Bhagalpur University, Bhagalpur.\n                                               ----------Respondents\n                              ----------\n<\/pre>\n<p>2       09.08.2010              Heard    learned       counsel       for     the<\/p>\n<p>                     petitioner and counsel for the University as<\/p>\n<p>                     also counsel for the State in both the cases.<\/p>\n<p>                                The prayer of the petitioner in both<\/p>\n<p>                     the writ applications, being similar, reads<\/p>\n<p>                     as follows:-\n<\/p>\n<blockquote><p>                          &#8220;1.    That this is an application for the<br \/>\n                                 issuance    of   an   appropriate    writ,<br \/>\n                                 order      or    direction      to        the<br \/>\n                                 respondents to fix the pay of the<br \/>\n                                 petitioner correctly from the date<br \/>\n                                 when new pay scale came into force<br \/>\n                                 on 01.01.1996 and also to correct<br \/>\n<span class=\"hidden_text\">               2<\/span><\/p>\n<p>             the      wrong     reduction          of       his    pay<br \/>\n             scale from March 2000 to 8.10.2003<br \/>\n             for about 2700\/- each month which<br \/>\n             was      corrected        by       the     respondent<br \/>\n             University         on    8-10-2003          resulting<br \/>\n             in arrears for the unpaid period.&#8221;\n<\/p><\/blockquote>\n<p>           Learned counsel for the petitioners,<\/p>\n<p>with reference to the aforementioned prayer,<\/p>\n<p>however, would draw attention of this Court<\/p>\n<p>towards    the     facts       stated       in        Annexure-2,        a<\/p>\n<p>representation dated 10.4.2006 filed by the<\/p>\n<p>petitioner       of     both    the        cases       to    the       Vice<\/p>\n<p>Chancellor of the University as with regard<\/p>\n<p>to the anomaly in the pay fixation after the<\/p>\n<p>pay revision effected by the State Government<\/p>\n<p>in the year 2006. Let it be noted that in the<\/p>\n<p>said    representation,              the    grievance             of   the<\/p>\n<p>petitioners        is    confined          to    re-fixation             of<\/p>\n<p>their pay earlier being drawn by them in the<\/p>\n<p>pay-scale of Rs. 1800-3330\/- and its revision<\/p>\n<p>to the pay-scale of Rs. 5000-8000\/- in place<\/p>\n<p>of   Rs.   6500-10500\/-          whereas          in     the      prayer<\/p>\n<p>portion, whatever has been stated is for re-<\/p>\n<p>fixation     of         their        pay        from         1.1.1996.<\/p>\n<p>Therefore, the prayer of the petitioners is<\/p>\n<p>at variance from the demand made by them in<\/p>\n<p>their      representation              filed            before         the<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>Registrar of the University.\n<\/p>\n<p>           This       Court,         would,    therefore,       make<\/p>\n<p>it     clear     that        if      the     grievance    of     the<\/p>\n<p>petitioners is with regard to pay fixation<\/p>\n<p>from 1.1.1996, the writ application having<\/p>\n<p>been filed on 2.5.2007, the same will not be<\/p>\n<p>maintainable          but       if   the     grievance    of     the<\/p>\n<p>petitioners is confined to pay fixation of<\/p>\n<p>the    year     2006       as     appears     from     reading    of<\/p>\n<p>Annexure-2, the copy of the representation<\/p>\n<p>filed    by     the    petitioners            on    10.4.2006,    in<\/p>\n<p>that     case        the     State         Government    and     the<\/p>\n<p>University           will       be    under        obligation     to<\/p>\n<p>consider         the         said          grievance     of      the<\/p>\n<p>petitioners confined to the alleged anomaly<\/p>\n<p>in pay fixation of the petitioners in the<\/p>\n<p>pay-scale of Rs. 5000-8000\/- in place of Rs.<\/p>\n<p>6500-10500\/-.\n<\/p>\n<p>           As there is no counter affidavit by<\/p>\n<p>either         the         State       Government        or      the<\/p>\n<p>University, this Court would remit the matter<\/p>\n<p>back to the University, which in the event<\/p>\n<p>would find that the petitioners are assailing<\/p>\n<p>the Government decision with regard to the<\/p>\n<p>grant    of     pay-scale,           it     would    forward     the<br \/>\n<span class=\"hidden_text\">                       4<\/span><\/p>\n<p>      claim    of   the    petitioners       to   the    Director,<\/p>\n<p>      Higher    Education           for    taking    appropriate<\/p>\n<p>      decision. Such exercise, however, by either<\/p>\n<p>      of the respondents with regard to taking a<\/p>\n<p>      final decision confined to the petitioners<\/p>\n<p>      being placed in the pay-scale of Rs. 6500-<\/p>\n<p>      10500\/- in place of Rs. 5000-8000\/-, will be<\/p>\n<p>      taken within a period of six months from the<\/p>\n<p>      date of receipt\/production of a copy of this<\/p>\n<p>      order and the petitioners will be entitled<\/p>\n<p>      for any arrear only from the date of filing<\/p>\n<p>      of the writ application i.e. 2.5.2007.<\/p>\n<p>                Let       it   be    made    clear      that   this<\/p>\n<p>      Court, however, has not decided the merit of<\/p>\n<p>      the claim of the petitioners and has only<\/p>\n<p>      remitted the matter back to the authorities<\/p>\n<p>      to take appropriate decision in accordance<\/p>\n<p>      with law.\n<\/p>\n<p>                With the aforementioned observation<\/p>\n<p>      and direction, both of these writ applicants<\/p>\n<p>      are disposed of.\n<\/p>\n<\/p>\n<pre>Rsh                                       (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Subrata Moulik vs The State Of Bihar &amp;Amp; Ors on 9 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.5775 of 2007 Haripada Ghosh, Son of late Upendra Chandra Ghosh, C\/o Hemant Kumar Roy, G.C.
