>      Accordingly, this petition is dismissed. However, petitioner,<br \/>\n<span class=\"hidden_text\"> Crl. Misc.
