PATTANAIK (J)\n\nCITATION:\n 1996 SCALE  (5)543\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Notification under Section 4(1) of the Land Acquisition<br \/>\nAct, 1894  [for short, the &#8220;Act&#8221;] initially was published on<br \/>\nMay 25, 1956 acquiring a huge extent of 985.95 acres of land<br \/>\nfor industrial\tpurpose in  Durgapur. It  would appear\tthat<br \/>\nsubsequently the  notification got lapsed. Consequently, the<br \/>\nsecond notification came to be published on August 10, 1964.<br \/>\nThe Land  Acquisition Officer  determined the compensation @<br \/>\nRs.2,310\/- per acre. In this case, we are concerned with the<br \/>\nextent of  the lands  in 5 plots Sri in survey Nos.710, 735,<br \/>\n762, 824  and 912 of an extent of 0.33, 0.11, 0.63, 0.13 and<br \/>\n0.49 acres  respectively. The  reference Court\tenhanced the<br \/>\ncompensation   Rs.1,45,000\/- per acre relying upon Ext. 1(d)<br \/>\ndated April  24, 1964.\tIt is  settled law  that the similar<br \/>\nlands were  of large  extent involved for acquisition and or<br \/>\nevidence relied\t upon, even  the High  Court has doubted the<br \/>\ngenuineness of\tthis document.\tIt is  scated by the learned<br \/>\ncounsel for  the appellant  that this  document came  to  be<br \/>\nexecuted  between   the\t parties  who  are  claiming  higher<br \/>\ncompensation. It  would be  obvious  that  after  the  first<br \/>\nnotification was  issued and  before the second notification<br \/>\ncame  to   be  published  this\tdocument  was  brought\tinto<br \/>\nexistence  to\tinflate\t the   market  value.\tUnder  these<br \/>\ncircumstances, the  High Court\tin  another  case  was\twell<br \/>\njustified in  doubting the correctness of it. Unfortunately,<br \/>\nexcept that  document, there  is  no\tother  evidence\t for<br \/>\nenhancement of\tthe compensation.  But in  view of  the fact<br \/>\nthat large  extent of  the lands  are involved and we do not<br \/>\nhave the  advantage of any other evidence or assistance from<br \/>\nrespondents, we are not inclined to confirm the award of the<br \/>\nCollector. under these circumstances, we set aside the award<br \/>\nor the\tCourt and the High Court and remit the matter to the<br \/>\nreference Court\t to decide  the compensation  afresh on\t the<br \/>\nbasis of  the evidence vis-a-vis any other reference pending<br \/>\nbefore\tit  having  similar  facts  and\t decide\t the  matter<br \/>\naccording to law.\n<\/p>\n<p>     The  appeal   is  accordingly   allowed,  but,  in\t the<br \/>\ncircumstances, without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India The State Of West Bengal vs Lohit Kumar Roy on 24 July, 1996 Equivalent citations: 1996 SCALE (5)543 Author: K Ramaswamy Bench: Ramaswamy, K.
