JUSTICE JAYA ROY\n                                       ----\n           For the Petitioner :  Mr. Arvind Kumar Lall\n           For the State      :  Mr. S.Maji, A.P.P.\n           For the O.P.No.2      Mr.\n\n\n04\/ 21.09.2011<\/pre>\n<p>          Heard the counsel for the petitioner and the counsel<\/p>\n<p>           for the State.\n<\/p>\n<p>                               The petitioner is apprehending his arrest in this<\/p>\n<p>           case which has been registered for the offence committed under<\/p>\n<p>           Section 138 of N.I.Act and under Section 420 of the Indian Penal<\/p>\n<p>           Code, pending in the court of Chief Judicial Magistrate, Koderma.<\/p>\n<p>                               Considering the facts and circumstances of the<\/p>\n<p>           case, I direct the petitioner namely Ravi Shankar Mishra to<\/p>\n<p>           deposit a sum of Rs.20,000\/- (Twenty Thousand) before the trial<\/p>\n<p>           court within a period of one month from the date of this order i.e<\/p>\n<p>           21.9.2011 and surrender before the trial court within the said<\/p>\n<p>           period, and if he so deposits the said amount and surrenders<\/p>\n<p>           within the aforesaid period, the trial court is directed to release<\/p>\n<p>           the petitioner above named on bail, on furnishing bail bond of<\/p>\n<p>           Rs.10,000\/- (Ten Thousand), with two sureties of the like amount<\/p>\n<p>           each, to the satisfaction of the trial court \/Chief Judicial<\/p>\n<p>           Magistrate, Koderma, in connection with Complaint Case<\/p>\n<p>           No.C-593 of 2008, subject to the conditions that one of the bailors<\/p>\n<p>           will be his close relative and another will be of local resident<\/p>\n<p>           having immovable property within the jurisdiction of the trial court<br \/>\n concerned and subject to the conditions laid down under Section<\/p>\n<p>438(2) Cr.P.C.\n<\/p>\n<p>                   However, the trial court will not release the<\/p>\n<p>aforesaid amount in favour of any of the parties till the conclusion<\/p>\n<p>of the trial and it will release the aforesaid amount subject to the<\/p>\n<p>result of the case, and the trial court will not be prejudiced in trial<\/p>\n<p>for the deposit of the said amount.\n<\/p>\n<p>                                                (JAYA ROY, J.)<\/p>\n<p>SI\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Ravi Shankar Mishra vs State Of Jharkhand &amp; Anr on 21 September, 2011 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2421 of 2011 &#8212;- Ravi Shankar Mishra &#8230;&#8230;&#8230;.
