Justice K.HEMA\n\n Dated :21\/07\/2008\n\n O R D E R\n                           K.HEMA, J.\n                --------------------------------------\n                 Bail Application No.4396 of 2008\n                ---------------------------------------\n               Dated this the 21st day of July, 2008\n\n\n                             O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.\n<\/p>\n<p>     2.   The alleged offences are under Sections 420, 465,<\/p>\n<p>467, 468 and 471 read with Section 120(B) of IPC. According to<\/p>\n<p>the prosecution, the first petitioner was engaged in a business in<\/p>\n<p>exporting and importing of gold ornaments. The defacto<\/p>\n<p>complainant was engaged in purchasing gold and manufacture of<\/p>\n<p>ornaments and thereafter, he supplied the same to various<\/p>\n<p>business concerns. On 15.10.2003, an agreement was executed<\/p>\n<p>between the defacto complainant and the first petitioner that gold<\/p>\n<p>ornaments will be imported by the petitioner on the guarantee<\/p>\n<p>given by the defacto complainant for Rs.20 lakhs before the<\/p>\n<p>Bank. It was also agreed that after one year, the amount will be<\/p>\n<p>paid by the first petitioner and the documents will be redeemed<\/p>\n<p>from the Bank.     On these terms, the property of the defacto<\/p>\n<p>complainant having an extent of 2 acre 17 cents were mortgaged<\/p>\n<p>before the Canara Bank main branch. Various other properties<\/p>\n<p>were also mortgaged as guarantee. But the documents were not<\/p>\n<p><span class=\"hidden_text\">BA 4396\/08                         2<\/span><\/p>\n<p>redeemed in spite of expiry of the period.        On enquiry, it is<\/p>\n<p>understood that instead of Rs.20 lakhs, the petitioners have<\/p>\n<p>fraudulently raised an amount of Rs.1 Crore 14 lakhs by creating<\/p>\n<p>false documents in collusion with the Bank officials. A complaint<\/p>\n<p>was lodged by the defacto complainant before the police based<\/p>\n<p>on which a crime was registered.\n<\/p>\n<p>     3.    Learned counsel for the petitioners submitted that<\/p>\n<p>there are civil suits between the petitioners and the defacto<\/p>\n<p>complainant relating to money transactions.            The present<\/p>\n<p>complaint is lodged only with a view to pressurise the petitioners<\/p>\n<p>to settle the civil dispute, it is submitted. It is pointed out that<\/p>\n<p>when there was an apprehension of arrest on the basis of a<\/p>\n<p>complaint lodged by the defacto complainant, first petitioner<\/p>\n<p>moved B.A.No.3384\/2007 before this Court and it was submitted<\/p>\n<p>by learned public prosecutor that no crime was registered against<\/p>\n<p>the petitioner and that he was only summoned in connection with<\/p>\n<p>an enquiry in a petition filed by the defacto complainant.<\/p>\n<p>Anticipatory bail application was disposed of and the defacto<\/p>\n<p>complainant withdrew that petition. Subsequently, the present<\/p>\n<p>complaint is lodged with a view to harass the petitioner with the<\/p>\n<p><span class=\"hidden_text\">BA 4396\/08                         3<\/span><\/p>\n<p>help of the police, it is submitted.\n<\/p>\n<p>      4.    On hearing both sides, it appears that       as per the<\/p>\n<p>allegations, the bank officials have created false documents by<\/p>\n<p>obtaining the petitioners signature from various documents for<\/p>\n<p>raising Rs.1 crore 14 lakhs as against Rs.20 lakhs which the<\/p>\n<p>defacto complainant had agreed to raise. It also appears that<\/p>\n<p>this is an offshoot of a series of civil disputes and violation of an<\/p>\n<p>agreement executed between the parties.\n<\/p>\n<p>      I heard the learned counsel for the defacto complainant and<\/p>\n<p>the learned public prosecutor also. Counsel for the defacto<\/p>\n<p>complainant submitted that there are materials to incriminate the<\/p>\n<p>petitioner and in case, if bail is granted, the petitioners will leave<\/p>\n<p>the country and they will not be available for trial.<\/p>\n<p>      In such circumstances, I find that anticipatory bail can be<\/p>\n<p>granted to the petitioners on conditions.\n<\/p>\n<p>      Hence, the following order is passed:\n<\/p>\n<p>      (1) The petitioners shall surrender before the Investigating<\/p>\n<p>      officer within seven days from today and make themselves<\/p>\n<p>      available for interrogation.\n<\/p>\n<p>      (2) Thereafter, in the event of arrest of the petitioners, if<\/p>\n<p><span class=\"hidden_text\">BA 4396\/08                         4<\/span><\/p>\n<p>    any, they shall be produced before the Magistrate court<\/p>\n<p>    concerned in accordance with law.\n<\/p>\n<p>    (3) On production of the petitioners before the Magistrate<\/p>\n<p>    court concerned, they shall be released on bail on their<\/p>\n<p>    executing bond for Rs.50,000\/- each with two solvent<\/p>\n<p>    sureties each for the like sum to the satisfaction of the<\/p>\n<p>    Magistrate court on the following conditions:<\/p>\n<blockquote><p>          (i) The petitioners shall report before the Investigating<\/p>\n<p>               officer as and when directed.\n<\/p><\/blockquote>\n<blockquote><p>         (ii) The petitioners shall co-operate with the investigation.<\/p>\n<\/blockquote>\n<blockquote><p>         (iii) The petitioners shall not leave the Kerala State except<\/p>\n<p>               with the prior permission of the learned Magistrate.<\/p>\n<\/blockquote>\n<blockquote><p>         (iv) The petitioners shall surrender before the passport, if<\/p>\n<p>               any, before the Magistrate court concerned within<\/p>\n<p>               seven days from release of the petitioners on bail.<\/p>\n<\/blockquote>\n<blockquote><p>         (v) The petitioners shall not tamper with evidence<\/p>\n<p>               influence or threaten any witness while on bail.<\/p>\n<p>        The petition is allowed.<\/p><\/blockquote>\n<p>                                               K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.P.S.
