JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/10\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Mr.L.R.Pujari, learned Additional Public Prosecutor, waives service<br \/>\nof notice of Rule on behalf of the respondent. On the facts and in<br \/>\nthe circumstances of the case, and with the consent of the learned<br \/>\ncounsel for the respective parties, the application is being  heard<br \/>\nand finally decided today.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been filed under Section 439 of the Code of Criminal<br \/>\nProcedure for grant of bail in connection with FIR, being C.R.No.I-18<br \/>\nof 2009, registered with Vapi Udyognagar Police Station, Vapi Town,<br \/>\nfor offences punishable under Sections 406, 420, 465, 466, 467, 468,<br \/>\n471, 474, 484, 485 and 114 of the Indian Penal Code.\n<\/p>\n<p>3.\tBriefly<br \/>\nstated, the case of the prosecution is that the applicant and other<br \/>\naccused persons (five in number), are involved in the commission of<br \/>\nthe above-mentioned offences involving  hatching and executing a<br \/>\nconspiracy, whereby the complainant was induced to part with a huge<br \/>\nsum of money, to the tune of about 8,73,40,000\/-, in cash,  cheques<br \/>\nand Demand Drafts, a substantial part of which ultimately came to be<br \/>\ndeposited in the Bank account of accused No.1, who transferred it to<br \/>\nthe account of  accused No.2. The allegation against the applicant is<br \/>\nthat  two Drafts received by Dena Bank,Vapi Branch, where the<br \/>\napplicant was working as Manager have been transferred and credited<br \/>\nto the Bank account of  accused No.1 at Zampa Bazar Branch, Surat,<br \/>\ninstead of putting them into the Suspense Account of the  Bank. It is<br \/>\nfurther the case of the prosecution that the applicant is involved in<br \/>\nhatching a conspiracy with the other accused persons, whereby the<br \/>\ncomplainant was assured that Dena Bank has charge over certain<br \/>\nproperty which is to be  auctioned by an order of the High Court of<br \/>\nGujarat. The investigation revealed that the said order of the High<br \/>\nCourt of Gujarat is a  forged and fabricated one, on which even the<br \/>\nsignatures of the Hon&#8217;ble Judge, who is purported to have passed the<br \/>\norder, as well as the Assistant Registrar of the High Court, have<br \/>\nbeen forged. According to the prosecution, it is on the basis of the<br \/>\nabove order that the complainant and two others were assured by the<br \/>\naccused persons that they would be given charge of the  property<br \/>\nafter making payment. In this manner the complainant was made to part<br \/>\nwith an amount of about Rs.8,73,40,000\/- in cash,  Demand Drafts and<br \/>\ncheques, which came to be deposited in the account of accused No.1.\n<\/p>\n<p>4.\tMr.S.V.Raju,learned<br \/>\nSenior Advocate for the applicant has made the following submissions:\n<\/p>\n<p>(a)\tThat<br \/>\nthe applicant is not even named in the FIR and no role has been<br \/>\nattributed to him. There is no allegation that the applicant had<br \/>\nreceived or pocketed any sum of money. The allegations against Bank<br \/>\nOfficials in the FIR are general in nature and nowhere is the<br \/>\napplicant   connected with the commission of the above-mentioned<br \/>\noffences.\n<\/p>\n<p>(b)\tThat<br \/>\nthe Bank has initiated a Departmental Inquiry in which five officers<br \/>\nand three staff members have been charge-sheeted, but the applicant<br \/>\nis not one of them.\n<\/p>\n<p>(c)\tThat<br \/>\nthe allegations against the applicant to the effect that it is at his<br \/>\nbehest that the money has been credited into the account of accused<br \/>\nNo.1 and his involvement in the other offences and  forgery of the<br \/>\norder of the High Court, are not substantiated by any evidence on<br \/>\nrecord.\n<\/p>\n<p>(d)\tThat<br \/>\nthe computer print out and the FSL report regarding the computer<br \/>\nprint out of the purportedly forged order of the High Court show that<br \/>\nit has been modified on 1-4-2009, which is after the arrest of the<br \/>\napplicant.\n<\/p>\n<p>(e)\tThat<br \/>\nthe  applicant has been in custody since 8-3-2009 but other persons,<br \/>\nwho are involved in crediting the Demand Drafts into the account of<br \/>\naccused No.1 have not been arrested. In any case, most of the money<br \/>\nhas been returned by accused No.1 to the complainant.\n<\/p>\n<p>(f)\tThat<br \/>\nthe applicant is not likely to abscond or tamper with evidence, which<br \/>\nis of a documentary nature, and in the possession of the<br \/>\ninvestigating agency, therefore, no useful purpose would be served by<br \/>\nkeeping him in jail.\n<\/p>\n<p>(g)\tThat<br \/>\nthere is a change in circumstances since filing of the last bail<br \/>\napplication as the Departmental Inquiry initiated by the Bank does<br \/>\nnot name the applicant, who has been informed by the Bank that there<br \/>\nis no complaint against him.\n<\/p>\n<p>(h)\tOn<br \/>\nthe basis of the above submissions, it is urged by the learned Senior<br \/>\nAdvocate  for the applicant that the application be allowed and bail<br \/>\nmay be granted to the applicant.\n<\/p>\n<p>5.\tThe<br \/>\nbail application has been strongly opposed by Mr.L.R.Pujari, learned<br \/>\nAdditional Public Prosecutor, who has made the following submissions:\n<\/p>\n<p>(a)<br \/>\nThere is ample evidence on record to show that the applicant is very<br \/>\nmuch a part of the conspiracy hatched by the  accused persons to dupe<br \/>\nthe complainant  for parting with huge sums of money, in cash, Demand<br \/>\nDrafts and cheques.\n<\/p>\n<p>(b)\tThere<br \/>\nis cogent material  indicating  that it is at the behest of the<br \/>\napplicant that the Demand Drafts  were credited to the account of<br \/>\naccused No1, instead of going into the Suspense Account of the Bank.<br \/>\nThe Demand Drafts were received at Vapi Branch of Dena Bank where the<br \/>\napplicant was working as Manager, and were transferred to the Account<br \/>\nof accused No.1 at Zampa Branch, Surat at the instance of the<br \/>\napplicant, as is revealed by the material on record.\n<\/p>\n<p>(c)\tThere<br \/>\nis also evidence on record to indicate that the applicant is involved<br \/>\nin the conspiracy to forge the order of the High Court of Gujarat.<br \/>\nFurther, the report of the FSL is also against the applicant.\n<\/p>\n<p>(d)\tA<br \/>\nstrong prima facie case is made out against the applicant and<br \/>\nin  view of the material on record, this is not a fit case wherein<br \/>\nthe Court may exercise discretion by granting bail.\n<\/p>\n<p>6.\tHaving<br \/>\nheard  learned counsel for the respective parties and after perusal<br \/>\nof the material on record, including papers of the charge-sheet,<br \/>\nevidence and report of the F.S.L., the following aspects emerge for<br \/>\nconsideration, and have been duly considered:\n<\/p>\n<p>(i)\tThe<br \/>\nmaterial on record, prima facie, indicates that the<br \/>\nallegations against the applicant  to the effect that he is involved<br \/>\nin the conspiracy with  other accused  persons, to dupe the<br \/>\ncomplainant on the pretext that Dena Bank had charge over certain<br \/>\nproperties which were purportedly to be put to auction, on the basis<br \/>\nof a forged and fabricated order of the High Court of Gujarat,<br \/>\nappears to be well founded.\n<\/p>\n<p>(ii)\tThe<br \/>\nreport of the Forensic Science Laboratory also indicates, prima<br \/>\nfacie, the involvement of the applicant in the commission of the<br \/>\nalleged offences.\n<\/p>\n<p>(iii)The<br \/>\nmaterial on record further leads to the prima facie view that<br \/>\nthe applicant is involved in crediting of the Bank Drafts in question<br \/>\nin the account of accused No.1 at Dena Bank, Surat, while he was<br \/>\nworking in the said Bank at Vapi.\n<\/p>\n<p>(iv)\tThe<br \/>\napplicant had made an application for bail before filing of the<br \/>\ncharge-sheet, being Criminal Misc. Application No.4118 of 2009, which<br \/>\nwas permitted to be withdrawn, by order dated 9-4-2009 of this Court.<br \/>\nFurther, the applicant had once again approached this Court after<br \/>\nfiling of the charge-sheet by making Criminal Misc. Application<br \/>\nNo.7930 of 2009, which was permitted to be withdrawn by order dated<br \/>\n4-9-2009. The applicant then filed Criminal Misc. Application No.2245<br \/>\nof 2010, which was permitted to be withdrawn by order dated<br \/>\n23-6-2010, with liberty to approach the Sessions Court, on filing of<br \/>\nthe supplementary  charge-sheet. The present application has been<br \/>\nfiled after rejection of the bail application by the Sessions Court<br \/>\nby order dated 30-7-2010. There is no change in circumstances after<br \/>\nfiling of the supplementary charge-sheet and the ground urged by the<br \/>\nlearned counsel for the applicant, to the effect that the applicant<br \/>\nis not named in the Departmental Inquiry initiated by the Bank cannot<br \/>\nbe considered to be a change in circumstances, for grant of bail.<br \/>\nMoreover, the standard of proof in a Departmental Inquiry and in a<br \/>\nCriminal Trial are different, and the Trial Court is bound to<br \/>\nappreciate and evaluate the evidence on record, according to settled<br \/>\nprinciples of criminal law.\n<\/p>\n<p>(v)\tThe<br \/>\nlength of incarceration of the applicant would not be relevant in<br \/>\nview of the fact that, his prima facie  involvement in the<br \/>\ncommission of the alleged offences appears to be borne out from the<br \/>\nrecord.\n<\/p>\n<p>7.\tHaving<br \/>\ntaken into consideration the above aspects  emerging from the<br \/>\nmaterial on record, and for reasons stated herein-above, in the<br \/>\nconsidered view of this Court, the present is not a fit case wherein<br \/>\ndiscretion can be exercised  in favour of the applicant. The offences<br \/>\nalleged against the applicant are grave and serious in nature. It<br \/>\ncannot be lost sight of, that an order of the High Court is alleged<br \/>\nto have been forged, which forms the basis of the conspiracy<br \/>\nallegedly hatched by the applicant and other accused persons.\n<\/p>\n<p>8.\tIn<br \/>\nview of the totality of the facts and circumstances mentioned<br \/>\nherein-above, the application is rejected. Rule is discharged.\n<\/p>\n<p>9.\tIt<br \/>\nis made clear that the Court has  considered the matter only from the<br \/>\nperspective of bail and no observations made in this  order may be<br \/>\ntaken to have any bearing on the merits of the case.
