Justice ANTONY DOMINIC\n\n Dated :27\/07\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                W.P.(C).No.21027 OF 2009\n              ------------------------\n            Dated this the 27th day of July, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>      Petitioners are members of the 6th respondent, a Co-<\/p>\n<p>operative Bank. Their grievance in this writ petition is<\/p>\n<p>regarding Ext.P2, a final voters list published for the<\/p>\n<p>election to the Managing Committee of the 6th respondent.<\/p>\n<p>Petitioners contend that        going by Ext.P1 election<\/p>\n<p>notification and Ext.P6 bye-laws of the Society, the area of<\/p>\n<p>operation of the Society is spread over 8 wards and the final<\/p>\n<p>voters list that is now published is a consolidated one,<\/p>\n<p>without any bifurcation of the voters into different wards, in<\/p>\n<p>which the area of operation of the society is divided.<\/p>\n<p>According to the petitioners, this has           been done<\/p>\n<p>deliberately with     the mala fide intention of creating<\/p>\n<p>confusion and difficulty in identifying the voters and to<\/p>\n<p>pave way for impersonation in the election.\n<\/p>\n<p><span class=\"hidden_text\">WP(c).No.21027\/09                 2<\/span><\/p>\n<p>      2. Ext.P1 election notification and Ext.P6 bye-laws only<\/p>\n<p>provide that there shall be representation in the managing<\/p>\n<p>committee from each of the wards, over which the Society has<\/p>\n<p>its area of operation. However, there is no provision either in<\/p>\n<p>Ext.P2 notification or in Ext.P6 bye laws requiring the Society<\/p>\n<p>or the Electoral Officer to prepare voters list separately for<\/p>\n<p>each of the wards. Neither is there any provisions in the Co-<\/p>\n<p>operative Societies Act or the Rules which requires the Society<\/p>\n<p>to prepare voters list    as contended by the petitioners. If so<\/p>\n<p>the voters list cannot be said to be illegal for any reason.<\/p>\n<p>      3. As far as their grievance that the list now prepared is<\/p>\n<p>capable of being misused by creating confusion and difficulty<\/p>\n<p>in identifying the voters           leading to impersonation is<\/p>\n<p>concerned, I feel that the capability of misusing the voters<\/p>\n<p>lists itself cannot invalidate the list, requiring this court to<\/p>\n<p>exercise its extra ordinary power under Artl.2226.
