No. M-33449 of 2008<\/p>\n<p>            Notice of motion.\n<\/p>\n<p>            On the asking of the Court, Mr.S.S. Mor, Senior Deputy<\/p>\n<p>Advocate General, Haryana, accepts notice on behalf of the State.<\/p>\n<p>            The petitioner is under incarceration following his<\/p>\n<p>conviction in a case under the N.D.P.S. Act. The plea preferred by<\/p>\n<p>him for his premature release was declined by the Competent<\/p>\n<p>Authority as he is undergoing sentence in a case under the<\/p>\n<p>N.D.P.S. Act. The Competent Authority, in support of that view,<br \/>\n<span class=\"hidden_text\"> Crl. Misc. No. M-33449 of 2008                                   2<\/span><\/p>\n<p>drew sustenance from the provisions of Section 32-A of the<\/p>\n<p>N.D.P.S. Act.\n<\/p>\n<p>             It is common ground otherwise that the relevant<\/p>\n<p>controversy is pending consideration at the hands of the Apex<\/p>\n<p>Court.\n<\/p>\n<p>             In support of the contention that the embargo indicated<\/p>\n<p>by the provisions of Section 32-A of the N.D.P.S. Act, does not<\/p>\n<p>affect the jurisdictional powers of the Governor of the State to<\/p>\n<p>grant remission in exercise of powers under Section 161 of the<\/p>\n<p>Constitution of India, the learned counsel for the petitioner relies<\/p>\n<p>upon two judgments rendered by this Court in Ekka Ram vs. State<\/p>\n<p>of Punjab in Criminal Writ Petition No. 839 of 2004 decided on<\/p>\n<p>14.09.2005 and <a href=\"\/doc\/1768134\/\">Baldev Singh vs. State of Punjab<\/a> in Criminal<\/p>\n<p>Writ Petition No. 79 of 2005 decided on 1.3.2005. The judgment<\/p>\n<p>in Ekka Ram&#8217;s case (supra) is under challenge before the Apex<\/p>\n<p>court in an SLP filed by the State of Punjab.<\/p>\n<p>             The learned State counsel does not controvert that<\/p>\n<p>proposition on fact. The pure and simple plea raised on behalf of<\/p>\n<p>the petitioner is that if the disposal of the SLP is delayed, even an<\/p>\n<p>ultimate favourable decision would be of no use because the<\/p>\n<p>petitioner &#8211; prisoner would have undergone the entire period of<\/p>\n<p>sentence by that time.\n<\/p>\n<p>             A similar eventuality was adjudicated upon by a<\/p>\n<p>Coordinate Bench of this Court (Satish Kumar Mittal, J.) in Criminal<\/p>\n<p>Misc. No. 51171-M of 2006 (Mahi Ram Vs. The Secretary &amp;<br \/>\n<span class=\"hidden_text\"> Crl. Misc. No. M-33449 of 2008                                     3<\/span><\/p>\n<p>Financial Commissioner to Government of Haryana and others)<\/p>\n<p>and the following order was passed on 08.11.2006:<\/p>\n<blockquote><p>             &#8220;It is ordered that in the meanwhile, the petitioner be<\/p>\n<p>             temporarily released, if he fulfills the following terms<\/p>\n<p>             and conditions:\n<\/p><\/blockquote>\n<blockquote><p>      i)     Before     releasing   the   petitioner,   the   concerned<\/p>\n<p>             Superintendent of Jail will verify the period undergone<\/p>\n<p>             by the convict and the remissions granted under Article<\/p>\n<p>             161 of the Constitution of India and that if after<\/p>\n<p>             subtracting the period on parole, the convict has<\/p>\n<p>             undergone the sentence awarded by the Court, he<\/p>\n<p>             shall be released temporarily on bail to the satisfaction<\/p>\n<p>             of the Chief Judicial Magistrate during the pendency of<\/p>\n<p>             Special Leave Petition filed by State of Punjab in case<\/p>\n<p>             Ekka Ram [SLP (Crl.) No. 2496 of 2006] arising from<\/p>\n<p>             the final judgment and order dated 14.09.2005 passed<\/p>\n<p>             in Criminal Writ Petition No. 839 of 2004. The convict<\/p>\n<p>             concerned be granted the benefit of remission as per<\/p>\n<p>             the circulars issued by Government of Punjab under<\/p>\n<p>             Article 161, after his conviction.\n<\/p><\/blockquote>\n<blockquote><p>      ii)    The petitioner will remain on bail during the pendency<\/p>\n<p>             of S.L.P. No. 2496 of 2006 in the Apex Court. If as per<\/p>\n<p>             the judgment of the Apex Court, benefit of remission<\/p>\n<p>             under Article 161 is not granted, the convict will<\/p>\n<p>             surrender back in jail for undergoing the unexpired<\/p>\n<p>             period of sentence.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Crl. No. M-33449 of 2008                                      4<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>      iii)   At the time of release on bail, the petitioner will give an<\/p>\n<p>             undertaking that he will not leave the country without<\/p>\n<p>             prior permission of the Court and will keep peace and<\/p>\n<p>             will continue informing the Chief Judicial Magistrate<\/p>\n<p>             concerned his residential address from time to time.&#8221;<\/p><\/blockquote>\n<p>             This petition involving facts, which are exactly similar to<\/p>\n<p>those involved in Mahi Ram&#8217;s case (supra), shall stand disposed of<\/p>\n<p>in terms of order Annexure P\/3.\n<\/p>\n<\/p>\n<pre>December 18, 2008                                       (S.D.
