    As per the order passed in C.M.P.776\/2008 filed<\/p>\n
under section 451 of Code of Criminal Procedure<\/p>\n
petitioner  deposited Rs.35,000\/- before Judicial<\/p>\n
First Class Magistrate, Pattambi.  The lorry KLO\/9-<\/p>\n
T.3087 was seized by the Police for transporting<\/p>\n
river sand illegally. Crime No.65\/2008 of Thrithala<\/p>\n
Police  Station  was  registered  for  the  offence<\/p>\n
punishable under section 12 read with section 20 of<\/p>\n
Kerala Protection of River Banks and Regulation of<\/p>\n
Removal  of  Sand  Act,  2001.    Subsequently  the<\/p>\n
District   Collector    passed    an    order    of<\/p>\n
confiscation.  According to petitioner, he remitted<\/p>\n
Rs.21,000\/-  as directed by the District Collector<\/p>\n
and he is entitled to get back the amount deposited<\/p>\n
before the court as directed by the order in<\/p>\n
C.M.P.776\/2008.  He filed C.M.P.2023\/2008 for the<\/p>\n
above purpose.   Learned Magistrate dismissed the<\/p>\n
CRRP 2268\/2008             2<\/span><\/p>\n
application holding that a final report is yet to<\/p>\n
be filed and before disposing     the case it cannot<\/p>\n
be granted.      Revision is filed challenging that<\/p>\n
order.\n<\/p>\n
     2.     Learned counsel appearing for petitioner<\/p>\n
and learned Public Prosecutor were heard.<\/p>\n
     3.      The order in C.M.P.776\/2008 was passed<\/p>\n
under section 451 of Code of Criminal Procedure<\/p>\n
granting interim custody of the vehicle.      Learned<\/p>\n
Magistrate was justified in holding that without a<\/p>\n
final report submitted by the Police as provided<\/p>\n
under section 173 of Code of Criminal Procedure,<\/p>\n
the amount deposited by the petitioner in court<\/p>\n
pursuant to the order passed under section 451 of<\/p>\n
Code of Criminal Procedure cannot be allowed to be<\/p>\n
withdrawn.     Learned counsel submitted that a final<\/p>\n
report     was  submitted.    Learned   counsel  also<\/p>\n
submitted that    the order shows that petition could<\/p>\n
be allowed only after disposal of the case.    It is<\/p>\n
pointed out that when confiscation order was passed<\/p>\n
by the District Collector, there is no necessity<\/p>\n
CRRP 2268\/2008            3<\/span><\/p>\n
for retaining the vehicle and therefore a final<\/p>\n
order could be passed.   If a final report is filed<\/p>\n
by the police under section 173 of Code of Criminal<\/p>\n
Procedure learned Magistrate can pass an order<\/p>\n
allowing the petitioner to withdraw the amount<\/p>\n
deposited, provided the vehicle is not necessary<\/p>\n
for the trial of the case.        Petitioner is at<\/p>\n
liberty to file a fresh application before the<\/p>\n
Magistrate. If a final report is filed    Magistrate<\/p>\n
is directed to pass appropriate order in accordance<\/p>\n
with law.\n<\/p>\n
     Criminal Revision Petition is disposed of.<\/p>\n
