Justice ANTONY DOMINIC\n\n Dated :01\/08\/2007\n\n O R D E R\n                      Antony Dominic, J.\n            ========================\n                  W.P(C).No.16325 of 2004\n            ========================\n\n           Dated this the 1st day of August, 2007.\n\n                          JUDGMENT\n<\/pre>\n<p>     Petitioner had applied for the post of Second Grade<\/p>\n<p>Instructor &#8211; Kathakali-Maddhalam in the second respondent. It is<\/p>\n<p>stated that he was called for an interview and practical test and<\/p>\n<p>Ext.P8 is the memo issued in this behalf.        Eventually, on<\/p>\n<p>completion of selection process, respondents 5 and 6 were<\/p>\n<p>selected and appointed and they have joined duty with effect<\/p>\n<p>from 1.6.2004.\n<\/p>\n<p>     2. Grounds on which the selection of respondents 5 and 6 is<\/p>\n<p>sought to be invalidated are those contained in paragraph 4 of<\/p>\n<p>the Writ Petition.    According to the petitioner, Recruitment<\/p>\n<p>Committee consisted of     two persons, who were teachers of<\/p>\n<p>respondents 5 and 6. It is also stated that one of the members<\/p>\n<p>of the Selection Committee was related to the fifth respondent<\/p>\n<p>and that the sixth respondent was working in the organisation on<\/p>\n<p>temporary basis.    In the counter affidavit filed on behalf of<\/p>\n<p><span class=\"hidden_text\">WP(C)16325\/04                  -: 2 :-<\/span><\/p>\n<p>respondents 5 and 6 it is admitted that two members of the<\/p>\n<p>Recruitment Committee were their Teachers.       But the counter<\/p>\n<p>affidavit proceeds to say that there were other students of the<\/p>\n<p>second respondent organisation, who did not succeed in the<\/p>\n<p>selection process. Allegation that one of the members of the<\/p>\n<p>Recruitment Committee is related to the fifth respondent is also<\/p>\n<p>seen denied.\n<\/p>\n<p>     3. In a selection process and that too in an organisation like<\/p>\n<p>the second respondent, it is not unnatural that Teachers of the<\/p>\n<p>organisation could be members of Recruiment Committee and<\/p>\n<p>that the students of the organisation could have participated as<\/p>\n<p>applicants.   That by itself, cannot invalidate the selection.<\/p>\n<p>Therefore, participation of the two members in the Recruitment<\/p>\n<p>Committee does not advance the case of the petitioner in any<\/p>\n<p>manner. I am also not prepared to accept the allegation that one<\/p>\n<p>of the members of the Committee is related to the fifth<\/p>\n<p>respondent in the absence of any material and in the face of its<\/p>\n<p>denial. Further, even if the fifth respondent has worked in the<\/p>\n<p>second respondent in a temporary capacity, that cannot render<\/p>\n<p>him ineligible for the post, but would only be an added<\/p>\n<p><span class=\"hidden_text\">WP(C)16325\/04                 -: 3 :-<\/span><\/p>\n<p>advantage.\n<\/p>\n<p>     I do not find any merit in this Writ Petition and the same is<\/p>\n<p>dismissed.
