Justice V.GIRI\n\n Dated :23\/09\/2009\n\n O R D E R\n                           V.GIRI, J\n                        .......................\n                     W.P.(C).25788\/2009\n                        .......................\n          Dated this the 23rd day of September, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>     Petitioner   is  an    Under         Secretary in  the  Law<\/p>\n<p>Department. While so, he was appointed as Secretary of the<\/p>\n<p>Tribunal for Local Self Government Institutions.<\/p>\n<p>2.   He was placed under suspension in connection with a<\/p>\n<p>complaint filed by a Legal Assistant Grade-I in the Law<\/p>\n<p>Department. He challenged the order of suspension and by<\/p>\n<p>Ext.P4, this Court directed the Government to consider the<\/p>\n<p>application for revocation of suspension.          By Ext.P5, the<\/p>\n<p>Government decided to reinstate him without prejudice to the<\/p>\n<p>disciplinary action to be initiated against him and also<\/p>\n<p>directed that he be posted outside the Government<\/p>\n<p>Secretariat. Accordingly he was reinstated and posted on<\/p>\n<p>other duty as a Draftsman in the Official Language<\/p>\n<p>(Legislative) Commission. He continues in the said post.<\/p>\n<p>3.   Ext.P7 is the gradation list of Legal Assistants and it is<\/p>\n<p>seen that     Sl.No.62 one R.Vijayakumar is junior to the<\/p>\n<p>W.P.(C).25788\/09<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>petitioner, who is listed against Sl.No.58.       This fact is<\/p>\n<p>projected by the petitioner to show that juniors to him have<\/p>\n<p>been given higher grade in the category of Under Secretary,<\/p>\n<p>in terms of the Pay Revision Order. A request made by the<\/p>\n<p>petitioner vide Ext.P9 for sanctioning higher grade in the<\/p>\n<p>scale of Rs.16650 &#8211; 23200 was considered and rejected by<\/p>\n<p>the Government as per Ext.P10. Same is under challenge in<\/p>\n<p>this writ petition. Paragraph 5 of Ext.P10 reads as follows.<\/p>\n<p>           On receipt of the judgment read as 2nd<\/p>\n<p>           paper above, Government have examined<\/p>\n<p>           the matter in detail.     The disciplinary<\/p>\n<p>           proceedings initiated against Sri.B.Bose,<\/p>\n<p>           Under Secretary, Law Department are not<\/p>\n<p>           yet finalized and his suspension period has<\/p>\n<p>           not been regularized.      The promotion<\/p>\n<p>           during    the  currency    of  disciplinary<\/p>\n<p>           proceedings    may    be   interpreted  as<\/p>\n<p>           condonation    of      misconduct.     The<\/p>\n<p>           petitioner&#8217;s name will be considered for<\/p>\n<p>           promotion if he is exonerated or acquitted<\/p>\n<p>           from the charges leveled against him. In<\/p>\n<p>           the above circumstances,      the claim of<\/p>\n<p>           Sri.B.Bose,    Under     Secretary,    Law<\/p>\n<p>           Department for promotion to Higher<\/p>\n<p>           Grade cannot be considered at present<\/p>\n<p>W.P.(C).25788\/09<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>           and the request is rejected. The order of<\/p>\n<p>           the Honourable High Court in W.P.(C).<\/p>\n<p>           6418\/2009 is complied with accordingly.<\/p>\n<p>4.   A statement has been filed on behalf of the 1st<\/p>\n<p>respondent. The stand taken in Ext.P10 is reiterated in the<\/p>\n<p>statement.      It is also contended   that the petitioner&#8217;s<\/p>\n<p>probation in the post of Under Secretary has not been<\/p>\n<p>declared so far.     Since he is involved in a criminal case<\/p>\n<p>directly in connection with his official capacity, his work<\/p>\n<p>and conduct had not been declared as satisfactory. This, it<\/p>\n<p>is contended, stands in the way of the higher grade being<\/p>\n<p>granted to the petitioner.\n<\/p>\n<\/p>\n<p>5.   I heard learned counsel on either side. Higher grade<\/p>\n<p>in the same post is based on the seniority and completion of<\/p>\n<p>a requisite number of years of service. It is not a cadre<\/p>\n<p>based for promotion. Nor is it a promotion to a selection<\/p>\n<p>post.     Petitioner has been reinstated in service and<\/p>\n<p>disciplinary proceedings are pending. These are not factors<\/p>\n<p>that should stand in the way of the petitioner being granted<\/p>\n<p>higher grade in the category of Under Secretary. The stand<\/p>\n<p>taken by the Government in Ext.P10 is unsustainable.<\/p>\n<p>W.P.(C).25788\/09<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>6.    In the result, Ext.P10 is quashed. 1st respondent is<\/p>\n<p>directed to pass orders granting grade promotion to the<\/p>\n<p>petitioner as Under Secretary (Higher Grade). Same may<\/p>\n<p>be granted with effect from the date of the order which the<\/p>\n<p>Government is to pass.        Such orders shall be without<\/p>\n<p>prejudice to the pendency of the disciplinary proceedings or<\/p>\n<p>continuation of the same against the petitioner.
