Justice ANTONY DOMINIC\n\n Dated :05\/01\/2010\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                      ------------------\n                   WP(C) No.35431 of 2009 (Y)\n                 --------------------------\n             Dated, this the 5th day of January, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>       Challenge in this writ petition is against Ext.P4 series of<\/p>\n<p>notices issued by the 3rd respondent rejecting the applications made<\/p>\n<p>by the petitioners under Section 28A of the Land Acquisition Act on<\/p>\n<p>the ground that the applications made by the petitioners were not<\/p>\n<p>accompanied by certified copy of the awards.<\/p>\n<p>      2.   The learned counsel for the petitioners submits that the<\/p>\n<p>applications having been made within the time prescribed, these<\/p>\n<p>could not have been rejected for the aforesaid reason and placed<\/p>\n<p>reliance on the judgment of this Court in <a href=\"\/doc\/155255438\/\">Balakrishnan v. Spl.<\/p>\n<p>Tahsildar<\/a> (2006(3) KLT 1000).\n<\/p>\n<p>      3.   A reading of the aforesaid judgment shows that it has<\/p>\n<p>been held that if an application has been made within the time limit<\/p>\n<p>prescribed in Section 28A (1) of the Land Acquisition Act, such an<\/p>\n<p>application cannot be rejected for the reason that the same is not<\/p>\n<p>accompanied by certified copy of the award. Ext.P4 series of notices<\/p>\n<p>WP(C) No.35431\/2009<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>impugned in this writ petition shows that the only reason pointed<\/p>\n<p>out is that certified copy of award was not enclosed. If that be the<\/p>\n<p>only reason for rejection, Ext.P4 series of notices are against the<\/p>\n<p>principles laid down in the judgment relied on by the learned<\/p>\n<p>counsel for the petitioners.\n<\/p>\n<p>      4.    Accordingly, Ext.P4 series of notices impugned in this<\/p>\n<p>writ petition are set aside, and the writ petition is disposed of<\/p>\n<p>directing the 3rd respondent to entertain the applications made by<\/p>\n<p>the petitioners under Section 28A of the Land Acquisition Act<\/p>\n<p>ignoring the fact that the applications were not accompanied by<\/p>\n<p>certified copy of the awards provided, the applications made by the<\/p>\n<p>petitioners have been received within the time limit prescribed<\/p>\n<p>under Section 28A(1) of the Land Acquisition Act.<\/p>\n<p>      The petitioners shall produce a copy of this judgment before<\/p>\n<p>the 3rd respondent, who shall take expeditious action in this matter.<\/p>\n<p>      This writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                        (ANTONY DOMINIC, JUDGE)<br \/>\njg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kumaridevi vs State Of Kerala on 5 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 35431 of 2009(Y) 1.
