As per the instructions<br \/>\n\treceived by Mr. Yadav from the office of the Official Liquidator,<br \/>\n\ttill date, the amount has not been received by the office of the<br \/>\n\tOfficial Liquidator.\n<\/p>\n<p>Therefore,<br \/>\n\tthe Registry is directed to see that the amount of Rs.64.05 lakhs is<br \/>\n\tpaid to the Official Liquidator of  the company in liquidation by<br \/>\n\tcheque drawn in favour of the Official Liquidator.\n<\/p>\n<p>The<br \/>\n\tOfficial Liquidator has no record of the company, so it is difficult<br \/>\n\tfor  Mr. Yadav to respond to the claim preferred by the present<br \/>\n\tapplicant-deceased worker of the company in liquidation. But on<br \/>\n\tcareful consideration of the submissions made by Mr. Mehta, learned<br \/>\n\tcounsel appearing for the applicants and the nature of documents<br \/>\n\ttendered to the office of the Official Liquidator while placing the<br \/>\n\tclaim, the amount in parity with the other workers, obviously shall<br \/>\n\thave to be paid to the heirs of the deceased worker, who are the<br \/>\n\tapplicants before this Court. The deceased worker was terminated<br \/>\n\tfrom service in the year 1993 whereas he was appointed in the<br \/>\n\tcompany under liquidation on 6th February, 1965.<br \/>\n\tTherefore, the deceased worker could have been paid Rs. 3,80,000\/-<br \/>\n\tkeeping in mind the  date of closure.\n<\/p>\n<p>It<br \/>\n\tis not a matter of dispute that all other workers have been paid<br \/>\n\tsome amount as per settlement arrived at between the workers and the<br \/>\n\tmanagement at the relevant point of time and the rights of the<br \/>\n\tdeceased worker can be crystallized keeping in mind the settlement<br \/>\n\tthat was arrived at between the management and the workers. If the<br \/>\n\tdeceased worker would not have died or would have continued in<br \/>\n\tservice, he would have got the amount equal to other workers  and<br \/>\n\tthat amount, according to Mr. Mehta would be Rs. 3,80,000\/-.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tMehta is directed to provide calculation sheet to the learned<br \/>\n\tcounsel representing the Official Liquidator so that on receipt of<br \/>\n\tthe amount by the Official Liquidator from the Registry of this<br \/>\n\tCourt, further orders of disbursement can be passed.
