PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2011  \n \nORAL ORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr Kodekar, waives service of notice of rule for and on<br \/>\nbehalf of State.\n<\/p>\n<p>\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nSinor Police Station, Dist. Vadodara vide C.R.No.I-14 of 2010  for<br \/>\nthe offences punishable under Sections 363, 366, 376, 506(2) read<br \/>\nwith Section 114 of IPC.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr YJ Patel for the applicant-accused and Mr<br \/>\nKodekar, learned APP for the State. Perused the FIR and papers of the<br \/>\nchargesheet.\n<\/p>\n<p>\tConsidering<br \/>\nthe role ascribed to the applicant-accused and the nature of<br \/>\nallegations levelled against the applicant-accused in the FIR, I am<br \/>\npersuaded to exercise my  discretion in favour of the<br \/>\napplicant-accused taking into consideration the following aspects :-\n<\/p>\n<p>(1)\tThere<br \/>\nare no allegations against the applicant-accused so far as the<br \/>\noffence punishable under Section 376 IPC is concerned;\n<\/p>\n<p>(2)\tThe<br \/>\naccused-applicant has been arraigned in the present case as an<br \/>\nabettor. He is stated to have abetted the commission of offence by<br \/>\nproviding his vehicle- Maruti Van in which  the main accused  and the<br \/>\nprosecutrix has been stated to have fled away.\n<\/p>\n<p>(3)\tInvestigation<br \/>\nis over and chargesheet is filed;\n<\/p>\n<p>\tIn<br \/>\nthis view of the matter, the accused-applicant is ordered<br \/>\nto be released on bail in connection with offence registered with<br \/>\nSinor Police Station, District: Vadodara being C.R.No.I-14 of 2010 on<br \/>\nhis executing a bond in the sum of Rs.25,000\/- (Rupees Twenty five<br \/>\nthousand only) with one surety of the like amount to the satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall,<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 2nd<br \/>\n\tand 4th Sunday of every month between 10:00 am to 2:00<br \/>\n\tpm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>shall<br \/>\n\tnot enter village Damnagar, Taluka Sinor till the conclusion of the<br \/>\n\ttrial;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
