Patel was<br \/>\nappearing on behalf of respondent No.1. Today, learned advocate Mr.<br \/>\nPatel submitted that now, he is not appearing in this matter and he<br \/>\nhas already written a letter to respondent No.1 as well as his Union<br \/>\nby registered A.D. Post on 11th March, 2011 stating that<br \/>\nhe is now retiring from this matter and they have to engage another<br \/>\nadvocate in his absence. In the said letters, learned advocate Mr.<br \/>\nPatel has specifically mentioned date of hearing 25th<br \/>\nMarch, 2011. Learned advocate Mr. Patel placed on record letters<br \/>\nwritten to respondent No.1 and his Union and acknowledgment.<br \/>\nAccordingly, letters and its acknowledgment are ordered to be taken<br \/>\non record.\n<\/p>\n<p>\tEven<br \/>\nthough, today, neither respondent No.1 nor any advocate is present on<br \/>\nhis behalf before this Court.\n<\/p>\n<p>\tConsidering<br \/>\nhis aforesaid letter dated 11th March, 2011, learned<br \/>\nadvocate Mr. Chirag B. Patel is permitted to retire from present<br \/>\nproceedings.\n<\/p>\n<p>\tIn<br \/>\nlight of these facts, issue fresh NOTICE to respondent<br \/>\nNo.1 returnable on  20 th<br \/>\nApril, 2011, specifying the fact that Mr. Chirag B.<br \/>\nPatel, learned advocate, is now not appearing in this matter on his<br \/>\nbehalf and he has to proceed with matter either personally or engage<br \/>\nany advocate on his behalf to proceed with matter on next returnable<br \/>\ndate, if he desired, otherwise, this Court will proceed with matter<br \/>\nin absence of respondent No.1.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Joshi submitted that pursuant to order passed by this<br \/>\nCourt on 10th March, 2011, petitioner has issued<br \/>\nreinstatement order dated 14th March, 2011 in favour of<br \/>\nrespondent No.1 and sent to his Union &#8211; Bhavishya Mazdoor<br \/>\nSangh. In pursuance of letter dated 14th March, 2011,<br \/>\nSecretary of Union has written a letter to petitioner on 22nd<br \/>\nMarch, 2011 stating therein that workman has already left the State<br \/>\nof Gujarat and went to his native place situated in State of Orissa,<br \/>\ntherefore, Union has also not able to contact workman. It is also<br \/>\nmade clear by his Union in its said letter that as and when workman<br \/>\nwill return from his native, he will give advise to contact<br \/>\nimmediately his advocate. Learned advocate Mr. Joshi placed on record<br \/>\nentire correspondence.
