PUBLIC\nPROSECUTOR for\nRespondent. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure, 1973 seeking regular bail by the applicant, who came to be<br \/>\narrested in connection with FIR registered as M. Case No. 1 of 2010<br \/>\nof Bhadarva Police Station for the offence punishable under Sections<br \/>\n465, 466, 467, 468, 471, 472, 474 and 114 of the Indian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr. Shukla submitted that the applicant is an innocent<br \/>\nperson and he has been falsely implicated in the commission of the<br \/>\nalleged offence. He further submitted that considering the role<br \/>\nattributed to the applicant in the FIR,  this is a fit case to<br \/>\nrelease the applicant on regular bail.  Learned advocate further<br \/>\nsubmitted that co-accused have also been released on regular bail by<br \/>\na co-ordinate Bench of this Court, and even on the ground of parity,<br \/>\nthe applicant may be released on bail.\n<\/p>\n<p>3.\tLearned<br \/>\nAddl. Public Prosecutor Mr. Raval, while opposing bail application<br \/>\nsubmitted that considering the role attributed to the applicant and<br \/>\nthe manner in which the offence is committed, discretionary relief<br \/>\nmay not be exercised in favour of the applicant, and the application<br \/>\ndeserves to be dismissed.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned advocate Mr. Shukla for the  applicant and Mr. Raval, learned<br \/>\nAPP. I have considered the averments made in the application as well<br \/>\nas the FIR produced on record. I have also perused the provisions of<br \/>\nsection 465, 466, 467, 468, 471, 472, 474 and 114 of the Indian Penal<br \/>\nCode and quantum of punishment. Co-accused are also enlarged on bail<br \/>\nby a co-ordinate Bench of this  Court and copy of orders passed in<br \/>\nCriminal Misc. Applications No. 9459 of 2010, 8246 of 2010 and 9456<br \/>\nof 2010 are also perused by me and I am of the view that even on the<br \/>\nground of parity, the applicant is required to be enlarged on regular<br \/>\nbail. Considering the above and the role alleged against the<br \/>\napplicant,  I am of the view that the the  applicant is required to<br \/>\nbe enlarged on regular bail at this stage, without entering into the<br \/>\nmerits of the case and without discussing the evidence in detail.\n<\/p>\n<p>5.\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the  applicant is ordered to be enlarged on bail in connection<br \/>\nwith M. Case No. 1 of 2010 of Bhadarva Police Station on executing a<br \/>\nbond of Rs.10,000\/- [Rupees ten thousand only] with one surety of the<br \/>\nlike amount to the satisfaction of the trial court and subject to the<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender<br \/>\nhis passport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e].\tmark<br \/>\nhis presence at  Bhadarva Police Station on any day of every first<br \/>\nweek of English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f].\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the  applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>11.\tDirect<br \/>\nService is permitted.\n<\/p>\n<pre>mathew\t\t\t\t\t\t[H.B.ANTANI,\nJ.]\n\n    \n\n \n\t   \n      \n      \n\t    \n\t\t   \u00a0\u00a0\u00a0\n\t   \n      \n\t  \t    \n\t\t   Top\n\t   \n      \n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court ========================================================= vs Mr Kp Raval on 15 October, 2010 Author: H.B.Antani,&amp;Nbsp;
