According to the<br \/>\napplicants, the respondent herein has committed breach of several<br \/>\nconditions imposed by the aforesaid order and as such the said<br \/>\nconditions are required to be deleted. It is in these circumstances<br \/>\nthat the applicants have moved the present application seeking the<br \/>\nrelief noted herein above.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe light of the controversy involved in this application it may be<br \/>\npertinent to refer to condition No.3 in the order dated 16.09.1992,<br \/>\nwhich reads thus:\n<\/p>\n<p> 3.\tThe<br \/>\npetitioner will not raise any dispute and he will surrender the truck<br \/>\nto the Respondent no.2 if the final order is passed in favour of the<br \/>\nState and respondent would be entitled to proceed further in<br \/>\naccordance with law.\n<\/p>\n<p>5.\t\tOn<br \/>\na plain reading of condition No.3, it is apparent that the same<br \/>\nprovides that the respondent would not raise any dispute and that he<br \/>\nwould surrender the truck to the applicant No.2 if the final order is<br \/>\npassed in favour of State. In the order dated 16.09.1992 itself the<br \/>\napplicants were given liberty to proceed further in accordance with<br \/>\nlaw in case the final order was passed in favour of State. In the<br \/>\ncircumstances in the opinion of this Court, the application is<br \/>\nmisconceived, inasmuch as, the applicants could have taken<br \/>\nappropriate action in case of breach of conditions.  Deletion of<br \/>\nconditions as prayed for would on the contrary weaker the case of the<br \/>\napplicants and strengthen the case of the respondent. Insofar as the<br \/>\norder of confiscation is concerned, on a plain reading of the order<br \/>\ndated 16.06.1992 it is apparent that liberty was granted by the Court<br \/>\nto the applicants to proceed further in accordance with law.  Hence,<br \/>\nthere was no impediment in the way of applicants in proceeding<br \/>\nfurther pursuant to the order of confiscation.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above discussion, no case is made out for grant of any of<br \/>\nthe reliefs prayed for.
